Pertamina and Marubeni Continue to Share in Java-1



The Java-1 PLTGU consortium may not change until the project operates commercially



PT Perusahaan Listrik Negara (PLN) is also monitoring the chaos in the consortium of PT Pertamina Power Indonesia (PPI) and Marubeni Corporation. PLN asks the consortium to immediately resolve the issue. 


      The consortium is working on a Java-1 gas-fired power plant (PLTGU) project with a capacity of 1,760 megawatts (MW). In building the Java-1 PLTGU, PPI and Marubeni obtained 40% ownership shares. As for one more member, Sojitz Corporation has a 20% stake.

PT PLN's Strategic Procurement Director 2, Djoko Rahardjo Aburhanan, said the relevant parties in the consortium must be able to show a solution to the problem. Because, the consortium may not change ownership of shares, let alone disband. 

     After the consortium is appointed and the power purchase agreement (PPA) is signed, the contract with the consortium may not change until the electric power plant project is commercially operational or commercial operation date (COD).

"Change of directors is okay. But it can't change the consortium. Unless the COD has become an item and the debts with landed banks have been completed," said Djoko.

That is, like a contract with another private electricity producer (IPP), the consortium is responsible for completing the Java-1 PLTGU project according to the agreed schedule. At present, the progress of the Java-1 PLTGU has reached 30% and is targeted to be completed in 2021. The power plant, which was built in Cilamaya, Karawang regency, West Java, requires an investment budget of around US $ 1.8 billion.

The PLTGU, which will be integrated with the Floating Storage and Regasification Unit (FSRU), has spent US $ 275 million. PLN and the PPI consortium, Marubeni and Sojitz Corporation have signed the PPA since January 31, 2017. 

    Not only at the Java-1 PLTGU, the fracture of Pertamina and Marubeni's relationship also affected other projects, namely power plants to be built in Bangladesh. In the 1,200 MW power plant project, Marubeni has been a partner of Pertamina since August 2017. PT Pertamina's President Director Nicke Widyawati refused to respond.

     There was even news that the President Director of PPI, Ginanjar Sofyan, was dismissed from his position due to this chaos. Pertamina Corporate Communication Vice President Fajriyah Usman denied the news.

"Until now he is still in office," he told KONTAN. He also said that Pertamina had also asked PPI to resolve the issue with Marubeni, in accordance with the contract, said Fajriyah.

Konsorsium PLTGU Jawa-1 tidak boleh berganti hingga proyek beroperasi secara komersial

PT Perusahaan Listrik Negara (PLN) ikut memantau kisruh di konsorsium PT Pertamina Power Indonesia (PPI) dan Marubeni Corporation. PLN minta konsorsium segera menyelesaikan masalah tersebut. Konsorsium tersebut menggarap proyek pembangkit listrik tenaga gas uap (PLTGU) Jawa-1 berkapasitas 1.760 megawatt (MW). Dalam membangun PLTGU Jawa-1, PPI dan Marubeni memperoleh saham kepemilikan masing-masing sebesar 40%. Adapun satu anggota Iagi, Sojitz Corporation memiliki 20% saham.

Direktur Pengadaan Strategis 2 PT PLN, Djoko Rahardjo Aburhanan, mengatakan, para pihak terkait di konsorsium tersebut harus bisa menunjukkan jalan keluar terhadap masalah tersebut. Sebab, konsorsium tidak boleh berganti kepemilikan saham, apalagi bubar. Setelah konsorsium ditunjuk dan perjanjian jual beli listrik alias power purchase agreement (PPA) ditanda tangani, kontrak dengan konsorsium tidak boleh berganti hingga proyek pembangkit Iistrik beroperasi secara komersial atau commercil operation date (COD). 

"Ganti direksi tidak apa-apa. Tapi tidak boleh ganti konsorsium. Kecuali sudah COD, sudah menjadi barangnya dan utang piutang dengan bank landed selesai," kata Djoko.

Artinya, seperti kontrak dengan produsen Iistrik swasta (IPP) lainnya, konsorsium bertanggung jawab merampungkan proyek PLTGU Jawa-1 sesuai jadwal yang telah disepakati. Saat ini, progres PLTGU Jawa-1 mencapai 30% dan ditargetkan rampung pada 2021. Pembangkit yang dibangun di Cilamaya, Kabupaten Karawang-Jawa Barat ini membutuhkan anggaran investasi sekitar US$ 1,8 miliar.

Sementara Direktur Perencanaan Investasi dan Manajemen Risiko Pertamina, Heru Setiawan, menyatakan, kongsi dengan Marubeni masih terus berlangsung. Kisruh Pertamina dan Marubeni bermula saat terjadi gesekan dan perbedaan pandangan antara PPI dan Marubeni di proyek PLTGU Jawa-1. Bahkan ada kabar Direktur Utama PPI, Ginanjar Sofyan, diberhentikan dari jabatannya akibat kisruh ini. Vice President Corporate communication Pertamina Fajriyah Usman membantah kabar itu. 

“Sampai saat ini beliau masih menjabat," kata dia kepada KONTAN. Ia juga bilang, Pertamina juga telah meminta PPI untuk menyelesaikan masalah dengan Marubeni, sesuai dengan kontrak, kata Fajriyah.

Repsol Andaman Exploration until 2021



The Aceh Oil and Gas Management Agency (BPMA) gave a recommendation for an extension of 2 years to Repsol to continue exploration in the Andaman III Block until 2021. BPMA Acting Officer Azhari Idris said Repsol was given a recommendation for an extension of the next 2 years.

So far, Repsol is still exploring oil and gas blocks which are estimated to have 3-4 trillion cubic feet (TCF) gas potential. Referring to BPMA data, in 2017-2018, Repsol has conducted several exploration activities, namely acquisition and processing of 3D seismic data covering 3,670 square kilometers (km2). The Repsol exploration permit in the Andaman Block should expire this year.

The Repsol party had applied for a permit extension for about 1 year. BPMA Deputy of Operations and Planning Teuku Muhammad Faisal the extension of this exploration period still has to wait for approval from the Minister of Energy and Mineral Resources (ESDM) Arifin Tasrif.

According to him, the additional exploration period was given so that Repsol could continue drilling Rencon IX wells. Repsol Eksplorasi Andaman hingga 2021


Badan Pengelola Migas Aceh (BPMA) memberikan rekomendasi perpanjangan selama 2 tahun kepada Repsol untuk melanjutkan eksplorasi di Blok Andaman III hingga 2021. Pelaksana Tugas BPMA Azhari Idris mengatakan Repsol diberikan rekomendasi perpanjangan waktu 2 tahun ke depan. 

“Ya, kami beri 2 tahun untuk Repsol,” katanya.

Sejauh ini, Repsol masih melakukan eksplorasi di blok migas yang diperkirakan memiliki potensi gas 3-4 triliun kaki kubik (TCF). Mengacu data BPMA, pada 2017-2018, Repsol telah melakukan beberapa kegiatan eksplorasi yakni akuisisi dan pemrosesan data seismik 3D seluas 3.670 kilometer persegi (km2). Izin eksplorasi Repsol di Blok Andaman seharusnya berakhir tahun ini. 

Pihak Repsol sempat mengajukan permohonan perpanjangan izin itu sekitar 1 tahun. Deputi Operasi dan Perencanaan BPMA Teuku Muhammad Faisal perpanjangan masa eksplorasi ini masih harus menunggu persetujuan Menteri Energi dan Sumber Daya Mineral (ESDM) Arifin Tasrif.

Menurutnya, tambahan masa eksplorasi ini diberikan agar Repsol dapat melanjutkan kegiatan pengeboran sumur Rencon IX. Selain itu, Repsol juga sedang melakukan persiapan shorebase, penyiapan long lead item dan pengadaan drill ship. Perpanjangan yang diberikan bahkan lebih lama dibandingkan permintaan Repsol yang hanya sekitar satu tahun.

“Repsol bisa maksimum di 2 tahun, melihat persiapan mereka di tahun kemarin dan tahun ini. Mereka optimistis memang, mintanya setahun cukup, [tetapi] daripada tidak selesai kan regulator juga yang repot,” tambahnya.

Sebelumnya, Pelaksana Tugas Direktur Jenderal Minyak dan Gas Bumi Kementerian ESDM Djoko Siswanto mengatakan pihaknya masih menunggu rekomendasi dari BPMA terkait perpanjangan masa eksplorasi Blok Andaman III.

“Masih menunggu rekomendasi BPMA untuk extension. 1-2 hari ini kami tunggu,” ujarnya.

Chevron-Pertamina Continues Discussion on Rokan Block Transition



PT Chevron Pacific Indonesia continues to hold discussions with Pertamina and SKK Migas in the transition to management of the Rokan Block, Riau. Chevron admitted that he continued to accompany Pertamina so that the state-owned oil and gas company could operate properly.

    PT Chevron Pacific Indonesia (CPI) Senior Vice President Policy, Government, and Public Affairs Wahyu Budiarto explained, the intense transition discussion was conducted by Chevron, Pertamina, and SKK Migas.


"We are helping Pertamina to operate smoothly and quickly," Budi said when met at the Ministry of Energy and Mineral Resources.

Budi also explained, the discussion between the three parties was about data that could be synergized by the three. These data can later become a provision for Pertamina in its subsequent operations.

"Now we are talking about data, so there is no need to start from zero. The data needed by anything from underground to facilities above the ground," said Budi.

Budi conveyed, the three parties also intensely discussed the implementation of Enhanced Oil Recovery (EOR). This is an effort to optimize oil reserves in existing wells. For EOR activities, Chevron has first used and always reported to SKK Migas.

"That is one of the data that we discussed, there are a lot of data in SKK. Because we have also reported our EOR reports. So, we keep updating and developing what it looks like," Budi said.

Previously, the Special Task Force for Upstream Oil and Gas Business Activities (SKK Migas) hoped that Pertamina and Chevron Pacific Indonesia would immediately agree on the Rokan Block transition. SKK Migas also targets that the agreement can be completed by the end of November 2019.

     SKK Migas Head Dwi Soetjipto said that his party needs to prepare a work program and budget for the Rokan Block. Therefore, SKK Migas hopes that the agreement process related to the Rokan transition can be completed soon.

"Later this time, we will ask for additional from Pertamina what they will do," Dwi said.

Pertamina is known to plan to drill many wells in the Rokan Block. However, Dwi has not been able to specify the number of wells to be drilled by the state-owned company.

"Great. Hopefully, at the beginning of November we will be able to input roughly the additional amount from Pertamina how much will be drilled next year," he said.

The transition period for the Rokan Block operation from Chevron to Pertamina is still ongoing. One of the works carried out during this transition period is pipe replacement. 

     Pertagas Managing Director Wiko Megantoro explained, currently, the pipe replacement process is at the design completion stage. After this design is complete, the company will complete an investment finalization plan for pipeline construction.

Shareholders of Pertamina and Marubeni will end



The chaotic Pertamina and Marubeni consortium in the Java-1 PLTGU project could continue

The partnership between PT Pertamina and Marubeni in the electricity project will end. The relationship between the two companies began with the Java 1 gas and steam power plant (PTGU) project in Cilamaya, West Java. 

    The tension among the members of the Java-1 PTGU consortium is increasing. Members of the Java-1 consortium namely PT Pertamina Power Indonesia (PPI), Marubeni Corporation and Sojitz Corporation.


The last two companies are companies from Japan. Well, this Pertamina subsidiary seems to be opposite Marubeni in the Java 1 PLTGU project (see table). In working on the 1,760 megawatt (MW) power plant project, Marubeni was considered not to prioritize business ethics. There are also violations of the domestic content level (TKDN) as well as project cost efficiency.

PPI President Director Ginanjar Sofyan, had sent a letter to three investors funding the Java-1 PLTGU project, namely the Japan Bank for International Cooperation (JBIC), NEXI and ADB. Previously, this consortium successfully won a financial close with JBIC Lenders and won a development fee of US $ 55 million.



The alleged inefficiency issue was also known from the investigation request document on the Java-1 IPP project submitted by Ginanjar to PT Pertamina's Chief Audit Executive dated September 13, 2019. Based on a copy of the document held by KONTAN, PPI considered Marubeni to be inconsistent with the proposed concept, but in the end they complained to Pertamina including regarding the appreciation program proposal.

Tensions between Pertamina and Marubeni at the Java-1 PLTGU finally led to a power plant project in Bangladesh. In this project, Marubeni is also a member of a PPI-led consortium. Therefore, PPI reportedly chose a new partner, one of the multinational companies from Japan.

    PT Pertamina Vice President of Corporate Communication Fajriyah Usman was reluctant to comment on this issue. Related to the construction of the Java-1 PLTGU, ensuring the construction phase of this plant goes according to plan.

"The Java-1 project will operate well, Pertamina is committed," said Fajriyah.

Regarding the power plant project in Bangladesh, Fajriyah said, Pertamina would review the structure of the project planning.

"There are several things that must be restructured," Fajriyah said without elaborating.

PLN's Strategic Procurement Director 2 Djoko Rahardjo Abumanan has not been able to intervene in this issue.

"Members of the consortium must immediately resolve internally," he said.

But if the conflict disrupts the project operational schedule, PLN will ask for clarification. Until this article goes to press, Marubeni has not been willing to provide confirmation.

"I want to translate and confirm to internal first," said Director of Marubeni Indonesia Slamet Muhadi, when contacted by KONTAN.

Marubeni also has several projects in Indonesia, including the Cirebon Unit II PLTU project, which partners with PT Indika Energy Tbk (see table).

"Until now there has been no influence on the Cirebon project," said Indika Energy's CEO, Azis Armand.

At present, the Cirebon II physical development project is already 60% and the target is by the end of 2021 completed.

Kongsi antara PT Pertamina dan Marubeni di proyek kelistrikan akan berakhir. Keretakan hubungan kedua perusahaan tersebut berawal dari proyek pembangkit listrik tenaga gas dan uap (PTGU) Jawa 1 di Cilamaya, Jawa Barat. Tensi di antara anggota konsorsium PTGU Jawa-1 semakin meningkat. Anggota konsorsium Jawa-1 yakni PT Pertamina Power Indonesia (PPI), Marubeni Corporation dan Sojitz Corporation. 

Kedua perusahaan terakhir adalah perusahaan dari Jepang. Nah, anak usaha Pertamina ini agaknya sedang berseberangan dengan Marubeni di proyek PLTGU Jawa 1 (lihat tabel). Dalam menggarap proyek pembangkit berkapasitas 1.760 megawatt (MW) itu, Marubeni dianggap tidak mengedepankan etika bisnis. Ada pula pelanggaran tingkat kandungan dalam negeri (TKDN) serta efisiensi biaya proyek.

Direktur Utama PPI Ginanjar Sofyan, sempat mengirim Surat kepada tiga investor pendanaan proyek PLTGU Jawa-1, yakni Japan Bank for International Cooperation (JBIC), NEXI dan ADB. Sebelumnya, konsorsium ini berhasil meraih financial close dengan Lenders JBIC dan berhasil meraih development fee US$ 55 juta.

Dugaan isu inefisiensi juga diketahui dari dokumen permohonan pelaksanaan investigasi pada proyek IPP Jawa-1 yang disampaikan oleh Ginanjar kepada Chief Audit Executive PT Pertamina tertanggal 13 September 2019. Berdasarkan salinan dokumen yang dipegang KONTAN, PPI menilai Marubeni inkonsisten dengan konsep yang diusulkan, namun pada akhirnya mereka komplain kepada Pertamina termasuk perihal usulan program apresiasi.

Ketegangan antara Pertamina dan Marubeni di PLTGU Jawa-1 akhirnya berimabs pada proyek pembangkit di Bangladesh. Di proyek ini, Marubeni juga anggota konsorsium pimpinan PPI. Oleh karena itu, PPI dikabarkan memilih mitra baru, salah satu perusahaan multinasional dari Jepang. Vice President of Corporate Communication PT Pertamina Fajriyah Usman enggan mengomentari masalah ini. Terkait pembangunan PLTGU Jawa-1, menjamin tahap konstruksi pembangkit ini berjalan sesuai rencana.

"Proyek Jawa-1 akan beroperasi dengan baik, Pertamina berkomitmen," kata Fajriyah.

Tentang proyek pembangkit di Bangladesh, Fajriyah bilang, Pertamina akan mengkaji ulang struktur perencanaan proyek itu. 

"Ada beberapa hal yang harus di-restructure," kata Fajriyah tanpa memerinci.

Direktur Pengadaan Strategis 2 PLN Djoko Rahardjo Abumanan belum bisa intervensi dalam permasalahan itu. 

"Anggota konsorsium harus segera menyelesaikan secara internal," kata dia. 

Namun jika konflik mengganggu jadwal operasional proyek, PLN akan minta klarifikasi. Hingga tulisan ini naik cetak, Marubeni belum bersedia memberikan konfirmasi.

“Saya minta translate dan konfirmasi ke internal dulu," ujar Direktur Marubeni Indonesia Slamet Muhadi, saat dihubungi KONTAN.

Marubeni juga punya beberapa proyek di Indonesia, termasuk proyek PLTU Cirebon Unit II, yang berkongsi dengan PT Indika Energy Tbk (lihat tabel). 

"Sampai saat ini tidak berpengaruh di proyek Cirebon," kata CEO Indika Energy, Azis Armand. 

Saat ini, proyek pembangunan fisik Cirebon II sudah 60% dan targetnya akhir tahun 2021 selesai.

Inpex Signs the Masela Block Contract Amendment



Inpex Corporation through its affiliate, Inpex Masela Ltd, has signed an amendment to the Masela Block production sharing contract (PSC). The oil and gas block contract was extended by 27 years so that the contract expired in 2055.

     The signing of the PSC revision was carried out by Inpex together with its partner Shell Upstream Overseas Ltd with the Special Task Force for Upstream Oil and Gas Business Activities (SKK Migas) as Indonesia's representative. The signing was witnessed directly by the Minister of Energy and Mineral Resources (ESDM) Ignasius Jonan.

"This signing marks the execution of a formal agreement related to the PSC period that was agreed and announced as part of the approval of the revised plan of development (POD) by the Government of Indonesia in July," it said in an official statement from Inpex.

In its official statement, Inpex explained that the announcement about the contract extension of the Masela Block had been made on July 16 last. The additional term of the contract is 7 years with an additional contract period and a contract extension of 20 years. Thus, the Masela Block contract will expire in 2055 from 2028 initially.

Japanese Ambassador to Indonesia Masafumi Ishii who also witnessed the signing of the contract amendment conveyed his appreciation for the Government of Indonesia. In his Instragram, he wrote that with this signing, the Abadi Project, the Masela Block could become a large-scale Japanese-Indonesian project.

"Eventually this project developed into a large-scale Japan-Indonesia project with an investment of US $ 20 billion, with an increase in GDP (Gross Domestic Product / gross domestic product for Indonesia of US $ 153 billion) and creating employment for 73 thousand people per year," wrote the Masafumi.

Previously, after receiving POD approval, INPEX Vice President Corporate Services Masela Ltd Nico Muhyiddin said that it was completing the preparation of an environmental impact analysis (Amdal). It has conducted public consultations with communities in a number of villages in the Tanimbar Islands Regency and is currently preparing a terms of reference.

"After Amdal, we will work on FEED (Front End Engineering Design / detailed design). "From the results of the FEED, we will know what the ship looks like, what kind of model, after that FID (Final Investment Decision / final investment decision)," said Nico.

At the same time, he also briefly said, his party was compiling a mapping of potential gas buyers from the Abadi Project. A number of companies becoming prospective gas buyers are PT PLN (Persero) and PT Perusahaan Gas Negara (PGN) Tbk. It will look for buyers at home and abroad.

"We have asked how much gas they need, which quality. But there is no contract, "he said.

After the FID is reached, the Abadi Project will enter the construction phase. During the construction phase, Inpex must undertake a number of activities, including the construction and operation of subsea gas wells and the construction of the Subsea Umbilicals, Risers and Flowlines (SURF) facilities off the Arafura coast. 

     Furthermore, Inpex also builds Floating Production, Storage and Offloading (FPSO) facilities, underwater gas pipelines from the FPSO to onshore Gas Receiving Facilities (GRFs), and LNG onshore refineries.



SKK Migas targets Proyak Abadi to start production in 2027. The project is projected to produce 9.5 million tons of gas per year in the form of liquefied natural gas (LNG) and 150 million cubic feet per day (million standard cubic feet per day / mmscfd) for gas pipelines.

Inpex Tanda Tangani Amendemen Kontrak Blok Masela


Inpex Corporation melalui afiliasinya, Inpex Masela Ltd, telah menandatangani amendemen kontrak kerja sama (production sharing contract/PSC) Blok Masela. Kontrak blok migas ini diperpanjang 27 tahun sehingga kontraknya berakhir pada 2055. 

      Penandatanganan revisi PSC dilakukan Inpex bersama mitranya Shell Upstream Overseas Ltd dengan Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas) sebagai perwakilan Indonesia. Penandatanganan ini disaksikan langsung oleh Menteri Energi dan Sumber Daya Mineral (ESDM) Ignasius Jonan.

“Penandatangan ini menandai eksekusi dari kesepakatan formal terkait jangka waktu PSC yang disepakati dan diumumkan sebagai bagian dari persetujuan revisi rencana pengembangan (plan of development/POD) oleh Pemerintah Indonesia pada Juli,” demikian tertulis dalam keterangan resmi Inpex.

Dalam keterangan resminya, Inpex menjelaskan bahwa pengumuman tentang perpanjangan kontrak Blok Masela telah dilakukan pada 16 Juli lalu. Tambahan jangka waktu kontrak ini yakni 7 tahun tambahan jangka waktu kontrak dan perpanjangan kontrak selama 20 tahun. Sehingga, kontrak Blok Masela akan berakhir pada 2055 dari awalnya 2028. 

Duta Besar Jepang untuk Indonesia Masafumi Ishii yang turut menyaksikan penandatangan amendemen kontrak tersebut menyampaikan apresiasinya terhadap Pemerintah Indonesia. Dalam Instragram-nya, dia menuliskan bahwa dengan penandatanganan ini, maka Proyek Abadi, Blok Masela dapat menjadi proyek berskala besar Jepang-Indonesia.

“Akhirnya proyek ini berkembang menjadi proyek berskala besar Jepang-Indonesia dengan investasi US$ 20 miliar, dengan pertambahan GDP (Gross Domestic Product/produk domestik bruto untuk Indonesia US$ 153 miliar dan menciptakan lapangan kerja sebanyak 73 ribu orang per tahun,” demikian tulis Masafumi.

Sebelumnya, pasca mendapat persetujuan POD, Vice President Corporate Services INPEX Masela Ltd Nico Muhyiddin mengatakan bahwa pihaknya sedang merampungkan penyusunan analisis dampak lingkungan (Amdal). Pihaknya telah melakukan konsultasi publik ke masyarakat di sejumlah desa yang berada di Kabupaten Kepulauan Tanimbar dan kini sedang menyusun kerangka acuan.

“Setelah Amdal, kami akan mengerjakan FEED (Front End Engineering Design/desain rinci). Dari hasil FEED, kami akan tahu kapalnya seperti apa, modelnya seperti apa, setelah itu FID (Final Investment Decision/keputusan akhir investasi),” ujar Nico.

Pada saat yang sama, dia juga sempat menuturkan, pihaknya menyusun pemetaan calon pembeli gas dari Proyek Abadi. Sejumlah perusahaan menjadi kandidat pembeli gas ini adalah PT PLN (Persero) dan PT Perusahaan Gas Negara (PGN) Tbk. Pihaknya akan mencari pembeli di dalam maupun luar negeri.

“Kami sudah menanyakan mereka butuh gasnya berapa, kualitasnya yang mana. Tetapi belum ada kontraknya,” kata dia.

Setelah FID tercapai, Proyek Abadi akan masuk tahap konstruksi. Pada tahap konstruksi, Inpex harus mengerjakan sejumlah kegiatan, meliputi pembangunan dan pengoperasian sumur gas bawah laut dan konstruksi fasilitas Subsea Umbilicals, Risers and Flowlines (SURF) di lepas pantai Arafura. 

     Selanjutnya, Inpex juga membangun fasilitas produksi, penampungan dan bongkar muat terapung (Floating Production, Storage and Offloading/FPSO), pipa gas bawah laut dari FPSO ke fasilitas penerima gas (Gas Receiving Facility/GRF) di darat, serta kilang LNG di darat. 

SKK Migas menargetkan Proyak Abadi akan mulai berproduksi pada 2027. Proyek ini diproyeksikan menghasilkan gas sebesar 9,5 juta ton per tahun dalam bentuk gas alam cair (Liquefied Natural Gas/LNG) dan 150 juta kaki kubik per hari (million standard cubic feet per day/mmscfd) untuk gas pipa.

Former Managing Director Petral becomes a suspect



Bambang allegedly received more than Rp 40 billion related to the procurement of oil and gas.



The Corruption Eradication Commission (KPK) named former Pertamina Energy Trading Ltd (Petral) director Bambang Irianto a suspect in bribery cases related to trade in crude oil and refinery products at Pertamina Energy Service (PES) Pte Ltd.

     Bambang allegedly received gifts or promises related to trading crude oil and refinery products at Pertamina Energy Services Pte Ltd (PES) as a subsidiary company of PT Pertamina (Persero).

"That in the period 2010 to 2013, the suspect BTO (Bambang) through a Siamese company account was alleged to have received money of at least 2.9 million US dollars for the assistance provided to Kernel Oil related to trading activities of refined products and crude oil to PES / PT Pertamina in Singapore and cargo shipments, "said Syarif at the Jakarta KPK building.


Syarif explained, the investigation into bribery of oil and gas mafia was carried out after President Joko Widodo declared war on the practice of oil and gas mafia to dissolve Petral in May 2015. The dissolution was believed to be due to oil and gas mafia practices in the oil trade assigned to Pertamina's subsidiary, including Petral and PES.

"In parallel, as a form of KPK's concern and support for priorities in combating the oil and gas mafia, the KPK made further searches and in this case it was found that the actual activities were carried out by PES, while Petral was positioned as a kind of paper company. The KPK focuses on uncovering irregularities that occur in the PES, "he said.

The KPK has confirmed a number of findings of alleged oil and gas mafia practices. In fact, in this case it was found how the flow of bribery carried out across countries and using "shell" companies in foreign jurisdictions included in the category of tax haven countries.

Initially, with the target of creating National Resilience in the energy sector, Pertamina formed the Integrated Supply Chain Function (ISC). This function is in charge of carrying out planning, procurement, exchange, crude oil sales, intermedia, and commercial and operational refinery products. Pertamina then established several subsidiary companies that are fully owned and controlled, namely Petral which is domiciled in Hong Kong and PES which is domiciled in Singapore.

Petral does not have active procurement and sales business activities, while PES runs main business activities, namely the procurement and sale of crude oil and refinery products in Singapore to support its parent company which is tasked with ensuring the availability of fuel oil nationally.

"We deeply regret the alleged corruption in the oil and gas sector. The reason is that the energy sector is a crucial sector for Indonesia, "said Syarif.

According to Syarif, the KPK has conducted an investigation very carefully and carefully. A total of 53 people have been examined as witnesses.

"And the study of documents from various agencies as well as coordination with several authorities across the country," he said.



Receiving Bribes

The bribery started when Bambang was appointed vice president (VP) of PES Marketing on May 6, 2009. In 2008, Bambang met with representatives of KEE Oil PTE LTD (Kemel Oil). The company is one of the partners in the trade of crude oil and refinery products for PES / PT Pertamina.

"When Bambang was appointed vice president of marketing, PES carried out the procurement and sale of crude oil and refinery products for the needs of PT Pertamina, which could be followed by the National Oil Company, major oil companies, refineries and traders," said Syarif.

In the period 2009 to June 2012, Kernel Oil representatives were invited several times and became PES partners in the import and export of crude oil for the benefit of PES / PT Pertamina. At that time, Bambang helped secure the allocation of Kernel Oil cargo in the procurement tender. In return, it is suspected that Bambang received a sum of money received through a bank account abroad.

"To accommodate this acceptance, Bambang established SIAM Group Holding Ltd, which is domiciled in the British Virgin Island," said Syarif.

Furthermore, in 2012, according to the direction of the President, PT Pertamina increased efficiency in the trade of crude oil and fuel oil (BBM) by prioritizing direct purchases to the main source. Companies that can become PES partners should be included in the PES List of Selected Business Partners (DMUT), including the National Oil Company (NOC). However, not all companies registered with the PES DMUT are invited to participate in a tender at PES.



Bambang along with a number of PES officials allegedly determined partners who would be invited to take part in the auction. NOCs are often invited to participate in auctions. However, the shipper of the cargo is Emirates National Oil Company (ENOC). Allegedly, ENOC is a "flag company" used by Kernel Oil representatives. The KPK also suspects that the NOC was invited as a camouflage to make it appear that PES is working with the NOC to meet the procurement requirements.

"The suspect Bambang allegedly directed to continue inviting the NOC despite knowing that the NOC was not (including) the party sending the cargo to PES / PT Pertamina," said Syarif.

Mantan Dirut Petral menjadi Tersangka


Bambang diduga menerima lebih dari Rp 40 miliar terkait pengadaan minyak dan gas.

Komisi Pemberantasan Korupsi (KPK) menetapkan mantan direktur utama Pertamina Energy Trading Ltd (Petral) Bambang Irianto sebagai tersangka kasus suap terkait dengan perdaganan minyak mentah dan produk kilang di Pertamina Energy Service (PES) Pte Ltd. Bambang diduga menerima hadiah atau janji terkait kegiatan perdagangan minyak mentah dan produk kilang di Pertamina Energy Services Pte Ltd (PES) selaku subsidiary company PT Pertamina (Persero).

Wakil Ketua KPK Laode Muhammad Syarif mengatakan, Bambang diduga menerima suap sebesar 2,9 juta dolar AS atau setara Rp 40.729.775.000 sesuai nilai tukar saat ini. Penerimaan tersebut terjadi dalam rentang 2010 hingga 2013 melalui rekening perusahaan Siam Group Holding yang berkedudukan hukum di British Virgin Island.

"Bahwa pada periode tahun 2010 sampai dengan 2013, tersangka BTO (Bambang) melalui rekening perusahaan Siam diduga telah menerima uang sekurang-kurangnya 2,9 juta dolar AS atas bantuan yang diberikannya kepada pihak Kernel Oil terkait dengan kegiatan perdagangan produk kilang dan minyak mentah kepada PES/ PT Pertamina di Singapura dan pengiriman kargo," kata Syarif di gedung KPK Jakarta.

Syarif menjelaskan, penyelidikan suap mafia minyak dan gas ini dilakukan setelah Presiden Joko Widodo menyatakan perang terhadap praktik mafia minyak dan gas hingga membubarkan Petral pada Mei 2015. Pembubaran itu diyakini karena terdapat praktik mafia minyak dan gas dalam perdagangan minyak yang ditugaskan pada anak perusahaan Pertamina, termasuk Petral dan PES.

"Secara paralel, sebagai bentuk concern dan dukungan KPK terhadap prioritas memerangi mafia minyak dan gas, maka KPK melakukan penelusuran lebih lanjut dan dalam perkara ini ditemukan bahwa kegiatan sesungguhnya dilakukan oleh PES, sedangkan Petral diposisikan sebagai semacam paper company. Sehingga, KPK fokus mengungkap penyimpangan yang terjadi di PES tersebut," kata dia.

KPK telah mengonfirmasi sejumlah temuan dugaan praktik mafia minyak dan gas tersebut. Bahkan, dalam perkara ini ditemukan bagaimana alur suap yang dilakukan lintas negara dan menggunakan perusahaan “cangkang” di yurisdiksi asing yang masuk dalam kategori tax haven countries.

Awalnya, dengan target menciptakan Ketahanan Nasional di bidang energi, Pertamina membentuk Fungsi Integrated Supply Chain (ISC). Fungsi ini bertugas melaksanakan kegiatan perencanaan, pengadaan, tukar-menukar, penjualan minyak mentah, intermedia, serta produk kilang untuk komersial dan operasional. Pertamina kemudian mendirikan beberapa perusahaan subsidiari yang dimiliki dan dikendalikan penuh, yakni Petral yang berkedudukan hukum di Hong Kong dan PES yang berkedudukan hukum di Singapura.

Petral tidak punya kegiatan bisnis pengadaan dan penjualan yang aktif, sedangkan PES menjalankan kegiatan bisnis utama, yaitu pengadaan dan penjualan minyak mentah dan produk kilang di Singapura untuk mendukung perusahaan induknya yang bertugas menjamin ketersediaan bahan bakar minyak secara nasional.

"Kami sangat menyesalkan terjadinya dugaan tindak pidana korupsi dalam sektor migas. Pasalnya, sektor energi ini merupakan sektor yang krusial bagi Indonesia," ujar Syarif. 

Menurut Syarif, KPK telah melakukan penyelidikan dengan sangat hati-hati dan cermat. Sebanyak 53 orang telah diperiksa sebagai saksi.

"Dan dipelajari dokumen dari berbagai instansi serta koordinasi dengan beberapa otoritas di lintas negara," kata dia.

Penerimaan Uang Suap

Suap bermula saat Bambang diangkat menjadi vice president (VP) Marketing PES pada 6 Mei 2009. Pada 2008, Bambang bertemu dengan perwakilan Kernel Oil PTE LTD (Kemel Oil). Perusahaan itu merupakan salah satu rekanan dalam perdagangan minyak mentah dan produk kilang untuk PES / PT Pertamina.

"Pada saat tersangka Bambang menjabat sebagai vice president marketing, PES melaksanakan pengadaan serta penjualan minyak mentah dan produk kilang untuk kebutuhan PT Pertamina yang dapat diikuti oleh National Oil Company, major oil company, refinery, maupun trader," kata Syarif.

Pada periode 2009 sampai Juni 2012, perwakilan Kernel Oil beberapa kali diundang dan menjadi rekanan PES dalam kegiatan impor dan ekspor minyak mentah untuk kepentingan PES/ PT Pertamina. Saat itu, Bambang membantu mengamankan alokasi kargo Kernel Oil dalam tender pengadaan. Sebagai imbalannya, diduga Bambang menerima sejumlah uang yang diterima melalui rekening bank di luar negeri.

"Untuk menampung penerimaan tersebut, maka Bambang mendirikan SIAM Group Holding Ltd yang berkedudukan hukum di British Virgin Island," kata Syarif.

Selanjutnya, pada 2012, sesuai arahan Presiden, PT Pertamina melakukan peningkatan efisiensi dalam perdagangan minyak mentah dan Bahan Bakar Minyak (BBM) dengan mengutamakan pembelian langsung ke sumber utama. Perusahaan yang dapat menjadi rekanan PES seharusnya yang masuk dalam Daftar Mitra Usaha Terseleksi (DMUT) PES, termasuk National Oil Company (NOC). Namun, tidak semua perusahaan yang terdaftar pada DMUT PES diundang mengikuti tender di PES. 

Bambang bersama sejumlah pejabat PES diduga menentukan rekanan yang akan diundang mengikuti lelang. NOC menjadi yang sering diundang mengikuti lelang. Namun, yang menjadi pengirim kargo adalah Emirates National Oil Company (ENOC). Diduga, ENOC merupakan “perusahaan bendera” yang digunakan perwakilan Kernel Oil. KPKjuga menduga NOC diundang sebagai kamuflase agar seolah-olah PES bekerja sama dengan NOC agar memenuhi syarat pengadaan. 

"Tersangka Bambang diduga mengarahkan untuk tetap mengundang NOC tersebut meskipun mengetahui bahwa NOC itu bukanlah (termasuk) pihak yang mengirim kargo ke PES/PT Pertamina," kata Syarif.
