Pertamina Shoots 55 Wells in Mahakam



PT Pertamina targets to drill 55 wells in the Mahakam block this year so that oil and gas production levels in the blocks located in East Kalimantan can be maintained.

Pertamina Corporate Communication Vice President Adiatma Sardjito said that throughout 2017, the company has drilled 14 wells in the Mahakam Block.

"Then, this year, we propose to be 55 wells. So, the total can drill 69 wells. If seen 55 divided by 12 months, meaning in a month can be four or five wells, "he said.

The potential for oil or condensate production in the Mahakam Block can reach 52,000 barrels per day (BPD). The Mahakam block is estimated to have oil reserves of 105 million barrels and 4.9 trillion cubic feet of gas.

In the process of managing the Mahakam block, Pertamina is looking for partners. However, Adiatma admitted that the company has not taken a decision in choosing a company that will become a partner in managing the offshore oil and gas blocks.

Pertamina needs partners to reduce the risks that occur in the field.

"Looking for partners in the oil and gas business is normal. So, we and our partners can mitigate the potential risks that exist such as congestion and so on. Included in the issue of investment as well, "said Adiatma.

Although not yet determine the partners, Adiatma said, Pertamina will continue to run oil and gas production in Mahakam block.

"We will continue to operate, pending the decision of who the partner is."

Meanwhile, the target of natural gas production from the Mahakam block in 2018 amounted to 916 million cubic feet per day fell to 32.65% compared to the realization as of November 2017.

The Mahakam Block gas production target refers to the work plan and budget proposed by Pertamina as the new operator of offshore oil and gas blocks in East Kalimantan. 

     Based on data from the Special Unit for Upstream Oil and Gas Business Activities (SKK Migas), the daily average gas production from Mahakam Block as of November 2017 reached 1.360 million standard cubic feet per day (MMscfd) and 52,000 BPH condensate.

The target of condensate production in the Mahakam block this year is only 42,000 BPD lower than the realization during 2017. This year's oil and gas production target is achieved by drilling 69 development wells, 132 re-drilling wells, 5,623 wells and advanced development plans five oil and gas fields in the Mahakam block. Previously, Pertamina targeted gas production of 1,100 MMscfd and 48,000 BPH condensate.

In terms of activities, Pertamina previously planned to drill 55 development wells, 125 re-operation wells, and 5,500 wells.

SHARE PARTICIPATION

Meanwhile, the ESDM Ministry will decide on the division of regional participating interest (PI) of 10% in the Mahakam block this month. Deputy Minister of Energy and Mineral Resources Arcandra Tahar said that the two local governments concerned in the Mahakam Block, the East Kalimantan Provincial Government and the Government of Kutai Kartanegara Regency, agreed to submit a decision on the distribution of shares of participation to the central government.

"The provincial government of East Kalimantan and the district government of Kutai Kartanegara will return to us," he said at the office of the Ministry of Energy and Mineral Resources on Wednesday (3/1).

In the future, the management of the Mahakam block by the regional government will be conducted through a regional-owned enterprise (BUMN). According to him, it has been done in Block Offshore North West Java (ONWJ) involving West Java Provincial Government and DKI Jakarta.

"It should be one such BUMD in ONWJ one BUMD. There are DKI Jakarta and West Java," he said.

The offering of a 10% stake in the Mahakam Block will be made in accordance with the Minister of Energy and Mineral Resources No.37 / 2016 on the 10% Pl Public Offering Provision on the Oil and Gas Working Area. Later, the BUMD does not need to pay the management rights in cash.

The BUMD will pay 10% PI by installments. The installment will be arranged so as not to spend all the profit earned so that BUMD.

As a result, the region will continue to receive periodic benefits from the production of oil and gas blocks to be deposited to the regional budget and expenditure (APBD).

Arcandra asserted that in the decision-making process his party will not be out of the provisions in the Minister of Energy and Mineral Resources Regulation no. 37/2016.

Pertamina Bidik 55 Sumur di Mahakam

PT Pertamina menargetkan untuk mengebor 55 sumur di Blok Mahakam sepanjang tahun ini sehingga tingkat produksi minyak dan gas bumi di blok yang berlokasi di Kalimantan Timur itu bisa terjaga.

Vice President Corporate Communication Pertamina Adiatma Sardjito mengatakan bahwa sepanjang 2017, perseroan telah mengebor 14 sumur di Blok Mahakam.

“Lalu, pada tahun ini, kami mengusulkan bisa sebanyak 55 sumur. Jadi, total bisa mengebor 69 sumur. Kalau dilihat 55 dibagi 12 bulan, berarti dalam sebulan bisa empat atau lima sumur,” ujarnya.

Potensi produksi minyak atau kondensat di Blok Mahakam bisa mencapai 52.000 barel per hari (BPH). Blok Mahakam diperkirakan masih memiliki cadangan minyak sebesar 105 juta barel dan 4,9 triliun kaki kubik gas.

Dalam proses pengelolaan Blok Mahakam itu, Pertamina pun sedang mencari mitra. Namun, Adiatma mengaku bahwa perseroan belum mengambil keputusan dalam memilih perusahaan yang akan menjadi mitra dalam mengelola blok migas lepas pantai tersebut.

Pertamina membutuhkan mitra kerja untuk mengurangi risiko yang terjadi di lapangan. 

“Mencari mitra dalam bisnis migas itu hal biasa. Jadi, kami bersama mitra bisa memitigasi potensi risiko yang ada seperti ada kemacetan dan sebagainya. Termasuk dalam mengeluarkan investasi juga,” ujar Adiatma.

Kendati belum menentukan mitra, Adiatma menyebutkan, Pertamina akan tetap menjalankan produksi migas di blok Mahakam. 

“Kami akan beroperasi terus, sambil menunggu keputusan siapa mitranya.”

Sementara itu, target produksi gas bumi dari Blok Mahakam pada 2018 sebesar 916 juta kaki kubik per hari turun hingga 32,65% dibandingkan dengan realisasi per November 2017.

Target produksi gas bumi Blok Mahakam itu mengacu pada rencana kerja dan anggaran yang diajukan oleh Pertamina sebagai operator baru blok migas lepas pantai di Kalimantan Timur tersebut. 

     Berdasarkan data Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas), rerata harian produksi gas dari Blok Mahakam per November 2017 mencapai 1.360 juta kaki kubik per hari (million standard cubic feet per day/MMscfd) dan kondensat 52.000 bph. 

Target produksi kondensat di Blok Mahakam pada tahun ini hanya 42.000 bph, lebih rendah dari realisasi selama 2017. Target produksi minyak dan gas bumi pada tahun ini dicapai melalui pengeboran 69 sumur pengembangan, pengeboran ulang 132 sumur, 5.623 perbaikan sumur serta pengajuan rencana pengembangan lanjutan atas lima lapangan migas di Blok Mahakam.

      Sebelumnya, Pertamina menargetkan produksi gas sebesar 1.100 MMscfd dan kondensat 48.000 bph.

Dari sisi kegiatan, Pertamina Sebelumnya berencana melakukan pengeboran 55 sumur pengembangan, 125 kegiatan sumur kerja ulang, dan perawatan 5.500 sumur.

SAHAM PARTISIPASI

Sementara itu, Kementerian ESDM akan memutuskan pembagian hak pengelolaan (participating interest/PI) daerah sebesar 10% di Blok Mahakam pada bulan ini. Wakil Menteri ESDM Arcandra tahar mengatakan bahwa dua pemerintah daerah yang berkepentingan di Blok Mahakam, yakni Pemerintah Provinsi Kalimantan Timur dan Pemerintah Kabupaten Kutai Kartanegara, sepakat menyerahkan keputusan pembagian saham partisipasi kepada pemerintah pusat.

"Pemerintah Provinsi Kalimantan Timur dan Pemerintah Kabupaten Kutai Kartanegara mengembalikan kepada kita. Kedua belah pihak sepakat bahwa pemerintah pusat yang memutuskan. Secepatnya akan kita selesaikan, Januari ini,“ ujarnya di kantor Kementerian ESDM, Rabu (3/1).

Nantinya, pengelolaan Blok Mahakam oleh pemda akan dilakukan melalui satu badan usaha milik daerah (BUMN). Menurutnya, hal itu sudah dilakukan di Blok Offshore North West Java (ONWJ) yang melibatkan Pemprov Jawa Barat dan DKI Jakarta.

"Harusnya nanti satu BUMD seperti di ONWJ satu BUMD. Ada DKI Jakarta dan Jawa Barat," tuturnya.

Penawaran saham partisipasi 10% Blok Mahakam akan dilakukan sesuai dengan Peraruran Menteri ESDM No.37/2016 tentang Ketentuan Penawaran Pl 10% pada Wilayah Kerja Minyak dan Gas Bumi. Nantinya, BUMD tersebut tidak perlu membayar hak kelola tersebut secara tunai.

BUMD tersebut akan membayar 10% PI dengan cara mencicil. Cicilan tersebut akan diatur agar tidak menghabiskan seluruh keuntungan yang diperoleh sehingga BUMD.

Alhasil, daerah akan tetap menerima keuntungan secara berkala dari hasil produksi blok migas yang akan disetor ke anggaran pendapatan dan belanja daerah (APBD).

Arcandra menegaskan bahwa dalam proses pengambilan keputusan pihaknya tidak akan keluar dari ketentuan dalam Peraturan menteri ESDM No. 37/2016.

LNG Production of Rhinoceros Refinery Targeted 156 Cargo



The production of liquefied natural gas (LNG) from LNG Plant managed by PT Badak NGL is targeted to increase to 156 cargoes by next year, from 140 cargoes this year.

Head of Special Unit for Upstream Oil and Gas Business Unit (SKK Migas) Amien Sunaryadi said the Badak LNG Plant has obtained gas supply to be processed into LNG from a number of oil and gas blocks, namely Mahakam block, Sanga-Sanga, East Kalimantan, Attaka, Indonesia Deepwater Development (IDD), and Jangkrik Field. Jangkrik Field gas production is projected to continue to rise.

"So, the Rhino Refinery in Bontang LNG production next year 156 cargoes, this year about 140 cargoes. Rising mainly from Eni (Field Cricket), Eni just came in, "he said. The Eni Italia-owned cricket field now generates 600 million cubic feet per day (mmscfd) of gas. It will seek to boost gas production.

"We are trying to increase a little," added Amien.

With a target of 153 cargoes, it is the first time that the LNG production of the Badak Refinery has increased since 2015. LNG production from Lontang Bontang refinery has been declining since 2015. In 2015, LNG production from the East Kalimantan refinery reaches 189 cargoes. However, this production figure fell to 172 cargoes in 2016. While this year's production is only about 140 cargoes.

Related to the operation, President Director of Badak NGL Didik Sasongko explained, his side will conduct a decommissioning of two train from total of eight train at the refinery it manage. The reduction in the number of trains in operation is a result evaluation of SKK Migas with gas producers.

We see with SKK Migas, for long term optimization, only need six train, we off two train. Because if we keep, too expensive, "he explained.

Not only about the number of train, next year the manager of LNG refinery in East Kalimantan is also officially switched to PT Badak NGL. This assignment refers to the Letter of the Minister of Finance No. S303 / MK6 / 2017 dated November 27, 2017. Operation scheme Badak LNG plant after 2017 is a new pattern that the Directorate General of State Assets through LMAN as the owner of the assets and appoint PT Badak NGL operate the refinery. Produksi LNG Kilang Badak Ditargetkan 156 Kargo


Produksi gas alam cair (liquefied natural gas/LNG) dari Kilang LNG yang dikelola PT Badak NGL ditargetkan naik menjadi 156 kargo pada tahun depan, dari tahun ini sekitar 140 kargo.

Kepala Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas) Amien Sunaryadi mengatakan, selama ini Kilang LNG Badak memperoleh pasokan gas untuk diolah menjadi LNG dari sejumlah blok migas, yakni Blok Mahakam, Sanga-Sanga, East Kalimantan, Attaka, Indonesia Deepwater Development (IDD), dan Lapangan Jangkrik. Produksi gas Lapangan Jangkrik diproyeksikan akan terus naik. 

“Jadi, Kilang Badak di Bontang itu produksi LNG tahun depan 156 kargo, tahun ini sekitar 140 kargo. Naiknya terutama dari Eni (Lapangan Jangkrik), Eni baru saja masuk,” kata dia. Lapangan Jangkrik yang dikelola Eni Italia kini menghasilkan gas 600 juta kaki kubik per hari (million standard cubic per day/ mmscfd) . Pihaknya akan berupaya menggenjot produksi gas ini. 

“Sedang diusahakan dinaikan sedikit,” tambah Amien.

Dengan target tahun depan ditetapkan 153 kargo, maka ini kali pertama produksi LNG Kilang Badak naik sejak 2015. Produksi LNG dari Kilang LNG Bontang tercatat terus turun sejak 2015. Pada 2015, produksi LNG dari kilang di Kalimantan Timur ini mencapai 189 kargo. Namun, angka produksi ini turun menjadi 172 kargo pada 2016. Sementara tahun ini produksinya hanya sekitar 140 kargo.

Terkait operasional, Presiden Direktur Badak NGL Didik Sasongko menjelaskan, pihaknya akan melakukan penghentian operasi (decomissioning) dua train dari total delapan train di kilang yang dikelolanya. Pengurangan jumlah train beroperasi ini merupakan hasil evaluasi SKK Migas dengan para produser gas. 

Kami lihat dengan SKK Migas, untuk optimalisasi jangka panjang, hanya perlu enam train, kami lepas dua train. Karena kalau kami pelihara, terlalu mahal,” jelasnya.

Tidak hanya soal jumlah train, tahun depan pengelola kilang LNG di Kalimantan Timur ini juga resmi beralih ke PT Badak NGL. Penugasan ini mengacu pada Surat Menteri Keuangan Nomor S303/MK6/2017 tanggal 27 November 2017. Skema pengoperasian Kilang LNG Badak pasca 2017 merupakan pola baru yakni Direktorat Jenderal Kekayaan Negara melalui LMAN sebagai pemilik aset dan menunjuk PT Badak NGL mengoperasikan kilang. Total aset yang dikelola senilai Rp 16 triliun.

Meski menjadi pengelolan, Amien menegaskan, Badak NGL tidak menerima pembayaran dan membayar biaya apapun. Adapun, biaya pencairan gas sebesar US$ 0,22 sen per juta british thermal unit (MMBtu) dibayar para produsen gas. Selain itu, biaya operasi dan investasi kilang semuanya dibebankan kepada produsen gas yang memiliki saham pada PT Badak NGL.

Masela Design Work Auction Opened



Inpex Masela Limited, Abadi Field operator, Masela Block, immediately opens a pre-defined end engineering (pre-FEED) project tender for the development of gas resources located in the Arufuru Sea, Maluku.

The subsidiary of Inpex Corporation is conducting a pre-FEED review check to complete the pre-qualification phase. Senior Specialist Media Relations Inpex Masela Limited Moch. N. Kurniawan said that it immediately started a tender for pre-FEED Abadi Field and the construction of a land liquefied natural gas (LNG) refinery. The auction process with a value of about US $ 23 million will last for 3 months.

"After prequalification is completed now is pre-FEED auction stage. More internal review, "he said.

Auction work packages include the study of floating production storage offloading (FPSO) and a land LNG plant. However, Iwan did not mention the details of the completion target of each stage. He ensures that Inpex will work to speed up the process so that the gas field project can start operating soon.

The results of this study will be used to enter the FEED phase which will be the basis for revision of the development plan of the field. At the FEED stage, workmanship Studies on the technical side of the specification, cost estimation, construction, and contract strategy.

Previously, Inpex, which operated the Masela Block, received a green light from the Minister of Energy and Mineral Resources, Ignasius Jonan, who stated that the contract extension until 2048. At present, the Masela Block contract will expire in 2028.

In addition to the extension, the government will also provide additional time for Inpex operations at Masela for 7 years to compensate for changes in the LNG plant scheme to float into a refinery onshore. Thus, Inpex governance of 65% and Shell 35% can be up to 2055.

Proposal for extension of cooperation contracts and compensation of time for lost contract period as an effort to make the project run according to economies of scale after changing development schemes. The proposed extension also considers the first production target, which is about 2026 or 2 years before the contract expires in 2028.

Previously, Head of Program and Communications Division of Wisnu Prabawa Taher said that currently, Inpex Masela Limited is procuring for pre-FEED work packages. According to him, the budget to do the work has been approved by SKK Migas.

After the government decided on the development of Abadi Field, Masela Block used an onshore liquefied natural gas (LNG) on March 23, 2016, the investment plan that Inpex had built was instant mess. The plan, which has been pioneered for 10 years, returned to zero since Inpex and Shell had to reconstruct the plan after the government changed the floating refinery scheme to a landline.

With the change of scheme, Inpex and Shell have to recalculate the investment for the development of oil and gas blocks including investment rate of return (IRR). It became natural because, with the change of scheme, investment was changed. 

     Masela's IRR project is currently only about 9%. In the meantime, Inpex and Shell expect the return on investment to reach 15%.

To achieve an IRR of 15%, Inpex and Shell proposed replacement time lost for 10 years (2007-2017). By reason of the preparation of the investment plan since 2007 with the floating refinery scheme to be destroyed, Inpex requested a replacement for 10 years. 

     The oil and gas block contract signed in 1998 will expire in 2028. Meanwhile, with the changes refinery development scheme, the project is projected to produce in 2026.

Lelang Pengerjaan Desain Masela Dibuka


Inpex Masela Limited, operator Lapangan Abadi, Blok Masela, segera membuka tender pekerjaan pra-pendefinisian proyek atau pre-front end engineering design (pre-FEED) untuk pengembangan sumber gas yang berlokasi di Laut Arufuru, Maluku tersebut.

Anak perusahaan Inpex Corporation itu sedang melakukan pemeriksaan kajian pre-FEED untuk menyelesaikan tahap pra-kualifikasi. Senior Specialist Media Relations Inpex Masela Limited Moch. N. Kurniawan mengatakan bahwa pihaknya segera memulai tender untuk pre-FEED Lapangan Abadi dan pembangunan kilang gas alam cair (liquefied natural gas/LNG) darat. Proses lelang dengan nilai sekitar US$23 juta itu akan berlangsung selama 3 bulan.

“Setelah prakualifikasi selesai sekarang sedang tahap lelang pre-FEED. Lagi review internal,” katanya.

Paket pengerjaan lelang meliputi Studi fasilitas produksi terapung (floating production storage offloading/FPSO) dan kilang LNG darat. Namun, Iwan tidak menyebut detail target penyelesaian tiap tahapan tersebut. Dia memastikan, Inpex akan berupaya untuk mempercepat proses itu agar proyek lapangan gas itu bisa segera beroperasi.

Hasil kajian ini akan digunakan untuk masuk tahap FEED yang nantinya akan menjadi basis revisi rencana pengembangan Iapangan. Pada tahap FEED, pengerjaan Studi mengenai sisi teknis menyangkut spesifikasi, estimasi biaya, konstruksi, dan strategi kontrak pengerjaanya. 

“Kami berkonsentrasi penuh agar tahapan demi tahapan proyek ini dapat kami laksanakan,” katanya.

Sebelumnya, Inpex yang mengoperasikan Blok Masela mendapat lampu hijau dari Menteri ESDM Ignasius Jonan yang menyatakan bahwa perpanjangan kontrak hingga 2048. Saat ini, kontrak Blok Masela akan berakhir pada 2028.

Selain perpanjangan, pemerintah juga akan memberikan tambahan waktu operasi Inpex di Masela selama 7 tahun sebagai kompensasi perubahan skema kilang LNG terapung menjadi kilang di darat. Dengan demikian, masa kelola Inpex yang menguasai 65% dan Shell 35% bisa sampai 2055.

Usulan untuk perpanjangan kontrak kerja sama dan mendapat kompensasi waktu atas masa kontrak yang hilang sebagai salah satu upaya untuk membuat proyek berjalan sesuai dengan skala ekonomi setelah mengalami perubahan skema pengembangan. Usulan perpanjangan juga mempertimbangkan target produksi pertama, yakni sekitar 2026 atau 2 tahun sebelum kontrak berakhir pada 2028.

Sebelumnya, Kepala Divisi Program dan Komunikasi Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas) Wisnu Prabawa Taher mengatakan bahwa saat ini Inpex Masela Limited sedang melakukan pengadaan untuk paket pekerjaan pre-FEED. Menurutnya, anggaran untuk melakukan pekerjaan tersebut telah disetujui oleh SKK Migas.

Setelah pemerintah memutuskan pengembangan Lapangan Abadi, Blok Masela menggunakan kilang LNG di darat (onshore liquefied natural gas) pada 23 Maret 2016, rencana investasi yang telah dibangun Inpex pun berantakan seketika. 

      Rencana yang sudah dirintis selama 10 tahun itu kembali ke titik nol karena Inpex dan Shell harus menyusun kembali rencana setelah pemerintah mengubah skema kilang terapung menjadi darat.

Dengan perubahan skema itu, Inpex dan Shell pun harus menghitung ulang investasi untuk pengembangan blok migas tersebut termasuk skala pengembalian investasi (investment rate of return/IRR). 

     Hal itu menjadi wajar karena dengan perubahan skema, investasi pun berubah. IRR proyek Masela saat ini hanya sekitar 9%. Sementara itu, Inpex dan Shell berharap agar tingkat pengembalian investasi mencapai 15%.

Untuk mencapai IRR 15%, Inpex dan Shell mengusulkan penggantian waktu yang hilang selama 10 tahun (2007-2017). Dengan alasan penyusunan rencana investasi sejak 2007 dengan skema kilang terapung menjadi musnah, Inpex meminta penggantian waktu selama 10 tahun. 

     Kontrak blok migas yang diteken pada 1998 itu akan habis masa kontrak pada 2028. Sementara itu, dengan perubahan skema pembangunan kilang, proyek diproyeksikan akan berproduksi pada 2026.

Supreme Court Strengthens COSL & Husky Parties



Efforts by the Business Competition Supervisory Commission (KPPU) to defend the decision on the jackpot plot of services drilling rig services between PT COSL Indo and Husky CNOOC Madura Limited ended defeated in the Supreme Court (MA).

The Supreme Court in the verdict of cassation actually reinforced the decision of South Jakarta District Court which overturned the KPPU's decision. In the decision No. 952 K / Pdt. Sus-KPPU / 201 7 Supreme Court declared the petition filed by KPPU.

"Rejected the appeal from the appellant of the Supervisory Commission of the Business Competition Supervisory Commission," the ruling from the Court's Supreme Court Registry official website said Tuesday (2/1).

The cassation is examined by a panel of judges comprising Takdir Rahmadi, Nurul Elmiyah and I Gusti Agung Surnanatha. The verdict was read on October 19, 2017. The verdict as well as reinforce the decision of South Jakarta Commercial Court. 907 K / Pdt.GKPPU / 2016 / PN.Jkt.Sel. which was set by the judge on April 27, 2017. The judges did not find the affiliation facts as mentioned by KPPU which caused a conspiracy.

Chairman of the Supreme Court Justice Takdir Rahmadi said the appellant of the appeal was unable to prove the existence of a conspiracy between PT COSL Indo and Husky CNOOC Madura Limited.

The two companies were not legally and convincingly proven to meet the elements of Article 22 of Law no. 5/1999 on Prohibition of Monopolistic Practices and Unfair Business Competition.

This ruling is also reinforced by testimony from witnesses and experts indicating that the bidding process is in compliance with prevailing regulations and current oil and gas industry conditions.

PT COSL Indo and Husky CNOOC Madura Limited have also received approval from the tender result from SKK Migas. In addition, Appreciation Letter has been given by Husky CNOOC Madura Limited as a service user to PT COSL INDO.

Upaya Komisi Pengawas Persaingan Usaha (KPPU) untuk mempertahankan putusan tentang persekongkolan tender jasa jack-up drilling rig services antara PT COSL Indo dan Husky CNOOC Madura Limited berakhir kalah di Mahkamah Agung (MA).

Mahkamah Agung dalam putusan kasasi justru menguatkan putusan Pengadilan Negeri Jakarta Selatan yang membatalkan putusan KPPU. Dalam putusan No. 952 K/Pdt. Sus-KPPU/201 7 MA menyatakan menolak permohonan kasasi yang diajukan KPPU.

“Menolak permohonan kasasi dari pemohon kasasi Komisi Pengawas Persaingan Usaha tersebut,” bunyi amar putusan dari laman resmi Kepaniteraan Mahkamah Agung, Selasa (2/1).

Perkara kasasi tersebut diperiksa oleh majelis hakim agung yang terdiri dari Takdir Rahmadi, Nurul Elmiyah, dan I Gusti Agung Surnanatha. Putusan dibacakan pada 19 Oktober 2017. Putusan itu sekaligus mempertegas putusan Pengadilan Niaga Jakarta Selatan No. 907 K/Pdt.GKPPU/2016/PN.Jkt.Sel. yang ditetapkan hakim pada 27 April 2017. Majelis hakim ketika itu tidak menemukan fakta afiliasi seperti yang disebutkan KPPU yang menimbulkan persekongkolan.

Ketua Majelis Hakim Agung Takdir Rahmadi mengatakan pemohon kasasi tidak mampu membuktikan adanya persekongkolan antara PT COSL Indo dan Husky CNOOC Madura Limited.

Kedua perusahaan pun tidak terbukti secara sah dan meyakinkan memenuhi unsur-unsur dalam Pasal 22 UU No. 5/1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat.

Putusan ini juga diperkuat dengan keterangan keterangan saksi dan ahli menyatakan proses tender sudah sesuai dengan peraturan yang berlaku dan kondisi industri minyak dan gas bumi saat ini.

PT COSL Indo dan Husky CNOOC Madura Limited pun sudah mendapat persetujuan hasil pelaksanaan tender dari SKK Migas. Selain itu telah diberikan Appreciation Letter oleh Husky CNOOC Madura Limited sebagai pengguna jasa kepada PT COSL INDO.

Sebelumnya, KPPU mengajukan kasasi atas putusan Pengadilan Negeri Jakarta Selatan yang memenangkan pihak PT COSL Indo dan Husky CNOOC Madura Limited terkait kasus persekongkolan tender. Kuasa hukum KPPU Nunil Fadilah mengatakan meskipun pengadilan mengabulkan keberatan terlapor I dan II, pihaknya tidak akan stunt dalam membuktikan adanya persekongkolan.

Sementara itu, kuasa hukum PT COSL Indo dan Husky-CNOOC Madura Limited, Teuku Raja Rajuanda dari kantor hukum Firmansyah and Co. mengatakan sudah dari awal putusan KPPU dinilai sumir.

Hal itu mengingat Majelis Komisi tidak mempertimbangkan fakta-fakta yang dihadirkan oleh saksi terlapor. Tender jasa jack-up drilling rig services for BD itu untuk mendukung pengeboran dan penyelesaian operasi dan Madura BD Structure yang berlokasi di lepas pantai Selat Madura KKS Madura. Estimasi nilai proyek mencapai US$ 34,62 juta. 

Pada 14 Oktober 2016 Majelis Komisi KPPU membacakan putusan yang menyatakan Husky CNOOC (terlapor I) dan PT COSL Indo (terlapor II) melanggar Pasal 22 UU No. 5/199. Kedua terlapor dihukum membayar denda Rp 12,8 miliar dan Rp 11,6 miliar.

Beware Increased Energy Subsidy 2018



The burden of energy subsidy becomes the budget burden again. See, due to rising world crude oil prices, the realization of the budget the energy subsidy of 2017 increases enormously.

The Ministry of Finance noted that until the end of 2017 the realization of energy subsidy budget reached Rp 97.6 trillion, equal to 108.7% of energy subsidy in APBNP 2017 amounting to Rp 89.9 trillion.

The increase in energy subsidy budget last year was like an alarm for this year. It is not impossible that the allocation of energy subsidies in 2018 exceeds the limit as well. Understandably, the government guarantees not to raise the price of fuel oil (BBM) subsidy and electricity tariffs, at least until March 2018. On the other hand, crude oil prices continue to rise.

Yesterday, the price of West Texas Intermediate (WTI) crude oil in the global market was at US $ 60.29 per barrel. Goldman Sachs projection, Brent oil price at the level of US $ 62 per barrel at the end of the first quarter of 2018. Finance Minister Sri Mulyani Indrawati is not worried about the upward trend in oil prices. Indeed, the allocation of energy subsidies increases if oil prices rise. On the other hand, rising oil prices also raised state revenues from oil and gas.

Waspadai Peningkatan Subsidi Energi 2018


Beban subsidi energi menjadi beban anggaran lagi. Lihat saja, akibat kenaikan harga minyak mentah dunia, realisasi anggaran subsidi energi tahun 2017 bertambah sangat besar.

Kementerian Keuangan mencatat, sampai akhir 2017 realisasi anggaran subsidi energi mencapai Rp 97,6 triliun, Nilai tersebut setara 108,7% dari bagian subsidi energi dalam APBNP 2017 yang sebesar Rp 89,9 triliun.

Peningkatan anggaran subsidi energi tahun lalu seperti alarm untuk tahun ini. Bukan mustahil alokasi subsidi energi tahun 2018 melebihi batas juga. Maklum, pemerintah menjamin tidak menaikkan harga bahan bakar minyak (BBM) subsidi maupun tarif listrik, setidaknya sampai Maret 2018. Di sisi lain, harga minyak mentah terus naik.

Kemarin, harga minyak mentah jenis West Texas Intermediate (WTI) di pasar global di posisi US$ 60,29 per barel. Proyeksi Goldman Sachs, harga minyak Brent di level US$ 62 per barel pada akhir kuartal I-2018. Sejumlah indikasi itu jauh di atas asumsi harga minyak Indonesia (ICP) dalam APBN 2018 yang sebesar US$ 48 per barel.

Sebagai perbandingan, per November 2017, dengan harga rata-rata minyak WTI di pasar dunia US$ 56,81 barel, ICP ditetapkan US$ 59,34 per barel. Sementara rata-rata ICP sepanjang tahun lalu diperkirakan US$ 50 per barel, di atas target US$ 45 per barel

Menteri Keuangan Sri Mulyani Indrawati tidak khawatir dengan tren kenaikan harga minyak. Memang, alokasi subsidi energi naik jika harga minyak naik. Tapi di sisi, kenaikan harga minyak juga menaikkan penerimaan negara dari migas. 

"ICP di atas target tidak masalah. Sebab kenaikan beban subsidi lebih kecil dibanding peningkatan penerimaan negara," kata Sri Mulyani.

Dia menambahkan, kenaikan alokasi subsidi energi tahun 2017 disebabkan dua hal. Pertama, perubahan asumsi harga minyak dunia. Kedua, pembayaran kurang bayar tahun lalu atau carry over. 

"Ini untuk Pertamina dan PLN yang katanya mengalami tekanan," jelas Sri Mulyani.

Wakil Ketua Komisi VII Dewan Perwakilan Rakyat Satya Widya Yudha menyarankan, pemerintah sebaiknya mengajukan revisi asumsi ICP dalam rancangan APBN-P 2018. 

"ICP naik, anggaran subsidi juga naik. Pemerintah juga harus bisa menjaga volume penyaluran subsidi energi," kata Satya.

Pertamina Manage Mahakam


The Decrease of Oil and Gas Production Strives 30 Percent Per Year

The management of the Mahakam block in East Kalimantan shifted from Total E&P Indonesie to PT Pertamina as of January 1, 2018. The transfer of large-scale oil and gas blocks poses Pertamina's challenge in managing the expired block of contracts. There are 38 oil and gas blocks in the country that will expire until 2026.

The peak of Mahakam Block gas production reached 2.8 billion standard cubic feet per day (BSCFD) in 2009. The peak oil production was 230,000 barrels per day in 1977. Currently, the remaining reserves of Mahakam Block gas are 4.9 trillion cubic feet ( TCF) and oil reserves of 57 million barrels.

The daily production of natural gas throughout 2017 recorded 1,286 million standard cubic feet per day (MMSCFD) and oil of 51,700 barrels per day.

"Another challenge is how to maintain operating standards that have been applicable before, while still managed Total E&P Indonesia. If possible, the standard should be improved even better, "said Syamsu.

President Director of PT Pertamina Hulu Indonesia, a subsidiary of Pertamina, which manages Mahakam-Bambang Manumayoso, said the investment is set as much as 1.7 billion US dollars or equivalent to Rp 23 trillion for 2018. Not ready

However, according to Assistant II for Economic Affairs and Development of East Kalimantan Province Ichwansyah, Regional Owned Enterprises (BUMD) is not fully prepared. Currently there is still talks between the Government of East Kalimantan Province and the Government of Kutai Kartanegara Regency. So far, the region is already willing to take the 10 per cent participation right.

"There are many challenges (in the formation of BUMD) and we need the support of all parties, including the central government, so that this will be realized soon," said Ichwansyah.

Head of SKK Migas Amien Sunaryadi hopes East Kalimantan Provincial Government and Pemerinath of Kutai Kartanegara Regency to settle the issue of the shares of participation. Because, if the settlement is delayed longer, then the longer the area will get profit sharing from the Mahakam Block. However, this problem certainly will not interfere with the operation of the Mahakam Block.

"We are still waiting for the establishment of BUMD shareholders 10 percent later. There is no time limit when to be formed immediately BUMD. It's just that the regions themselves are losers if not immediately formed because it will delay their acceptance, "said Amien.

Involvement

Meanwhile, Total E&P Indonesia has not yet found an agreement to engage in the management of the Mahakam Block. The government has signaled that Total E&P Indonesia can get 39 percent of management. If the share was taken, Pertamina controls 51 percent shares.

"The talks with Pertamina are still ongoing. Our target before the end of January is no decision, "said President and General Manager of Total E&P Indonesia Arividya Noviyanto.

Regarding the transfer of management, said Arividya, it believes Pertamina can maintain the oil and gas production performance of the Mahakam Block. The block known as the largest gas producer since the early 2000s has an important contribution to gas production in Indonesia. Gas from the Mahakam Block contributes 13 percent of Indonesia's total gas production.

The Mahakam Block cooperation contract was signed on 6 October 1966 for a period of 30 years. TEPI as operator with 65 percent share cooperating with Inpex Corporation (Japan) which owns 35 percent shares. In 1991, Total E&P Indonesia obtained a contract extension for 20 years until March 30, 2017 The Mahakam Contract incurred an additional period of nine months until December 31, 2017 due to a renewal of the liquefied natural gas sales contract.

Laju Penurunan Produksi Migas Diupayakan 30 Persen Per Tahun

Pengelolaan Blok Mahakam di Kalimantan Timur beralih dari Total E&P Indonesie ke PT Pertamina per 1 Januari 2018. Pengalihan blok minyak dan gas bumi skala besar ini menjadi tantangan Pertamina dalam mengelola blok-blok yang habis masa kontraknya. Ada 38 blok minyak dan gas bumi di dalam negeri yang akan habis masa kontraknya hingga 2026.

Penyerahan hak kelola Blok Mahakam dilakukan beberapa saat sebelum detik-detik pergantian tahun 2017 ke 2018 di Balikpapan, Kalimantan Timur. Blok kaya gas bumi tersebut dikelola Total E&P Indonesia (TEPI) sejak 1967 dan habis kontraknya per 31 Desember 2017. 

Blok Mahakam dikembalikan Total E&P Indonesia ke negara Republik Indonesia, dalam hal ini Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas), dan selanjutnya diserahkan kepada Pertamina.

”Pengelolaan blok ini penuh tantangan berupa kondisi lapangan yang kompleks dan usia sumur yang tua sehingga produktivitasnya menurun drastis. Ini menjadi saat yang tepat bagi Pertamina untuk membuktikan bahwa kami mampu mengelola blok besar,” kata Direktur Hulu Pertamina Syamsu Alam, seusai acara penerimaan hak kelola Blok Mahakam dari SKK Migas, Senin (1/1) dini hari, di Balik-
Papan.

Puncak produksi gas Blok Mahakam mencapai 2,8 miliar standar kaki kubik per hari (BSCFD) pada 2009. Adapun puncak produksi minyak sebesar 230.000 barrel per hari pada 1977. Saat ini, sisa cadangan terbukti gas Blok Mahakam sebanyak 4,9 triliun kaki kubik (TCF) dan cadangan minyak 57 juta barrel. 

Adapun produksi harian gas bumi sepanjang 2017 tercatat 1.286 juta standar kaki kubik per hari (MMSCFD) dan minyak sebanyak 51.700 barrel per hari.

”Tantangan lainnya adalah bagaimana mempertahankan standar operasi yang sudah berlaku sebelumnya, saat masih dikelola Total E&P Indonesia. Kalau bisa, standarnya harus ditingkatkan lebih baik lagi,” ujar Syamsu.

Direktur Utama PT Pertamina Hulu Indonesia anak usaha Pertamina yang mengelola Mahakam-Bambang Manumayoso mengatakan, investasi yang disiapkan sebanyak 1,7 miliar dollar AS atau setara Rp 23 triliun untuk 2018. Adapun investasi yang sudah dibelanjakan sepanjang 2017 sebesar 150 juta dollar AS (setara Rp 2 triliun) yang salah satunya untuk pengeboran 15 sumur pengembangan.

”Laju penurunan produksi migas di Blok Mahakam mencapai 51 persen per tahun. Kami akan mengupayakan laju penurunannya menjadi sekitar 30 persen saja dengan metode kerja ulang sumur dan pengeboran sumur pengembangan,” ujar Bambang.

Terkait dengan status karyawan TEPI yang sebelumnya terlibat dalam pengelolaan Blok Mahakam, menurut Bambang, mereka kini menjadi karyawan Pertamina. Total karyawan Total E&P Indonesia saat mengelola Blok Mahakam sebanyak 1.919 orang. Setelah diambil alih Pertamina, jumlah karyawan yang bergabung dan tetap bekerja di blok tersebut sebanyak 1.885 orang atau sekitar 98,23 persen yang berpindah menjadi karyawan Pertamina. 

Belum siap

Berdasarkan Peraturan Menteri ESDM Nomor 37 Tahun 2016, daerah penghasil migas mendapat saham partisipasi sebesar 10 persen. Saham itu diberikan kepada badan usaha milik daerah (BUMD).

Namun, menurut Asisten II Bidang Perekonomian dan Pembangunan Provinsi Kalimantan Timur Ichwansyah, Badan Usaha Milik Daerah (BUMD) belum sepenuhnya siap. Saat ini masih berlangsung pembicaraan antara Pemerintah Provinsi Kalimantan Timur dan Pemerintah Kabupaten Kutai Kartanegara. Sejauh ini, daerah sudah bersedia mengambil hak partisipasi 10 persen tersebut.

”Banyak tantangannya (dalam pembentukan BUMD) dan kami butuh dukungan semua pihak, termasuk pemerintah pusat, agar ini segera terealisasi,” kata Ichwansyah.

Kepala SKK Migas Amien Sunaryadi berharap Pemerintah Provinsi Kalimantan Timur dan Pemerinath Kabupaten Kutai Kartanegara menyelesaikan persoalan saham partisipasi tersebut. Sebab, jika penyelesaiannya semakin lama tertunda, maka semakin lama pula daerah tersebut mendapatkan dana bagi hasil dari Blok Mahakam. Akan tetapi, masalah ini dipastikan tidak akan mengganggu operasi Blok Mahakam.

”Kami tetap menunggu kesiapan dibentuknya BUMD pemegang saham 10 persen nanti. Tidak ada batas waktu kapan harus segera dibentuk BUMD. Hanya saja, daerah sendiri yang merugi kalau tidak segera terbentuk karena akan menunda penerimaan mereka,” kata Amien.

Keterlibatan

Sementara itu, pihak Total E&P Indonesia  juga belum menemukan kesepakatan untuk terlibat dalam pengelolaan Blok Mahakam. Pemerintah sudah memberi sinyal bahwa Total E&P Indonesia  bisa mendapat bagian pengelolaan sebanyak 39 persen. Jika bagian itu diambil, Pertamina menguasai saham 51 persen.

”Pembicaraan dengan Pertamina masih terus berlangsung. Target kami sebelum akhir Januari sudah ada keputusan,” kata President and General Manager Total E&P Indonesia Arividya Noviyanto.

Terkait alih kelola tersebut, kata Arividya, pihaknya percaya Pertamina dapat mempertahankan kinerja produksi migas Blok Mahakam. Blok yang dikenal sebagai penghasil gas terbesar sejak awal 2000-an tersebut memiliki kontribusi penting terhadap produksi gas di Indonesia. Gas dari Blok Mahakam berkontribusi 13 persen dari keseluruhan produksi gas Indonesia.

Kontrak kerja sama Blok Mahakam ditandatangani pada 6 Oktober 1966 untuk jangka 30 tahun. TEPI selaku operator dengan saham 65 persen menggandeng Inpex Corporation (Japan) yang menguasai saham 35 persen. Pada 1991, Total E&P Indonesia  memperoleh perpanjangan kontrak selama 20 tahun hingga 30 Maret 2017 Kontrak Mahakam mengalami tambahan waktu selama sembilan bulan hingga 31 Desember 2017 karena ada perpanjangan kontrak penjualan gas alam cair.

Mahakam Block Finally Managed Pertamina

3. Mahakam Block Potentially Profitable

Based on SKK Migas data as of November 2017, the Mahakam Working Area produces oil and condensate of 52 thousand barrels of oil per day, and 1.360 million cubic feet of natural gas per day. Proses diawali dengan penyerahan pengelolaan Wilayah Kerja Mahakam dari Total E&P Indonesia dan Inpex Jepang kepada pemerintah yang diwakili oleh Kepala SKK Migas Amien Sunaryadi, yang selanjutnya diserahkan ke Pertamina diwakili oleh Direktur Hulu Syamsu Alam.

Berikut ini merupakan fakta-fakta tentang pengambilalihan Blok Mahakam dari Total E & P Indonesia ke PT Pertamina. 

Mulai 1 Januari 2018, Blok Mahakam Resmi Dikelola Pertamina 1 Januari Pertamina Kelola Blok Mahakam, Ladang Migas Terbesar di Indonesia di Blok Mahakam, Wakil Menteri ESDM: Insya Allah, 31 Desember 100% ke Pertamina. 

1. Berubah Nama 

Setelah dikuasai pihak Asing selama 50 Tahun, Blok Mahakam kini berganti nama menjadi Wilayah Kerja (WK) dikelola oleh Pertamina Hulu Mahakam (PHM) yang disebut-sebut sebagai cucu perusahaan Pertamina. Sebelumnya pengelolaan berada di tangan Total E&P Indonesia dan lnpex selama 50 tahun.

2. Peralihan Melalui Beberapa Tahap 

Pihak Pertamina selama masa peralihan telah melakukan berbagai upaya dan koordinasi dengan semua pihak. Mengingat pengelolaan Wilayah Kerja Mahakam sebagai tugas negara yang akan dijalankan sesuai tugas pokok, dan fungsi Pertamina sebagai BUMN

"Pengelolaan dilaksanakan dengan tetap menjaga produksi Wilayah Kerja blok Mahakam yang masa puncak produksi reservoirnya pada periode 2003-2009 telah terlewati. 

PHM mengontrol biaya operasi dan tetap mengedepankan QHSSE (Quality, Health, Safety, Security and Environment) dalam operasionalnya," kata Direktur Hulu Pertamina Syamsu Alam.

Sebelumnya, Pertamina telah berhasil membuktikan pengelolaan blok migas pascaterminasi, yakni Blok Offshore North West lava (ONWJ) pada 2009, dan West Madura Offshore (WMO) pada 2011.

3. Blok Mahakam Berpotensi Menguntungkan 

Berdasarkan data SKK Migas per November 2017, Wilayah Kerja Mahakam berproduksi minyak dan kondensat sebesar 52 ribu barel minyak per hari, dan 1.360 juta kaki kubik gas bumi per hari. Hal itu yang menjadikan Blok Mahakam memiliki potensi yang cukup menjanjikan, dengan bukti per 1 Januari 2018 sebesar 4,9 Tiliun Cubic Feet (TCF) gas, 57 juta barel minyak, serta 45 juta barel kondensat.

Sedangkan, pada Persetujuan Program Kerja dan Anggaran (WP&B) 2018, SKK Migas menargetkan produksi PHM 42,01 ribu barel minyak per hari, dan 916 mmscf gas per hari. Angka tersebut direncanakan tercapai dengan adanya pengeboran sumur pengembangan sebanyak 69 sumur, 132 workover sumur, 5623 perbaikan sumur, serta POFD 5 lapangan migas di Wilayah Kerja Mahakam.
