SKK Migas Clarify the Findings of State Losses



Special Unit for Upstream Oil and Gas Activities (SKK Migas) and the Supreme Audit Agency (BPK) has conducted a follow-up discussion on the results of the consolidated financial year 2015.

     In the report states, the state lost revenue of US $ 1.18 billion. In response, SKK Migas and the Cooperation Contract Contractor (KKKS) have taken a number of steps.

"The BPK audit report is an important source of information for SKK Migas, both in the form of correction of adjustment of profit-sharing calculation and other relevant evidence," said Head of Program and Communication Division of SKK Migas Wisnu Prabawa Taher, in a press release on Wednesday (15/1) 1).

     Dalam laporan tersebut menyebutkan, negara kehilangan penerimaan sebesar US$ 1,18 miliar. Menanggapi itu, SKK Migas dan Kontraktor Kontrak Kerja Sama (KKKS) telah melakukan sejumlah langkah. 

"Laporan hasil pemeriksaan BPK tersebut menjadi sumber informasi penting bagi SKK Migas, baik bukti berupa koreksi penyesuaian perhitungan bagi hasil maupun bukti lainnya yang relevan," ujar Kepala Divisi Program dan Komunikasi SKK Migas Wisnu Prabawa Taher, dalam siaran pers, Rabu (15/1 1).

Beberapa hal yang sudah dilakukan antara lain adalah pengiriman tanggapan SKK Migas dan KKKS atas materi temuan tersebut, pengiriman tanggapan atau action plan atas konsep hasil pemeriksaan BPK dan pengiriman tanggapan SKK Migas atas laporan hasil pemeriksaan. 

    Hal terakhir yang sudah dilakukan adalah pelaksanaan pembahasan tindak lanjut dengan BPK. Hasil pembahasan dimasukkan dalam berita acara pembahasan SKK Migas, KKKS dan BPK. 

"Dari pembahasan tersebut, telah dapat didokumentasikan bukti-bukti penyelesaian tindak lanjut atas nilai hasil pemeriksaan sebesar US$ 842,47," ujar Wisnu. Sisanya sebesar US$ 325,67 juta masih terus ditelusuri.

PGN and Pertamina for Natural Gas Supply PLN



PLN is holding a tender for gas infrastructure for central Indonesia

PT Perusahaan Gas Negara Milik (PGN) together with a consortium of PT Pertamina and Engie, a French company, passed the first stage of tender gas infrastructure for Central Indonesia organized by PT Perusahaan Listrik Negara (PLN). The PGN-Pertamina-Engie Consortium is preparing for the second phase of selection, which is natural gas commercial offerings.

So far, PGN is quite confident the project will belong to the consortium it follows. Understandably, only the PGN consortium passed the first phase of the tender for Central Indonesia's gas infrastructure.

"Of the many that we participate in, one already announces, but stage one, that is Central Indonesia, it is definitely PGN and
Pertamina, "said Mugiono, President Director of PGN LNG Indonesia, Wednesday (15/11).

In the consortium, the three companies have shares of approximately 30% each. Pertamina is still the majority shareholder, because its shares are slightly larger than PGN and Engie.

If it passes the second phase of the tender for the Central Indonesia gas project, the consortium will then seek its funds. The investment value of Central Indonesia's gas infrastructure project, Mugiono said, is around US $ 1 billion.

This consortium has been thinking of doing project financing aka loans to finance this project. If you already get a loan, the next stage is to do financial closing within the span of six months to 12 months. The next process is the Gas Sale and Purchase Agreement and build the infrastructure in ten locations.

"This is the biggest project in the world, it has never been like this," Mugiono claims.

In this Central Indonesia project, the PGN consortium will build floating storage regasification units (FSRUs), receiving terminals, to operate gas transport vessels that will connect 10 locations in the central Indonesia region in Kalimantan, Sulawesi and Nusa Tenggara West (NTB).

"There is one FSRU, two LNG feeder vessels, small LNG vessels are around, so the ship will carry LNG from the FSRU delivered to the cluster and will be divided into two clusters, so there are two LNG feeder," he explained.

Mugiono said the project requires natural gas of about 150 million cubic feet per day, aka million standard cubic feet per day (mmscfd). The gas supply will be taken from the consortium of domestic gas production.

"This year and next year, still a surplus, Head of SKK Migas said there are still 70 LNG cargoes next year, next year still
which is uncommitted, "Mugiono said.

If domestic gas supply declines, Pertamina has prepared sufficient LNG supply for this project.

"From the domestic market, Pertamina has LNG portfolio as well, so it is safe, Pertamina has LNG supply, infrastructure development," said Mugiono.

In addition, PGN still has cheap gas supplies from the United States, namely from Fasken Block. The subsidiary of PGN in the upstream oil and gas sector, Saka Energi Indonesia is indeed noted to have about 36% stake in Fasken Block.

"At any time if domestic LNG prices are less competitive, PGN will bring gas from America, it's cheap shale gas," he said.

Overall, PGN is optimistic about LNG business prospects and potential after this central Indonesia project. Currently, only western Indonesia already has facilities and gas infrastructure.

Part of the new gas infrastructure was built by issuers of shares coded PGAS on the Indonesia Stock Exchange. Its location is in Sumatra, South Sumatra West Java (SSWJ), Duri-Dumai, Singapore or infrastructure in Java Island.

"But if we talk Borneo, Sulawesi, Papua moreover, it must use LNG, because the number is small, spread far," explained Mugiono.

Mugiono is optimistic that in the future the company's LNG business will replace the gas pipeline business in PGN.

"Along with the decline in conventional gas reserves, LNG will replace the main role of gas pipelines," he said.

PGN dan Pertamina Pasok Gas Alam PLN


PLN sedang mengadakan tender infrastruktur gas untuk Indonesia tengah

PT Perusahaan Gas Negara Milik (PGN) bersama konsorsium PT Pertamina dan Engie, perusahaan asal Prancis, lolos tahap I tender infrastruktur gas untuk Indonesia Tengah yang diselenggarakan oleh PT Perusahaan Listrik Negara (PLN).  Konsorsium PGN-Pertamina-Engie ini sedang bersiap mengikuti seleksi tahap II, yaitu penawaran komersial gas alam.

Sejauh ini, PGN cukup yakin proyek tersebut akan menjadi milik konsorsium yang diikutinya. Maklum, hanya konsorsium PGN yang lolos tahap pertama tender infrastruktur gas Indonesia Tengah. 

"Dari sekian banyak yang kami ikut, satu yang sudah ada pengumuman, tapi tahap satu, itu Indonesia Tengah, itu sudah pasti PGN dan Pertamina," kata Mugiono, Direktur Utama PGN LNG Indonesia, Rabu (15/11).

Dalam konsorsium tersebut, ketiga perusahaan memiliki saham masing-masing sekitar 30%. Pertamina masih menjadi pemegang saham mayoritas, karena jumlah sahamnya sedikit lebih besar daripada PGN dan Engie.

Jika lolos tahap kedua tender proyek gas Indonesia Tengah, konsorsium ini selanjutnya mencari dananya. Nilai investasi proyek infrastruktur gas Indonesia Tengah, Mugiono menyebutkan, sekitar US$ 1 miliar.

Konsorsium ini telah memikirkan melakukan project financing alias pinjaman untuk membiayai proyek ini. Jika sudah mendapatkan pinjaman, tahap selanjutnya adalah melakukan financial closing dalam rentang waktu enam bulan hingga 12 bulan. Proses selanjutnya adalah Perjanjian Jual Beli Gas dan membangun infrastuktur di sepuluh lokasi. 

"Ini merupakan proyek terbesar di dunia. Belum pernah ada seperti ini," klaim Mugiono.

Dalam proyek Indonesia Tengah ini, konsorsium PGN memang akan membangun terminal gas terapung alias floating storage regasification unit (FSRU), receiving terminal, hingga mengoperasikan kapal pengangkut gas yang akan menghubungkan 10 lokasi di kawasan Indonesia tengah yang berada di Kalimantan, Sulawesi, dan Nusa Tenggara Barat (NTB). 

"Ada satu FSRU, dua kapal LNG feeder, kapal LNG yang kecil-kecil yang keliling. Jadi kapal ituakan membawa LNG dari FSRU diantar ke klaster. Nanti akan dibagi dua klaster, makanya ada dua LNG feeder, jelasnya".

Mugiono menyebutkan proyek ini membutuhkan gas alam sekitar 150 juta kaki kubik per hari alias million standard cubic feet per day (mmscfd). Pasokan gas ini akan diambil konsorsium tersebut dari produksi gas dalam negeri. 

"Tahun ini dan tahun depan, masih surplus. Kepala SKK Migas mengatakan masih ada 70 kargo LNG tahun depan, tahun depan masih ada yang uncommitted," ungkap Mugiono.

Jika pasokan gas domestik menurun, Pertamina telah menyiapkan pasokan LNG yang cukup untuk proyek ini.

"Dari domestik masih ada, tapi Pertamina punya portofolio LNG juga, jadi aman. Pertamina memiliki pasokan LNG, membangun infrastruktur," kata Mugiono.

Selain itu, PGN masih memiliki pasokan gas murah dari Amerika Serikat, yaitu dari Blok Fasken. Anak usaha PGN di sektor hulu migas, Saka Energi Indonesia memang tercatat memiliki sekitar 36% saham di Blok Fasken. 

"Kapan saja apabila harga LNG domestik kurang kompetitif, PGN akan membawa gas dari Amerika. Itu shale gas murah," katanya.

Secara keseluruhan, PGN optimistis terhadap prospek dan potensi bisnis LNG setelah ada proyek Indonesia tengah ini. Saat ini, hanya Indonesia bagian barat yang sudah memiliki fasilitas dan infrastruktur gas.

Sebagian dari infrastruktur gas yang baru itu dibangun oleh emiten saham yang berkode PGAS di Bursa Efek Indonesia itu. Lokasinya berada di Sumatra, South Sumatera West Java (SSWJ), Duri-Dumai, Singapura atau infrastruktur di Pulau Jawa. 

"Tapi kalau kami bicara Kalimantan, Sulawesi, Papua apalagi, itu harus menngunakan LNG, karena  jumlahnya kecil, menyebar jauh-jauh," jelas Mugiono.

Mugiono optimistis bahwa ke depan bisnis LNG perusahaan ini akan menggantikan bisnis pipa gas di PGN. 

"Seiring dengan penurunan cadangan gas konvensional, LNG akan menggantikan peranan utama dari gas pipa," tandasnya.

RPS - Pertamina EP Holds Journalism School



The association of journalists who are members of Ronggolawe Press Solidarity (RPS) of Tuban District held a basic journalism school at Madrasah Aliyah (MA) Islamiyah Senori for two consecutive days, Wednesday-Thursday (15-16 / 11). The activity is in cooperation with PT Pertamina Ep Asset 4 Cepu.

Chairman of the RPS, Khoirul Huda said there were 30 students who attended this elementary school journalism. During the training, they are provided with some materials, ranging from basic journalism, reporting and interviewing techniques, photography, videography, and news writing techniques.

"The press is not only looking for news, but also educating the community, so in this training we also want to be able to share so that students who participate better understand the science of journalism," explained Huda greeting familiar.

Huda revealed that this journalism school is the first time implemented in Senori area and is an implementation program to give responsibility to educate the community, especially school students. In the future journalistic school activities will be held in other schools within the next weeks.

"Once here, continued in SMA Negeri Kenduruan," he added.

The two locations were chosen as the location of journalism school because its area happened to be adjacent to ring 1 Pertamina EP Asset 4 Cepu.

RPS - Pertamina EP Gelar Sekolah Jurnalistik


Perkumpulan wartawan yang tergabung dalam Ronggolawe Press Solidarity (RPS) Kabupaten Tuban menggelar sekolah jurnalistik tingkat dasar di Madrasah Aliyah (MA) Islamiyah Senori selama dua hari berturut-turut, Rabu-Kamis (15-16/11). Kegiatan tersebut bekerja sama dengan PT Pertamina Ep Asset 4 Cepu.

Ketua RPS, Khoirul Huda mengatakan ada 30 siswa yang mengikuti sekolah jurnalistik tingkat dasar ini. Selama mengikuti pelatihan, mereka dibekali beberapa materi, mulai dari dasar jurnalistik, teknik reportase dan wawancara, fotografi, videografi, dan teknik menulis berita.

"Fungai pers tak hanya mencari berita, namun juga mengedukasi masyarakat. Sehingga, dalam pelatihan ini kami juga ingin bisa berbagi agar siswa yang ikut lebih memahami ilmu jurnalistik," terang Huda sapaan akrabnya.

Huda mengungkapkan jika sekolah jurnalistik ini baru pertama kali dilaksanakan di wilayah Senori dan merupakan program implementasi untuk memberikan tanggung jawab untuk mengedukasi masyarakat, khusunya pelajar sekolah. Ke depan kegiatan sekolah jurnalistik akan dilaksanakan di sekolah lain dalam waktu minggu kedepan.

"Setelah di sini, dilanjut di SMA Negeri Kenduruan," tambahnya.

Dua lokasi itu dipilih sebagai lokasi digelarnya sekolah jurnalistik karena wilayahnya kebetulan berdekatan dengan ring 1 Pertamina EP Asset 4 Cepu.

2018, LNG Volume Does Not Increase



State-owned electricity company PT Perusahaan Listrik Negara projected that liquefied natural gas (LNG) demand for electricity generation in 2018 will not be much different from this year's 51 cargoes.

Director of Strategic Procurement II PT Perusahaan Listrik Negara Supangkat Iwan Santoso said that in 2018 there is no new steam power plant (PLTGU) power plant operating so there is no additional LNG volume.

Based on data from the ESDM Ministry, this year there are 51 LNG cargoes allocated to PLN. The LNG cargo was acquired through five purchase contracts. First, a contract with BP Tangguh refinery of 16 cargoes is processed through regasification facilities
Arun Aceh.

Second, the LNG supply is received through a total purchase contract with Total in Mahakam Block as 4 cargoes which are classified through the Benoa gas facility in Bali. Third, the last three contracts are processed at Nusantara Regas's floating storage regasification unit (FSRU), which is the contract of purchase of LNG from BP Tangguh LNG Plant as much as 4 cargoes.

Fourth, the purchase contract with Bontang LNG Plant located in East Kalimantan is 17 cargoes. Fifth, LNG purchase contract from PT Pertamina as much as 10 cargoes from the oil and gas project in Deepwater Development (IDD) Bangka and Muara Bakau.

"It's about the same because the plant is the same. There is no additional, "he said.

According to him, the new regasification facility is not yet operational next year. Therefore, the supply of LNG in 2018 is still absorbed by existing regasification facilities such as Arun FSRU, FSRU Iampung, FSRU Nusantara Regas. In terms of power plants, LNG supply will still be absorbed by power plants in Tanjung Priok, Muara Tawar, North Sumatra and Arun.

NOT OPERATING

The new gas-fired power plant is expected to operate in 2020, namely PLTGU Java-1 which has obtained gas supply and Tangguh Train III LNG Plant. From PLN data, LNG demand for power plants is projected to increase every year.

LNG demand for power plants by 2018 is estimated at 310 billion cubic feet (Bcf) to increase to 358 Bcf in 2019 and 2020 to 419 Bcf. Then, in 2021 it drops to 416 Bcf and 2022 rises to 438 bcf.

Previously, Director General of Oil and Gas of EMR Ministry Ego Syahrial said that the absorption of LNG for PLN has not been optimum for the last 2 years.

In 2016, PLN LNG cargo absorption is around 75%. For 2017, Ego Syahrial said that the absorption of LNG in the range of 85%.
However, he did not specify the volume of allocation and absorption. For example, this year's LNG production target of 278 cargoes consists of 163 cargoes from the Bontang LNG Plant and 115 cargoes from the Tangguh Train of Papua.

"Over the last 2 years indeed the absorption of PLN may be down if not mistaken 2016 absorption 75%.

IN INDONESIA

2018, Volume LNG Tidak Bertambah


PT Perusahaan Listrik Negara memproyeksikan kebutuhan gas alam cair (liquefied natural gas/ LNG) untuk pembangkit Iistrik pada 2018 tidak akan jauh berbeda dengan tahun ini sebanyak 51 kargo.

Direktur Pengadaan Strategis II PT Perusahaan Listrik Negara Supangkat Iwan Santoso mengatakan bahwa pada 2018 belum ada pembangkit Iistrik tenaga gas uap (PLTGU) baru yang beroperasi sehingga tidak ada tambahan volume LNG.

Berdasarkan data Kementerian ESDM, pada tahun ini ada 51 kargo LNG yang dialokasikan kepada PLN. Kargo LNG itu diperoleh melalui lima kontrak pembelian. Pertama, kontrak dengan Kilang BP Tangguh sebanyak 16 kargo yang diolah melalui fasilitas regasifikasi
Arun Aceh.

Kedua, pasokan LNG diterima melalui kontrak pembelian dengan Total di Blok Mahakam sebanyak 4 kargo yang diregasifikasi melalui fasilitas gas Benoa di Bali. Ketiga, tiga kontrak terakhir diolah di fasilitas penyimpanan dan regasifikasi (floating storage regasification unit/FSRU) milik Nusantara Regas, yakni kontrak pembelian LNG dari Kilang LNG BP Tangguh sebanyak 4 kargo.

Keempat, kontrak pembelian dengan Kilang LNG Bontang yang berlokasi di Kalimantan Timur sebanyak 17 kargo. Kelima, kontrak pembelian LNG dari PT Pertamina sebanyak 10 kargo yang berasal dari proyek migas laut dalam (Indonesia Deepwater Development/ IDD) Bangka dan Muara Bakau.

“Kira-kira sama karena pembangkitnya juga sama. Belum ada tambahan," ujarnya.

Menurutnya, fasilitas regasifikasi baru pun belum beroperasi pada tahun depan. Oleh karena itu, pasokan LNG pada 2018 masih diserap fasilitas regasifikasi yang ada seperti FSRU Arun, FSRU Iampung, FSRU Nusantara Regas. Dari sisi pembangkit, pasokan LNG masih akan diserap unit pembangkit di Tanjung Priok, Muara Tawar, Sumatra Utara dan Arun.

BELUM BEROPERASI

Untuk pembangkit baru berbahan bakar gas diperkirakan beroperasi pada 2020, yakni PLTGU Jawa-1 yang telah mendapatkan pasokan gas dan Kilang LNG Tangguh Train III. Dari data PLN, kebutuhan LNG untuk pembangkit diproyeksi terus naik setiap tahun.

Kebutuhan LNG untuk pembangkit pada tahun 2018 diperkirakan 310 miliar kaki kubik (Bcf) naik menjadi 358 Bcf pada 2019 dan 2020 naik menjadi 419 Bcf. Kemudian, pada 2021 turun menjadi 416 Bcf dan 2022 naik menjadi 438 bcf.

Sebelumnya, Direktur Jenderal Minyak dan Gas Bumi Kementenan ESDM Ego Syahrial mengatakan bahwa penyerapan LNG untuk PLN belum optimum selama 2 tahun terakhir.

Pada 2016, penyerapan kargo LNG PLN sekitar 75%. Untuk 2017, Ego Syahrial menuturkan bahwa penyerapan LNG di kisaran 85%.
Kendati demikian, dia tidak menyebut secara rinci volume alokasi dan penyerapannya. Sebagai contoh, target produksi LNG tahun ini 278 kargo terdiri dari 163 kargo berasal dari Kilang LNG Bontang dan 115 kargo dari Train Tangguh Papua.

“Selama 2 tahun terakhir memang penyerapan PLN boleh dibilang turun kalau tidak salah 2016 itu penyerapannya 75 %.

SKK Migas Give Public Lecture on Role of Upstream Oil and Gas Industry



SKK Migas representatives of Java, Bali, and Nusa Tenggara (Jabanusa) region cooperate with universities in Sumenep Regency to socialize the role of upstream oil and gas companies for local communities.

The socialization was conducted by holding a public lecture that presented the Oil and Gas Cooperation Contractors (KKKS) operating in Sumenep, namely Kangean Energy Indonesia (KEI), Santos, and Husky Cnooc Madura Limited (HCML).

Humas SKK Migas representative of Jabanusa, Ami Herawawati, said that the public lecture entitled "The Role of Upstream Oil and Gas Company in the Improvement of Community Economy" held at two universities, namely Trunojoyo Madura University (UTM) Bangkalan, and STKIP PGRI Sumenep intend to socialize the company's role upstream oil and gas, because so far people still do not understand it.

"This is a routine activity of SKK Migas every year for socialization to the community as a whole, because, by socializing to the campus community, it can be forwarded to other people, because we are aware of our limitations, it is difficult to reach all community layers," said Ami Hermawati Sumenep, Wednesday (15/11).

Ami hoped that public lecture with material about the role of upstream oil and gas company could reach the general public layers in the working area of ​​KKKS, including in Sumenep, Madura. By cooperating with universities like this, within the next 5 to 10 years, people will be familiar with upstream oil and gas industry in Madura, including in Sumenep.

SKK Migas perwakilan wilayah Jawa, Bali, dan Nusa Tenggara (Jabanusa) menggandeng perguruan tinggi di Kabupaten Sumenep untuk mensosialisasikan peran perusahaan hulu migas bagi masyarakat setempat. 

Sosialisasi itu dilakukan dengan mengadakan kuliah umum yang menghadirkan Kontraktor Kontrak Kerja Sama (KKKS) migas yang beroperasi di Sumenep yakni Kangean Energy Indonesia (KEI), Santos, dan Husky Cnooc Madura Limited (HCML).

Humas SKK Migas perwakilan Jabanusa, Ami Herawawati mengatakan, kegiatan berupa kuliah umum bertema "Peran Perusahaan Hulu Migas dalam Peningkatan Ekonomi Masyarakat" yang diadakan di dua perguruan tinggi, yakni Universitas Trunojoyo Madura (UTM) Bangkalan, dan STKIP PGRI Sumenep bermaksud untuk mensosialisasikan peran perusahaan hulu migas, sebab selama ini masyarakat masih kurang memahami hal tersebut.

"Ini merupakan kegiatan rutin SKK Migas setiap tahun untuk sosialisasi kepada masyarakat secara menyeluruh. Sebab, dengan mensosialisasikan kepada masyarakat kampus, bisa diteruskan kepada masyarakat Iain, karena kami sadar dengan keterbatasan kami, sulit untuk menjangkau seluruh Iapisan masyarakat," kata Ami Hermawati, di Sumenep, Rabu (15/11).

Ami berharap, kuliah umum dengan materi tentang peran perusahaan hulu migas itu bisa sampai kepada Iapisan masyarakat umum yang ada di wilayah kerja KKKS, termasuk di Sumenep, Madura. Dengan menggandeng perguruan tinggi seperti ini, dalam kurun waktu 5 hingga 10 tahun ke depan, masyarakat akan terbiasa dengan Industri hulu migas di Madura, termasuk di Sumenep.

“Sosialisasi ini manfaatnya mungkin tidak bisa dirasakan Iangsung saat ini. Tapi kami optimis sangat membantu proses perubahan paradigma masyarakat tentang industri migas. Pemanfaatan energi yang baik harus dimulai dari diri sendiri," tegasnya.

Sementara itu, Community Relations and Development Coordinator HCML, Ali Aliyuddin menyatakan, Perusahaan Hulu Migas yang beroperasi di Indonesia merupakan Kontraktor Kontrak Kerja Sama yang diawasi oleh pemerintah, dalam hal ini SKK Migas. 

"Artinya, perusahaan Hulu Migas tidak murni berdiri sendiri sebagai perusahaan swasta, tapi kontraktor pemerintah. Sehingga dalam beroperasi, KKKS bertanggung jawab sepenuhnya kepada negara," jelas Ali Aliyuddin.

KPPU's Decision on PGN Bad Predictions for SOEs



The legal team of PT Perusahaan Gas Negara Tbk (PGN) assessed the decision of the panel of judges of the Business Competition Supervisory Commission (KPPU) in the trial of the alleged monopoly of the selling price of natural gas in Medan, North Sumatra. Because the testimony of the witnesses is not displayed intact so obscure the facts on the ground.

"The opinions of expert witnesses are not comprehensive and only partial. So many considerations of the verdict of the wrong assembly, "said PGN lawyer, Yahdy Salampessy.

Yahdy continued that also the spotlight of the legal counsel over the verdict of the trial is the lack of competence of the judges in understanding the downstream gas business scheme. With the KPPU's decision, PGN's legal team will first learn a copy of the decision to take further legal action.

"What is clear this decision will be a bad precedent for other SOEs in conducting business activities."

As is known, the polemic about the high gas prices for the industrial sector in Medan appeared some time last. The high selling price due to the number of companies owning gas quota but does not have facilities (gas brokers).

On the other hand, in running the business, PGN which is a state-owned company in the national downstream natural gas sector has a number of legal basis in buying, distributing, and determining the selling price of gas to consumers. There are two regulations that regulate it, namely Article 27 of Law No. 22 of 2001 on Oil and Natural Gas and Article 51 of Law Number 5 Year 1999 on Prohibition of Monopolistic Practices and Unfair Business Competition.

Putusan KPPU atas PGN Preseden Buruk bagi BUMN


Tim kuasa hukum PT Perusahaan Gas Negara Tbk (PGN) menilai putusan majelis hakim Komisi Pengawas Persaingan Usaha (KPPU) dalam persidangan dugaan monopoli harga jual gas bumi di wilayah Medan, Sumatra Utara, sangat keliru. Pasalnya, keterangan para saksi tidak ditampilkan utuh sehingga mengaburkan fakta di lapangan.

“Pendapat para saksi ahli tidak menyeluruh dan hanya sebagian. Jadi banyak pertimbangan putusan majelis yang keliru,” ujar kuasa hukum PGN, Yahdy Salampessy.

Yahdy melanjutkan yang juga jadi sorotan kuasa hukum atas putusan sidang ialah kurangnya kompetensi majelis Hakim dalam memahami skema bisnis hilir gas bumi. Dengan keputusan KPPU itu, tim kuasa hukum PGN akan mempelajari lebih dulu salinan keputusan untuk mengambil langkah hukum selanjutnya.

“Yang jelas putusan ini akan jadi preseden buruk bagi BUMN lainnya dalam melakukan kegiatan usaha.”

Seperti diketahui, polemik tentang tingginya harga gas untuk kalangan industri di Medan muncul beberapa waktu terakhir. Tingginya harga jual akibat banyaknya perusahaan pemilik kuota gas tapi tidak memiliki fasilitas (calo gas).

Di sisi lain, dalam menjalankan bisnis, PGN yang merupakan BUMN di sektor hilir gas bumi nasional memiliki sejumlah landasan hukum dalam membeli, menyalurkan, sekaligus menentukan harga jual gas tadi ke konsumen. Ada dua peraturan yang mengatur itu, yakni Pasal 27 UU No 22 Tahun 2001 tentang Minyak dan Gas Bumi dan Pasal 51 UU Nomor 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha tidak Sehat.

“Sayangnya keputusan majelis tidak menyentuh pokok permasalahan di lapangan dan kami yang disalahkan. Padahal sangat jelas praktik semacam itu (calo gas) dapat dilihat langsung,” kata Yahdy.

CNPC International-Pertamina Hulu Sign Oil and Gas Cooperation



The parent company of PetroChina, CNPC (China National Petroleum Corporation) International, signed a Memorandum of Understanding (MoU) with PT Pertamina in an effort to increase cooperation in oil and gas business development both in Indonesia and abroad.

The MOU was signed by CNPC International President Lyu Gongxun and Senior Vice President of Upstream Business Development of Pertamina Denie Tampubolon in Jakarata.

Upstream Director of Pertamina Syamsu Alam, several Pertamina directors, and President of PetroChina International Companies in Indonesia, Gong Bencai, witnessed the signing of the cooperation.

The Memorandum of Understanding contains several key points in the effort to enhance cooperation between CNPC International and Pertamina, including oil and gas project management cooperation in upstream and downstream sectors, both in Indonesia and internationally as well as cooperation in oil and gas services both in Indonesia and in the country other.

CNPC is a Chinese state-owned oil and gas company operating in many countries around the world, including Indonesia through its subsidiary PetroChina International Companies in Indonesia.

Until now, PetroChina has cooperation with Pertamina in the development of Oil and Gas Block, among others Jabung Block in Jambi, Joint Operating Body (JOB) Pertamina-PetroChina East Java (PPEJ) in Tuban Block, and JOB Pertamina-PetroChina Salawati (PPS) in the Salawati Island Block in West Papua.

PetroChina officially started its oil and gas business in Indonesia in June 2002 after it acquired all assets of the oil and gas company from the United States, Devon Energy Companies.

During 15 years of operations in Indonesia, PetroChina has been involved in nine oil and gas blocks and is able to maintain the average oil and gas production at 80,000 barrels of oil equivalent per day. In fact, by 2016 PetroChina's oil and gas production has surpassed 80,000 barrels of oil equivalent per day.

Under the supervision and control of SKK Migas, PetroChina is operator of Jabung Block and Bangko Block in Jambi. PetroChina is also the operator of South Jambi Block "B" through a form of Joint Operation with Pertamina. In the Strait Block (Riau) and the Salawati Basin Bird Head Challenge in West Papua, PetroChina is a non-operator partner.

CNPC International-Pertamina Hulu Teken Kerja Sama Migas


Induk perusahaan PetroChina, CNPC (China National Petroleum Corporation) International, menandatangani MoU (Memorandum of Understanding/ Nota Kesepahaman) dengan PT Pertamina dalam upaya peningkatan kerja sama pengembangan bidang usaha minyak dan gas bumi, baik di Indonesia maupun di mancanegara.

MOU tersebut ditandatangani President CNPC International Lyu Gongxun dan Senior Vice President Upstream Business Development Pertamina Denie Tampubolon di Jakarata.

Direktur Hulu Pertamina Syamsu Alam, beberapa jajaran direksi Pertamina, serta Presiden PetroChina International Companies di Indonesia, Gong Bencai, turut menyaksikan penandatanganan kerja sama tersebut.

Nota Kesepahaman tersebut berisi beberapa poin penting dalam upaya peningkatan kerja sama CNPC International dan Pertamina, termasuk kerja sama pengelolaan proyek migas di sektor hulu dan hilir, baik di Indonesia maupun di wilayah internasional serta kerja sama di bidang jasa migas, baik di Indonesia maupun di negara lain.

CNPC merupakan perusahaan migas milik pemerintah Tiongkok yang beroperasi di banyak negara di dunia, termasuk di Indonesia melalui anak perusahaan PetroChina International Companies di Indonesia.

Hingga saat ini, PetroChina memiliki kerja sama dengan Pertamina dalam pengembangan Blok Migas, antara lain Blok Jabung di Jambi, Joint-Operating Body (JOB) Pertamina-PetroChina East Java (PPEJ) di Blok Tuban, dan JOB Pertamina-PetroChina Salawati (PPS) di Blok Salawati Island di Papua Barat.

PetroChina secara resmi memulai kegiatan usaha migasnya di Indonesia pada Juni 2002 setelah mengakuisisi seluruh aset perusahaan minyak dan gas bumi yang berasal dari Amerika Serikat, Devon Energy Companies.

Selama 15 tahun beroperasi di Indonesia, PetroChina terlibat dalam sembilan blok migas dan hingga kini mampu mempertahankan rata-rata produksi migas pada level 80.000 barel setara minyak per hari. Bahkan, tahun 2016 produksi migas PetroChina berhasil melewati angka 80.000 barel setara minyak per hari.

Di bawah pengawasan dan pengendalian SKK Migas, PetroChina merupakan operator Blok Jabung dan Blok Bangko di Jambi. PetroChina juga merupakan operator Blok South Jambi “B” melalui bentuk Kerja Sama Operasi dengan Pertamina. Di Blok Selat Panjang (Riau) dan Blok Kepala Burung Salawati Basin di Papua Barat, PetroChina merupakan mitra non-operator.

Premiere Oil-Petrovietnam Agrees on Tuna Block Gas Sales



Premiere Oil agreed to sell gas produced from Tuna Block, North Natuna Sea to Petrovietnam. Both have signed a memorandum of understanding on gas sales on the sidelines of the 2017 Asia-Pacific Economic Cooperation Summit in DaNang, Vietnam.

"The signing of this MOU is expected to provide certainty in the development of gas reserves in Blok K Tuna," said Head of Special Unit for Upstream Oil and Gas Business Activities (SKK Migas) Amien Sunaryadi in his official statement on Tuesday (14/11).

Premier Oil, operator of the Tuna Block in the North Natuna Sea, will develop a Tuna field with a gas drain target in 2023. Premier has a 65% participating interest in Tuna PSC and partners with MOECO (25%) and GS Energy (15%). Gas generated from the Tuna field will be flown to the Nam Con Son Pipeline System in Vietnam through a cross-border pipe being built.

In its official website, Premiere Oil said it is still evaluating the two-field development scenario in the Tuna Block, the Sea Horse and Sea Lion. In 2017, Premiere Oil obtained an extended exploration period in the Tuna Block for three years.

With this extension, it allows the UK-based oil and gas company to carry out an appratal drilling and develop the commercial development concepts of this block before incorporating POD.

Data from the Ministry of Energy and Mineral Resources, proven reserves for oil in the block reached 2,127 million barrels and gas of 12.36 billion cubic feet. Meanwhile, the block area reaches 2,450.29 square kilometers. Not only buying and selling gas, also agreed cooperation between Indonesia and Vietnam.

"This cooperation will be followed by cooperation to manage the border area," said Amien.

Discussion on cooperation between Indonesia and Vietnam, especially in the utilization of gas in the cross-border region of continent initiated by Directorate General of Oil and Gas (DG Migas) since March 2017. The meeting of The 7th Indonesia-Vietnam Joint Commission on Economic, Scientific and Technical Cooperation (JC-ESTC) was held in Hanoi, Vitenam on 12 August 2017.

At JC-ESTC yesterday both sides will support and facilitate companies from both countries in implementing oil and gas exploration and exploitation cooperation projects, seeking new cooperation opportunities, especially Tuna Project in Natuna Sea, provision of oil and gas technical services, and cooperation on coal utilization.

Indonesia-Vietnam cooperation in the field of gas utilization will include a joint study for the utilization and construction of gas infrastructure at the border, a feasibility study of gas pipeline connectivity in each border region, and supervision of SKK Migas and Petrovietnam or its affiliated companies to conduct gas utilization in the region border.

This MSP will not reduce any party related to the Maritime border as well as their rights and obligations in their respective maritime zones according to UNCLOS 1982.

Premiere Oil-Petrovietnam Sepakati Penjualan Gas Blok Tuna


Premiere Oil sepakat menjual gas yang dihasilkan dari Blok Tuna, Laut Natuna Utara ke Petrovietnam. Keduanya telah menandatangani nota kesepahaman penjualan gas ini di sela Konferensi Tingkat Tinggi Kerja Sama Ekonomi Asia Pasifik 2017 di DaNang, Vietnam.

“Penandatanganan MOU ini diharapkan akan memberikan kepastian pengembangan cadangan gas di Blok K Tuna,” kata Kepala Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas) Amien Sunaryadi dalam keterangan resminya, Selasa (14/ 11). 

Premier Oil, sebagai operator Blok Tuna di Laut Natuna Utara, akan mengembangkan lapangan Tuna dengan target pengaliran gas pada 2023. Premier memiliki participating interest sebesar 65% di Tuna PSC dan bermitra dengan MOECO (25%) dan GS Energy (15%). Gas yang dihasilkan dari lapangan Tuna akan dialirkan ke Nam Con Son Pipeline System di Vietnam melalui pipa lintas batas negara yang sedang dibangun.

Dalam laman resminya, Premiere Oil menyatakan masih mengevaluasi skenario pengembangan dua lapangan di Blok Tuna, yakni Kuda Laut dan Singa Laut. Pada 2017, Premiere Oil memperoleh perpanjangan masa eksplorasi di Blok Tuna selama tiga tahun. 

Dengan perpanjangan ini, maka memungkinkan perusahaan migas yang berasal dari Inggris ini untuk melaksanakan pengeboran apprasial dan menyusun konsep pengembangan komersial dari blok ini sebelum memasukkan POD.

Data Kementerian ESDM, cadangan terbukti untuk minyak yang ada di blok tersebut mencapai 2.127 juta barel dan gas sebesar 12,36 miliar kaki kubik. Adapun, luas bloknya mencapai 2.450,29 kilometer persegi. Tidak hanya jual beli gas, disepakati juga kerja sama antara Indonesia dan Vietnam. 

“Kerja sama ini akan diikuti dengan kerja sama untuk mengelola wilayah perbatasan,” ujar Amien.

Pembahasan kerjasama Indonesia dan Vietnam terutama di pemanfaatan gas pada wilayah lintas batas kontinen diinisiasi oleh Direktorat Jenderal Minyak dan Gas Bumi (Ditjen Migas) sejak Maret 2017 lalu. Kemudian dilakukan pertemuan The 7th Indonesia-Vietnam Joint Commission on Economic, Scientific, and Technical Cooperation (JC-ESTC) di Hanoi, Vitenam pada 12 Agustus 2017.

Pada JC-ESTC kemarin kedua pihak akan mendukung dan memfasilitasi perusahaan-perusahaan dari kedua negara dalam mengimplementasikan proyek kerja sama eksplorasi dan eksploitasi migas, mencari peluang kerja sama baru khususnya Proyek Tuna di Laut Natuna, penyediaan jasa teknis migas, dan kerjasama pemanfaatan batubara.

Kerja sama Indonesia-Vietnam di bidang pemanfaatan gas diantaranya akan mencakup studi bersama untuk pemanfaatan dan pembangan infrastruktur gas di perbatasan, studi kelayakan konektivitas pipa gas di masing-masing wilayah perbatasan, dan pengawasan SKK Migas dan Petrovietnam atau perusahaan afiliasinya untuk melakukan pemanfaatan gas di wilayah perbatasan. 

MSP ini tidak akan mengurangi pihak manapun yang berkaitan dengan perbatasan Maritim serta hak dan kewajiban mereka di zona maritim masing-masing sesuai dengan UNCLOS 1982.

The Price of Downstream Gas is Now in Jonan's Hand



After issuing the Regulation of the Minister of Energy and Mineral Resources (ESDM) regarding the limitation of gas margin of only 7%, now the Ministry of Energy and Mineral Resources will revise the Regulation of Minister of Energy and Mineral Resources No. 19/2009 on Gas Gas Business Activities Through Pipe.

Head of Downstream Oil and Gas Regulatory Agency (BPH Migas) M. Fanshurullah Asa revealed, there are two important points in the change of the rules. First, BPH Migas will divide the distribution network area and establish the holding business entity
the region.

If there is an existing business entity in an area, the business entity will be included in the gas pipeline of the business entity of the owner of the distribution network area. According to him, BPH Migas will regulate the widest or highest business entity.

"BPH Migas will regulate the area, we give the most there in terms of existing distribution channels are not harmed," explained Fanshurullah, Tuesday (14/11).

In addition to points concerning the division of gas network territory, the second revision of Ministerial Regulation No. 19/2009 will change the rules of downstream dedicated. According to him, dedicated downstream that makes gas prices to end consumers become expensive.

In Presidential Regulation No. 40/2016 on the Determination of Natural Gas Prices, the government determines not only the upstream gas price, but downstream.

"So far the downstream dedicated that determines who? Yes, business entities," he explained.

As an illustration, Ministerial Regulation Number 19/2009 Article 8 states that in certain commercial areas, natural gas business activities can be conducted through pipes by more than one business entity holding natural gas business license through pipeline. 

     While Article 9 of the regulation stipulates that in carrying out the business activities of the natural gas business through pipes, the business entity as referred to in Article 6 shall use transmission pipes and or distribution pipes available to be able to be utilized together (open access) on the transmission segment and / or distribution network territory certain.

Fanshurullah explained, this policy has been discussed by stakeholders both business entities and associations engaged in downstream gas sector. Like Pertamina, Perusahaan Gas Negara, SKK Migas and also one of the associations is the Indonesian Natural Gas Distributors Association (INGTA).

Harga GaS Hilir Kini di Tangan Jonan


Setelah menerbitkan Peraturan Menteri Energi dan Sumber Daya Mineral (ESDM) tentang pembatasan margin gas hanya sebesar 7%, kini Kementerian ESDM akan merevisi Peraturan Menteri ESDM Nomor 19/2009 tentang Kegiatan Usaha Gas Bumi Melalui Pipa.

Kepala Badan Pengatur Hilir Minyak dan Gas Bumi (BPH Migas) M. Fanshurullah Asa mengungkapkan, ada dua poin penting dalam perubahan aturan tersebut. Pertama, BPH Migas akan membagi wilayah jaringan distribusi dan menetapkan badan usaha yang memegang
wilayah tersebut. 

Jika di suatu wilayah telah ada badan usaha eksisting, badan usaha itu akan masuk dalam jaringan pipa gas badan usaha pemilik wilayah jaringan distribusi. Menurut dia, BPH Migas akan mengatur badan usaha paling luas atau paling tinggi.

"BPH Migas akan mengatur kawasan, kami memberikan kepada yang paling banyak di sana dari sisi jalur distribusi yang sudah ada tidak dirugikan," jelas Fanshurullah, Selasa (14/11).

Selain poin soal pembagian Wilayah jaringan gas, revisi kedua Peraturan Menteri Nomor 19/2009 akan mengubah aturan tentang dedicated hilir. Menurutnya, dedicated hilir yang membuat harga gas hingga konsumen akhir menjadi mahal.

Dalam Peraturan Presiden Nomor 40/2016 tentang Penetapan Harga Gas Bumi, pemerintah menentukan bukan hanya harga gas di hulu, melainkan sampai hilir. 

"Selama ini dedicated hilir yang menentukan siapa? Ya, badan usaha," jelasnya.

Sebagai gambaran, Peraturan Menteri Nomor 19/2009 Pasal 8 menyebutkan, pada wilayah niaga tertentu dapat dilaksanakan kegiatan usaha niaga gas bumi melalui pipa oleh lebih dari satu badan usaha pemegang izin usaha niaga gas bumi melalui pipa. 

     Sementara Pasal 9 aturan tersebut menyatakan, dalam melaksanakan kegiatan usaha niaga gas bumi melalui pipa, badan usaha sebagaimana dimaksud dalam Pasal 6 wajib menggunakan pipa transmisi dan atau pipa distribusi yang tersedia untuk dapat dimanfaatkan bersama (open access) pada ruas transmisi dan atau vwilayah jaringan distribusi tertentu.

Fanshurullah menjelaskan, kebijakan ini sudah dibahas oleh para pemangku kepentingan baik badan usaha maupun asosiasi yang bergerak di sektor hilir gas. Seperti Pertamina, Perusahaan Gas Negara, SKK Migas dan juga asosiasi salah satunya adalah Asosiasi Penyalur Gas Alam Indonesia (INGTA).
