KPPU's Decision on PGN Bad Predictions for SOEs



The legal team of PT Perusahaan Gas Negara Tbk (PGN) assessed the decision of the panel of judges of the Business Competition Supervisory Commission (KPPU) in the trial of the alleged monopoly of the selling price of natural gas in Medan, North Sumatra. Putusan KPPU atas PGN Preseden Buruk bagi BUMN


Tim kuasa hukum PT Perusahaan Gas Negara Tbk (PGN) menilai putusan majelis hakim Komisi Pengawas Persaingan Usaha (KPPU) dalam persidangan dugaan monopoli harga jual gas bumi di wilayah Medan, Sumatra Utara, sangat keliru. Pasalnya, keterangan para saksi tidak ditampilkan utuh sehingga mengaburkan fakta di lapangan.

“Pendapat para saksi ahli tidak menyeluruh dan hanya sebagian. Jadi banyak pertimbangan putusan majelis yang keliru,” ujar kuasa hukum PGN, Yahdy Salampessy.

Yahdy melanjutkan yang juga jadi sorotan kuasa hukum atas putusan sidang ialah kurangnya kompetensi majelis Hakim dalam memahami skema bisnis hilir gas bumi. Dengan keputusan KPPU itu, tim kuasa hukum PGN akan mempelajari lebih dulu salinan keputusan untuk mengambil langkah hukum selanjutnya.

“Yang jelas putusan ini akan jadi preseden buruk bagi BUMN lainnya dalam melakukan kegiatan usaha.”

Seperti diketahui, polemik tentang tingginya harga gas untuk kalangan industri di Medan muncul beberapa waktu terakhir. Tingginya harga jual akibat banyaknya perusahaan pemilik kuota gas tapi tidak memiliki fasilitas (calo gas).

Di sisi lain, dalam menjalankan bisnis, PGN yang merupakan BUMN di sektor hilir gas bumi nasional memiliki sejumlah landasan hukum dalam membeli, menyalurkan, sekaligus menentukan harga jual gas tadi ke konsumen. Ada dua peraturan yang mengatur itu, yakni Pasal 27 UU No 22 Tahun 2001 tentang Minyak dan Gas Bumi dan Pasal 51 UU Nomor 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha tidak Sehat.

“Sayangnya keputusan majelis tidak menyentuh pokok permasalahan di lapangan dan kami yang disalahkan. Padahal sangat jelas praktik semacam itu (calo gas) dapat dilihat langsung,” kata Yahdy.

CNPC International-Pertamina Hulu Sign Oil and Gas Cooperation



The parent company of PetroChina, CNPC (China National Petroleum Corporation) International, signed a Memorandum of Understanding (MoU) with PT Pertamina in an effort to increase cooperation in oil and gas business development both in Indonesia and abroad.

The MOU was signed by CNPC International President Lyu Gongxun and Senior Vice President of Upstream Business Development of Pertamina Denie Tampubolon in Jakarata.

Premiere Oil-Petrovietnam Agrees on Tuna Block Gas Sales



Premiere Oil agreed to sell gas produced from Tuna Block, North Natuna Sea to Petrovietnam. Both have signed a memorandum of understanding on gas sales on the sidelines of the 2017 Asia-Pacific Economic Cooperation Summit in DaNang, Vietnam.

"The signing of this MOU is expected to provide certainty in the development of gas reserves in Blok K Tuna," said Head of Special Unit for Upstream Oil and Gas Business Activities (SKK Migas) Amien Sunaryadi in his official statement on Tuesday (14/11).

Premier Oil, operator of the Tuna Block in the North Natuna Sea, will develop a Tuna field with a gas drain target in 2023. Premier has a 65% participating interest in Tuna PSC and partners with MOECO (25%) and GS Energy (15%). Gas generated from the Tuna field will be flown to the Nam Con Son Pipeline System in Vietnam through a cross-border pipe being built.

In its official website, Premiere Oil said it is still evaluating the two-field development scenario in the Tuna Block, the Sea Horse and Sea Lion. In 2017, Premiere Oil obtained an extended exploration period in the Tuna Block for three years.

Premiere Oil-Petrovietnam Sepakati Penjualan Gas Blok Tuna


Premiere Oil sepakat menjual gas yang dihasilkan dari Blok Tuna, Laut Natuna Utara ke Petrovietnam. Keduanya telah menandatangani nota kesepahaman penjualan gas ini di sela Konferensi Tingkat Tinggi Kerja Sama Ekonomi Asia Pasifik 2017 di DaNang, Vietnam.

“Penandatanganan MOU ini diharapkan akan memberikan kepastian pengembangan cadangan gas di Blok K Tuna,” kata Kepala Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas) Amien Sunaryadi dalam keterangan resminya, Selasa (14/ 11). 

Premier Oil, sebagai operator Blok Tuna di Laut Natuna Utara, akan mengembangkan lapangan Tuna dengan target pengaliran gas pada 2023. Premier memiliki participating interest sebesar 65% di Tuna PSC dan bermitra dengan MOECO (25%) dan GS Energy (15%). Gas yang dihasilkan dari lapangan Tuna akan dialirkan ke Nam Con Son Pipeline System di Vietnam melalui pipa lintas batas negara yang sedang dibangun.

Dalam laman resminya, Premiere Oil menyatakan masih mengevaluasi skenario pengembangan dua lapangan di Blok Tuna, yakni Kuda Laut dan Singa Laut. Pada 2017, Premiere Oil memperoleh perpanjangan masa eksplorasi di Blok Tuna selama tiga tahun. 

Dengan perpanjangan ini, maka memungkinkan perusahaan migas yang berasal dari Inggris ini untuk melaksanakan pengeboran apprasial dan menyusun konsep pengembangan komersial dari blok ini sebelum memasukkan POD.

Data Kementerian ESDM, cadangan terbukti untuk minyak yang ada di blok tersebut mencapai 2.127 juta barel dan gas sebesar 12,36 miliar kaki kubik. Adapun, luas bloknya mencapai 2.450,29 kilometer persegi. Tidak hanya jual beli gas, disepakati juga kerja sama antara Indonesia dan Vietnam. 

“Kerja sama ini akan diikuti dengan kerja sama untuk mengelola wilayah perbatasan,” ujar Amien.

Pembahasan kerjasama Indonesia dan Vietnam terutama di pemanfaatan gas pada wilayah lintas batas kontinen diinisiasi oleh Direktorat Jenderal Minyak dan Gas Bumi (Ditjen Migas) sejak Maret 2017 lalu. Kemudian dilakukan pertemuan The 7th Indonesia-Vietnam Joint Commission on Economic, Scientific, and Technical Cooperation (JC-ESTC) di Hanoi, Vitenam pada 12 Agustus 2017.

Pada JC-ESTC kemarin kedua pihak akan mendukung dan memfasilitasi perusahaan-perusahaan dari kedua negara dalam mengimplementasikan proyek kerja sama eksplorasi dan eksploitasi migas, mencari peluang kerja sama baru khususnya Proyek Tuna di Laut Natuna, penyediaan jasa teknis migas, dan kerjasama pemanfaatan batubara.

Kerja sama Indonesia-Vietnam di bidang pemanfaatan gas diantaranya akan mencakup studi bersama untuk pemanfaatan dan pembangan infrastruktur gas di perbatasan, studi kelayakan konektivitas pipa gas di masing-masing wilayah perbatasan, dan pengawasan SKK Migas dan Petrovietnam atau perusahaan afiliasinya untuk melakukan pemanfaatan gas di wilayah perbatasan. 

MSP ini tidak akan mengurangi pihak manapun yang berkaitan dengan perbatasan Maritim serta hak dan kewajiban mereka di zona maritim masing-masing sesuai dengan UNCLOS 1982.

Harga GaS Hilir Kini di Tangan Jonan


Setelah menerbitkan Peraturan Menteri Energi dan Sumber Daya Mineral (ESDM) tentang pembatasan margin gas hanya sebesar 7%, kini Kementerian ESDM akan merevisi Peraturan Menteri ESDM Nomor 19/2009 tentang Kegiatan Usaha Gas Bumi Melalui Pipa.

Kepala Badan Pengatur Hilir Minyak dan Gas Bumi (BPH Migas) M. Fanshurullah Asa mengungkapkan, ada dua poin penting dalam perubahan aturan tersebut. Pertama, BPH Migas akan membagi wilayah jaringan distribusi dan menetapkan badan usaha yang memegang
wilayah tersebut. 

Jika di suatu wilayah telah ada badan usaha eksisting, badan usaha itu akan masuk dalam jaringan pipa gas badan usaha pemilik wilayah jaringan distribusi. Menurut dia, BPH Migas akan mengatur badan usaha paling luas atau paling tinggi.

"BPH Migas akan mengatur kawasan, kami memberikan kepada yang paling banyak di sana dari sisi jalur distribusi yang sudah ada tidak dirugikan," jelas Fanshurullah, Selasa (14/11).

Selain poin soal pembagian Wilayah jaringan gas, revisi kedua Peraturan Menteri Nomor 19/2009 akan mengubah aturan tentang dedicated hilir. Menurutnya, dedicated hilir yang membuat harga gas hingga konsumen akhir menjadi mahal.

Dalam Peraturan Presiden Nomor 40/2016 tentang Penetapan Harga Gas Bumi, pemerintah menentukan bukan hanya harga gas di hulu, melainkan sampai hilir. 

"Selama ini dedicated hilir yang menentukan siapa? Ya, badan usaha," jelasnya.

Sebagai gambaran, Peraturan Menteri Nomor 19/2009 Pasal 8 menyebutkan, pada wilayah niaga tertentu dapat dilaksanakan kegiatan usaha niaga gas bumi melalui pipa oleh lebih dari satu badan usaha pemegang izin usaha niaga gas bumi melalui pipa. 

     Sementara Pasal 9 aturan tersebut menyatakan, dalam melaksanakan kegiatan usaha niaga gas bumi melalui pipa, badan usaha sebagaimana dimaksud dalam Pasal 6 wajib menggunakan pipa transmisi dan atau pipa distribusi yang tersedia untuk dapat dimanfaatkan bersama (open access) pada ruas transmisi dan atau vwilayah jaringan distribusi tertentu.

Fanshurullah menjelaskan, kebijakan ini sudah dibahas oleh para pemangku kepentingan baik badan usaha maupun asosiasi yang bergerak di sektor hilir gas. Seperti Pertamina, Perusahaan Gas Negara, SKK Migas dan juga asosiasi salah satunya adalah Asosiasi Penyalur Gas Alam Indonesia (INGTA).

Selanjutnya, pihaknya akan meneken kontrak untuk paket rekayasa, pengadaan dan konstruksi (engineering procurement construction/ EPC) yang melibatkan PT Rekayasa Industri dan Japan Gas Corporation (JGC). Pada 2018, perseroan mulai mengerjakan konstruksi fisik fasilitas pemrosesan gas (gas processing facility/ GPF) beserta pengeboran dua dari total enam sumur yang ditargetkan.

“Next step-nya tanda tangan kontrak EPC. Rekayasa Industri sama JGC,” ujarnya usai penandatanganan pengalihan dokumen dan perjanjian jual beli gas di Kementerian ESDM, Senin (13/11).

Finding the Right Gas Price



Yesterday, Tuesday (14/11), the Commission for the Supervision of Business Competition decided PT Perusahaan Gas NegaraTbk. monopolistic practice by setting the excessive price for industrial gas in North Sumatra.

PGN is considered guilty of violating Article 17 of Law Number 5/1999 on Unfair Business Competition so that it is punished to pay a fine of Rp 9.9 billion. According to the judge, due to PGN's actions the business actors in North Sumatra can not compete with other products because they bear high expenditure costs.

On the other hand, PGN's Legal Counsel judges the verdict related to the alleged monopoly of the selling price of natural gas in the area of ​​Medan, North Sumatra, it is mistaken. For us, the events experienced by PGN in North Sumatra again opened up issues that have not been fully resolved in the current gas trading system.

The problems of infrastructure constraints such as gas pipes and limited gas storage and regasification facilities make the utilization of natural gas for domestic needs is not optimal.

Currently, part of natural gas production in the country is still exported abroad. On the other hand, some industrial users of gas, such as in North Sumatra, still get a relatively high price.

Indeed, the price of gas borne by the industry varies depending on the region, the agreement with the contractor, and the incentives provided by the government. Compare current gas prices in West Java US $ 9.2 per MMBtu, and East Java US $ 8.2 MMBtu.

In North Sumatra in particular, this gas issue is not new at this time just talked about. For industry players in North Sumatra, expensive gas prices make production costs inefficient.

In the province led by Governor Tengku Erry Nuradi, many investors are 'feeling uncomfortable' with the issue of high gas prices, some even have to lay off their labor. The impact is real, some industry players also moved to other areas that cost cheaper production. The impact of gas demand for North Sumatra industry is now down from 25 MMScfd to 10 MMScfd.

However, the issue has not been fully answered. Gas prices are still complained. Indeed, a number of solutions have been given several times, but the problem remains the same. Prices are still expensive.

We know, some time ago, the price of gas in North Sumatra was lowered from US $ 13.86 per MMBtu to US $ 12.22 per MMBtu. However, for business actors, the price is still far from the previous price of US $ 8.7 per MMBtu.

Even Presidential Regulation No. 40/2016 on Natural Gas Price Determination and Regulation of the Minister of Energy and Mineral Resources No. 16/2016 on Pricing and Certain Gas User Practices does not affect the price of gas for industries in North Sumatra.

It is only natural that the North Sumatra and North Sumatra Provincial Gas User Association (Apigas) and the Provincial Government repeatedly sent letters of application for a decline in gas prices since last year.

We also know that the central government is not silent about the gas in North Sumatra. The ESDM Ministry has responded by releasing Ministerial Decree No. 434 K / 12 / MEM / 2017 on February 13, 2017 on Natural Gas Price for Industry in Medan and surrounding areas.

In the regulation, the price of upstream gas is suppressed, ie from PT Pertamina and its affiliates with Pertamina Hulu Energi NSO Block manufacturer, Pertamina EP and from Triangle Pase Inc. producers.

Similarly, the tariff for gas distribution through pipes is also lowered for the Arun-Belawan transmission segment and Milk-Wampu Base. Meanwhile, PGN's distribution cost was reduced to US $ 0.9 per m3 from US $ 1.35 per m3. This decision is in effect since February 1, 2017. However, again the price is still considered expensive. For business actors, they have felt a much cheaper price that can be used for North Sumatra's business actors to be competitive.

In addition, the special price facility of US $ 6 per MMBtu for state-owned steel industry players since January 1, 2017 should also be enjoyed by private actors. In North Sumatra there are five private steel industries with 8,000 workers.

Not to mention if we talk about gas distribution for the sake of electricity supply in Sei Mangkei special economic area. Once again the PGN case in North Sumatra, we hope to be a valuable lesson for this trading system to be re-evaluated by the government.

The complicated issue of the complex natural gas administration in Indonesia needs to be resolved so that abundant local gas supplies can be enjoyed by the user industry at affordable prices and continuous supply.

Of course, we hope that the right gas price in each region in the country can make the producers, distributors and user industries not harmed.

Mencari Harga Gas yang Pas 


Kemarin, Selasa [14/11), Majelis Komisi Pengawas Persaingan Usaha memutuskan PT Perusahaan Gas NegaraTbk. melakukan praktik monopoli dengan menetapkan harga yang berlebihan untuk gas industri di Sumatra Utara.

PGN dianggap bersalah melanggar pasal 17 UU Nomor 5/1999 tentang Persaingan Usaha Tidak Sehat sehingga dihukum membayar denda Rp 9,9 miliar. Menurut hakim, akibat tindakan PGN tersebut para pelaku usaha di Sumatra Utara tidak dapat bersaing dengan produk lain karena menanggung biaya pengeluaran yang tinggi.

Di pihak lain, Kuasa Hukum PGN menilai putusan yang terkait dengan dugaan monopoli harga jual gas bumi di wilayah Medan, Sumatra Utara, itu adalah keliru. Bagi kita, kejadian yang dialami PGN di Sumatra Utara kembali membuka persoalan yang belum sepenuhnya terselesaikan di tata niaga gas saat ini. 

Persoalan keterbatasan infrastruktur seperti pipa gas dan fasilitas penyimpanan dan regasifikasi gas yang terbatas membuat pemanfaatan gas bumi untuk kebutuhan domestik tidak optimal.

Saat ini, sebagian produksi gas bumi di dalam negeri masih diekspor ke luar negeri. Di sisi lain, beberapa industri pengguna gas, seperti di Sumatra Utara, masih mendapatkan harga yang relatif tinggi.

Memang harga gas yang ditanggung oleh industri berbeda-beda tergantung dari wilayah, perjanjian dengan kontraktor, dan insentif yang diberikan oleh pemerintah. Bandingkan saat ini harga gas di Jawa Barat US$ 9,2 per MMBtu, dan Jawa Timur US$ 8,2 MMBtu.

Di Sumatra Utara khususnya, persoalan gas ini bukanlah hal yang baru saat ini saja dibicarakan. Bagi pelaku industri di Sumatra Utara, harga gas yang mahal membuat biaya produksi tidak efisien.

Di provinsi yang dipimpin Gubernur Tengku Erry Nuradi itu, banyak investor yang ‘merasa tidak nyaman’ dengan persoalan harga gas tinggi tersebut, bahkan ada yang harus merumahkan tenaga kerja mereka. Dampaknya pun nyata, beberapa pelaku industri pun pindah ke daerah lain yang biaya produksinya lebih murah. Dampaknya kebutuhan gas untuk industri Sumatra Utara pun kini turun dari 25 MMScfd menjadi 10 MMScfd.

Namun, persoalan belum sepenuhnya terjawab. Harga gas masih dikeluhkan. Memang, sejumlah solusi sudah beberapa kali diberikan, tetapi persoalan masih tetap sama. Harga masih mahal.

Kita tahu, beberapa waktu lalu, harga gas di Sumatra Utara diturunkan yakni dari US$ 13,86 per MMBtu menjadi US$ 12,22 per MMBtu. Namun, bagi pelaku usaha, harga itu masih jauh dari harga sebelumnya US$ 8,7 per MMBtu.

Bahkan Peraturan Presiden Nomor 40/2016 tentang Penetapan Harga Gas Bumi dan Peraturan Menteri ESDM Nomor 16/2016 tentang Tata Cara Penetapan Harga dan Pengguna Gas Bumi Tertentu pun tidak berdampak apa-apa terhadap harga gas untuk industri di Sumatra Utara.

Wajar saja bila Asosiasi Pengguna Gas (Apigas) Sumatra Utara dan Pemerintah Provinsi Sumatra Utara berulang kali mengirimkan surat permohonan penurunan harga gas sejak tahun lalu.

Kita juga mengetahui pemerintah pusat tidak diam saja tentang gas di Sumatra Utara tersebut. Kementerian ESDM telah memberikan respons dengan merilis Keputusan Menteri Nomor 434 K/12/MEM/2017 pada 13 Februari 2017 tentang Harga Gas Bumi untuk Industri di Medan dan sekitarnya.

Dalam regulasi tersebut, harga gas hulu ditekan, yakni dari PT Pertamina dan afiliasinya dengan produsen Pertamina Hulu Energi Blok NSO, Pertamina EP dan dari produsen Triangle Pase Inc.

Begitu pula dengan tarif untuk penyaluran gas melalui pipa juga diturunkan untuk ruas transmisi Arun-Belawan dan Pangkalan Susu-Wampu. Sementara itu, biaya distribusi PGN diturunkan menjadi US$ 0,9 per m3 dari US$ 1,35 per m3. Keputusan ini berlaku mundur sejak 1 Februari 2017. 

      Namun, lagi-lagi harga itu masih dinilai mahal. Bagi pelaku usaha, mereka pernah merasakan harga yang jauh lebih murah yang dapat digunakan agar pelaku usaha industri Sumatra Utara bisa kompetitif.

Selain itu, fasilitas harga khusus US$ 6 per MMBtu bagi BUMN pelaku industri baja sejak 1 Januari 2017 juga seharusnya dapat dinikmati oleh pelaku swasta. Di Sumatra Utara ini saja ada lima industri baja milik swasta yang memiliki 8.000 tenaga kerja.

Belum lagi kalau kita berbicara distribusi gas untuk kepentingan pasokan listrik di kawasan ekonomi khusus Sei Mangkei. Sekali lagi kasus PGN di Sumatra Utara, kita berharap bisa menjadi pelajaran berharga agar tata niaga ini harus selalu dievaluasi kembali oleh pemerintah.

Persoalan tata niaga gas bumi yang rumit di Indonesia perlu segera diselesaikan sehingga pasokan gas lokal yang melimpah bisa dinikmati oleh industri pengguna dengan harga terjangkau dan pasokan yang kontinyu.

Tentunya, kita berharap harga gas yang pas di masing-masing wilayah di Tanah Air bisa membuat produsen, distributor dan industri pengguna tidak dirugikan.

When appropriate to fix Gas Price



The government will immediately fix the natural gas trading system which still has not found a suitable price formula in the downstream sector to be enjoyed by the user industry at affordable prices.

High gas prices are often a dispute between the user industry and the distributor company. The Assembly of the Business Competition Supervisory Commission ruled PT Perusahaan Gas Negara Tbk. monopolistic practice by setting an excessive price for industrial gas in North Sumatra.

PGN is considered to violate Article 17 of Law Number 5/1999 on Unfair Business Competition so that it is punished to pay a fine of Rp 9.9 billion. According to the judge, due to the actions of the issuers with the PGAS stock code, business actors in North Sumatra bear the high cost of expenditure.

The Commission Assembly also recommends to the Minister of Energy and Mineral Resources (ESDM) related to the regulation of national natural gas energy. The ESDM Ministry is requested to harmonize the regulation concerning the price of natural gas through pipes for general users.

The government responded with readiness to regulate the price of natural gas from upstream to downstream so that the price at the consumer level can be more competitive.

Head of Oil and Gas Downstream Regulatory Agency (BPH Migas) Fanshurullah Asa said it was revising the Regulation of the Minister of Energy and Mineral Resources No. 19/2009 on Natural Gas Business Activities through Pipelines. The revised rule will govern the mechanism of pricing of gas to consumers.

"The government not only regulates the selling price of gas at the upstream level but also at the downstream level as well," he said, Tuesday (14/11).

So far, the Government has issued Presidential Regulation No. 40/2016 on Natural Gas Price, so as not to be higher than US $ 6 per MMBtu for seven priority industry sectors namely fertilizer, petrochemical, oleochemical, steel, ceramics, glass, and rubber gloves.

Even for North Sumatra, there has been Ministerial Decree No. 434 K / 12 / MEM / 2017 on February 13, 2017- on Natural Gas Price for Industries in Medan and surrounding areas.

As a result, gas prices in North Sumatra dropped from US $ 13.86 per MMBtu to US $ 12.22 per MMBtu and last became US $ 9.95 per MMBtu. However, for business actors, it is still far from the previous price of US $ 8.7 per MMBtu. For comparison, the current price of gas in West Java is US $ 9.2 per MMBtu, and East Java US $ 8.2 MMBtu.

RENTAL RATES

BPH Migas will also regulate the construction of gas pipelines so that the investments issued by business entities will be more efficient. The arrangement of the gas pipeline project is aimed to make the gas pipeline rental rate cheaper so that the gas price at the consumer level can decrease.

Gas Committee member of BPH Migas Jugi Prajugio said that the possibility of KPPU is a clause in the contract of sale and purchase of gas.

"More towards the content of PJBG [gas purchase agreement]" which is questioned by KPPU, this must be checked again, "he said.

PGAS's Legal Counsel Yahdy Salampessy said the verdict of the judges has not been supported by the expert opinion of a comprehensive expert. Thus, he considered the verdict dropped not reflect the facts on the ground. The Corporate Secretary of PGAS Rachmat Hutama said it would first study the outcome of the decision.

"Obviously we respect that decision. The next step is yet to be decided, "he said Wednesday (15/11).

KPPU's verdict does not seem to have a major impact on the performance of PGAS stocks which at the close of trading on the Indonesia Stock Exchange on Tuesday (14/11) actually rose 3.11% to Rp 1.825 level.

PT Danareksa Securities analyst Lucky Bayu Pumomo said the case of gas prices in North Sumatra is a minor issue and has no impact on PGAS shares.

Meanwhile, Chairman of the Association of Indonesian Entrepreneurs (Apindo) North Sumatra Parlindungan Purba appreciate the decision of the Commission Assembly. Parlindungan Purba who is also the Chairman of Committee II of the Regional Leadership Council of the Republic of Indonesia (DPR RI) is optimistic that the decline in industrial gas prices in North Sumatra can push the wheels of the community economy and industrial productivity, for example in the Special Economic Zone (SEZ) Sei Mangkei.

Secretary General of the Ministry of Industry Haris Munandar said that the current gas supply in North Sumatra has not met the needs of the industry, so it has to take it from other remote areas such as Lampung.

Saat Tepat Membenahi Harga Gas


Pemerintah segera membenahi tata niaga gas bumi yang masih belum menemukan formula harga yang sesuai di sektor hilir agar dapat dinikmati oleh industri pengguna dengan harga terjangkau.

Harga gas yang masih tinggi sering menjadi sengketa antara industri pengguna dengan perusahaan distributor. Majelis Komisi Pengawas Persaingan Usaha memutuskan PT Perusahaan Gas Negara Tbk. melakukan praktik monopoli dengan menetapkan harga yang berlebihan (excessive price) untuk gas industri di Sumatra Utara.

PGN dinilai melanggar pasal 17 Undang-Undang Nomor 5/1999 tentang Persaingan Usaha Tidak Sehat sehingga dihukum membayar denda Rp 9,9 miliar. Menurut hakim, akibat tindakan emiten dengan kode saham PGAS tersebut, para pelaku usaha di Sumatera Utara menanggung biaya pengeluaran yang tinggi.

Majelis Komisi juga memberikan rekomendasi kepada Menteri Energi dan Sumber Daya Mineral (ESDM) terkait dengan pengaturan energi gas bumi nasional. Kementerian ESDM diminta untuk menyelaraskan regulasi menyangkut harga gas bumi melalui pipa untuk pengguna umum.

Pemenintah pun merespons dengan kesiapan untuk mengatur harga gas bumi dari hulu sampai hilir sehingga harga di tingkat konsumen bisa Iebih kompetitif.

Kepala Badan Pengatur Hilir Minyak dan Gas Bumi (BPH Migas) Fanshurullah Asa mengatakan pihaknya sedang merevisi Peraturan Menteri ESDM Nmor 19/2009 tentang Kegiatan Usaha Gas Bumi Melaiui Pipa. Revisi aturan itu akan mengatur tentang mekanisme penetapan harga jual gas kepada konsumen.

“Pemerintah tidak hanya mengatur harga jual gas di tingkat hulu melainkan di tingkat hilir juga,” ujarnya, Selasa (14/11).

Sejauh ini, Pemerintah telah menerbitkan Peraturan Presiden Nomor 40/2016 tentang Harga Gas Bumi, agar tidak lebih tinggi dari US$ 6 per MMBtu untuk tujuh sektor industri prioritas yaitu pupuk, petrokimia, oleokimia, baja, keramik, kaca, dan sarung tangan karet.

Bahkan untuk Sumatera Utara, telah ada Keputusan Menteri Nomor 434 K/12/MEM/2017 pada 13 Februari 2017- tentang Harga Gas Bumi untuk lndustri di Medan dan sekitarnya.

Dampaknya, harga gas di Sumatera Utara sempat turun dari US$ 13,86 per MMBtu menjadi US$ 12,22 per MMBtu dan terakhir menjadi US$ 9,95 per MMBtu. Namun, bagi pelaku usaha, itu masih jauh dari harga sebelumnya US$ 8,7 per MMBtu. Sebagai perbandingan, saat ini harga gas di Jawa Barat US$ 9,2 per MMBtu, dan Jawa Timur US$ 8,2 MMBtu.

TARIF SEWA

BPH Migas juga akan mengatur pembangunan jaringan pipa gas sehingga investasi yang dikeluarkan badan usaha akan lebih efisien. Pengaturan proyek pipa gas itu bertujuan agar tarif sewa pipa gas menjadi lebih murah sehingga harga gas di tingkat konsumen bisa turun.

Anggota Komite Gas BPH Migas Jugi Prajugio mengatakan kemungkinan besar hal yang dipermasalahkan KPPU adalah klausul dalam kontrak jual beli gas.

“Lebih ke arah isi PJBG [perjanjian jual beli gas]" yang disoal oleh KPPU, ini harus dicek kembali,” katanya.

Kuasa Hukum PGAS Yahdy Salampessy mengatakan putusan majelis hakim belum didukung pendapat saksi ahli yang menyeluruh. Dengan demikian, dia menganggap putusan yang dijatuhkan belum mencerminkan fakta di lapangan. Adapun Sekretaris Perusahaan PGAS Rachmat Hutama mengatakan pihaknya akan mempelajari terlebih dahulu hasil keputusan tersebut. 

“Yang jelas kami menghormati keputusan tersebut. Langkah selanjutnya belum diputuskan,” katanya Rabu (15/11).

Vonis KPPU nampaknya tidak berdampak besar terhadap kinerja saham PGAS yang pada penutupan perdagangan di Bursa Efek Indonesia hari Selasa (14/11) justru menguat 3,11% ke level Rp 1.825.

Analis PT Danareksa Sekuritas Lucky Bayu Pumomo mengatakan kasus harga gas di Sumatra Utara menjadi persoalan minor dan tidak memberikan dampak terhadap saham PGAS.

Sementara itu, Ketua Asosiasi Pengusaha Indonesia (Apindo) Sumatera Utara Parlindungan Purba mengapresiasi putusan Majelis KPPU tersebut. Parlindungan Purba yang juga menjadi Ketua Komite II Dewan Pimpinan Daerah Republik Indonesia (DPR RI) optimistis penurunan harga gas industri di Sumatera Utara dapat mendorong putaran roda ekonomi masyarakat dan produktivitas industri, misalnya di Kawasan Ekonomi Khusus (KEK) Sei Mangkei.

Sekretaris Jenderal Kementerian Perindustrian Haris Munandar mengatakan saat ini kondisi pasokan gas di Sumatra Utara belum memenuhi kebutuhan industri sehingga harus mengambil dari daerah lain yang lebih jauh, seperti Lampung.

French Companies Develop Renewable Energy in Aceh



The French company, Akuo Energy, which focuses on renewable energy, will develop wind, water and biomass power plants in several locations in Aceh.

 "We see enormous potential in Aceh, such as wind potential, water and biomass," said Managing Director of Akuo Energy for Indonesia Christophe Moyon with the team of Akuo Energy in its Meeting with Aceh Governor Irwandi Yusuf in Banda Aceh on Monday (13/11).

Christophe said Akuo Energy will conduct a study for the development of wind, water and biomass power plants in Aceh for a year. The development of wind power will be conducted in Krueng Raya and Lhoknga areas and will build as many as 50 turbines generating 100 MW or more.

For biomass will be done in Simeulue by developing Kaliandra which will generate electrical energy about 3 megawatts. The hydroelectric power plant will be built in Central Aceh District with an estimated power of 6 megawatts.

The development of the three projects will be implemented in November after obtaining a license and will take at least one year to study and will be operational by 2021.

"If this works, we hope Aceh becomes an icon for the first renewable energy development in Sumatra and encourages the development of renewable energy throughout Indonesia," Christophe said. "

Governor of Aceh Irwandi Yusuf asked Akuo Energy to immediately arrange permission for the project to be implemented as soon as possible in Aceh. Irwandi also hopes Akuo Energy invites local entrepreneurs and local government to participate in the project.

"I want this project to be implemented, because so far many investors are just presentations, but the project is not implemented and to conduct suryei to other areas in Aceh that have the potential to develop renewable energy," he said.

Perusahaan Perancis Kembangkan Energi Terbarukan di Aceh


Perusahaan Prancis, Akuo Energy yang fokus di bidang energi terbarukan akan mengembangkan pembangkit listrik tenaga angin, air, dan biomass di beberapa lokasi di Aceh. 

 “Kami melihat potensi yang sangat besar di Aceh, seperti potensi angin, air maupun biomass,” kata Managing Director Akuo Energy untuk lndonesia Christophe Moyon bersama tim Akuo Energy dalam Pertemuannya dengan Gubernur Aceh Irwandi Yusuf di Banda Aceh, Senin (13/11). 

Christophe mengatakan Akuo Energy akan melakukan studi untuk pengembangan pembangkit listrik tenaga angin, air, dan biomass di Aceh selama setahun. Pengembangan pembangkit listrik tenaga angin akan dilakukan di kawasan Krueng Raya dan Lhoknga dan akan membangun sebanyak 50 turbin yang menghasilan energi listrik sebesar 100 megawat atau lebih.

     Untuk biomass akan dilakukan di Simeulue dengan mengembangkan Kaliandra yang akan menghasilkan energi listrik sekitar 3 megawat. Untuk pembangkit listrik tenaga air akan dibangun di Kabupaten Aceh Tengah dengan perkiraan energi listrik sebanyak 6 megawatt.

     Pengembangan ketiga proyek tersebut akan dilaksanakan pada November setelah mendapatkan izin dan setidaknya butuh waktu satu tahun untuk studi dan ditargetkan akan beroperasi pada 2021.

“Jika ini berhasil, kami berharap Aceh menjadi ikon untuk pengembangan energi terbarukan yang pertama di Sumatera dan mendorong pengembangan energi terbarukan di seluruh Indonesia,” kata Christophe. “

     Gubernur Aceh Irwandi Yusuf meminta Akuo Energy segera mengurus izin agar proyek tersebut dapat dilaksanakan secepatnya di Aceh. Irwandi juga berharap Akuo Energi mengajak para pengusaha lokal dan pemerintah setempat untuk berpertisipasi dalam proyek tersebut.

“Saya ingin proyek ini dilaksanakan, karena selama ini banyak investor hanya presentasi saja, tapi proyeknya tidak dilaksanakan dan untuk melakukan suryei ke daerah lain di Aceh yang mempunyai potensi pengembangan energi terbarukan,” katanya.
