Two Points RPP Gross Split Agreed



Tax incentives on the scheme of oil and gas sharing contracts for oil and gas (oil) gross splits are immediately issued. The Ministry of Energy and Mineral Resources (ESDM) and the Ministry of Finance (MoF) have agreed on two important points in the Government Regulation (RPP) Regulation related to the gross split tax.

Secretary of the Directorate General of Oil and Gas of the Ministry of Energy and Mineral Resources, Susyanto, said that there are crucial points to be dealt with in the RPP. First about carry forward loss. If in the Income Tax loss carry forward law only for a period of five years, then in this new Gross Split Tax RPP plus the time limit to be 10 years. In the end that according to the Law of Income should only be five years, then this is devoted.

"This will excite oil and gas stakeholders because it can be up to ten years," said Susyanto, last weekend.

The government will provide two times more depreciation and amortization. This amortization issue is not available in Government Regulation No. 27 of 2017 concerning Amendment to Government Regulation Number 79 of 2010 concerning Refundable Operating Costs and the Treatment of Income Taxes in Upstream Oil and Gas Business Fields. According to Susyanto, in PP 27 year 2017 it is a cost that can be used to reduce taxable income.

"In addition to up to ten years, it is also amortized twice, so this is an exciting thing," said Susyanto.

After the exploitation period, the amortization will still follow the rules of Government Regulation number 27 of 2017. In the attachment to the rule, there is provision on acceleration of certain assets.

Secondly, regarding the tax facilities. In the exploitation period, based on Government Regulation No. 27 of 2017 can be given the government based on the economy, then in this Gross Split Tax RPP can be replaced directly by the government by providing additional split for the contractor.

Susyanto expects, RPP Tax Gross Split is expected to be published before the deadline of oil and gas work auction area ended. According to him, Finance Minister Sri Mulyani has sent a letter to the President for approval.

"Meanwhile, the Minister of Energy and Mineral Resources has also sent in order to be accelerated, so before November 27 it is expected that this Government Regulation will be issued," said Susyanto.

Dua Poin RPP Gross Split Disepakati


Insentif perpajakan skema kontrak bagi hasil minyak dan gas bumi (migas) gross split segera dikeluarkan. Kementerian Energi dan Sumber Daya Mineral (ESDM) dan Kementerian Keuangan (Kemkeu) telah menyepakati dua poin penting dalam Rancangan Peraturan Pemerintah (RPP) terkait pajak gross split tersebut.

Sekretaris Direktorat Jenderal Minyak dan Gas Bumi Kementerian ESDM Susyanto mengatakan, ada poin-poin krusial yang menjadi kesepakatan dalam RPP tersebut. Pertama mengenai loss carry forward. Jika dalam Undang-Undang Pajak Penghasilan loss carry forward hanya untuk masa lima tahun, maka dalam RPP Pajak Gross Split yang baru ini ditambah batas waktunya hingga menjadi 10 tahun. Pada akhirnya yang sesuai Undang-Undang PPh mestinya hanya lima tahun, maka ini dikhususkan. 

"Ini akan menggembirakan stakeholder migas karena bisa sampai paling lama sepuluh tahun," kata Susyanto, akhir pekan lalu.  

Pemerintah akan memberikan depresiasi dan amortisasi hingga dua kali lebih banyak. Soal amortisasi ini tidak ada dalam Peraturan Pemerintah Nomor 27 tahun 2017 tentang Perubahan Atas Peraturan Pemerintah Nomor 79 Tahun 2010 tentang Biaya Operasi Yang Dapat Dikembalikan dan Perlakuan Pajak Penghasilan di Bidang Usaha Hulu Minyak dan Gas Bumi. Menurut Susyanto, dalam PP 27 tahun 2017 itu merupakan biaya yang bisa dipakai untuk mengurang pendapatan kena pajak. 

"Selain bisa sampai sepuluh tahun, maka juga diamortisasi dua kali lipat. Jadi ini suatu hal yang menggembirakan," ungkap Susyanto.

Setelah masa eksploitasi, maka amortisasi akan tetap mengikuti aturan Peraturan Pemerintahnomor 27 tahun 2017. Dalam lampiran aturan tersebut tertera ketentuan mengenai percepatan mengenai aset tertentu.

Kedua, mengenai fasilitas perpajakan. Di masa eksploitasi, berdasarkan Peraturan Pemerintah Nomor 27 tahun 2017 dapat diberikan pemerintah berdasarkan keekonomian, maka dalam RPP pajak gross split ini bisa digantikan langsung oleh pemerintah dengan memberikan tambahan bagi hasil (split) bagi kontraktor.

Susyanto mengharapkan, RPP Pajak Gross Split ini diharapkan bisa terbit sebelum batas Waktu lelang wilayah kerja migas berakhir. Menurut dia, Menteri Keuangan Sri Mulyani sudah mengirimkan surat ke Presiden untuk meminta persetujuan.

“Sedangkan Menteri ESDM juga sudah mengirimkan agar dapat dipercepat, sehingga sebelum tanggal 27 November diharapkan Peraturan Pemerintah ini sudah terbit," ujar Susyanto.
