Welcoming the New Institute of Oil and Gas Sector



Beginning April 2017, the House of Representatives Commission VII submit the results of the discussion of the draft amendment of the Bill of Law no. 22/2001 on Oil and Natural Gas to Legislation Body (Baleg).

The discussion was finally completed in Commission VII although the completion of the process should be completed last year. The Constitutional Court has decided that the Oil and Gas Law is not revoked, but revised several articles, namely Article 12 concerning the granting of authority to business entities and permanent establishments to conduct oil and gas exploration and exploitation.

In addition, Article 22 on the obligation to deliver 25% of the production proceeds to meet domestic demand and Article 28 on the pricing of fuel oil. Then, the form of regulatory body, manager, also the position of government in oil and gas sector is strengthened in the revision of Oil and Gas Law.

The most interesting thing and the draft of Oil and Gas Draft Law submitted by Commission VII to Baleg, there are 98 articles with additional chapters such as upstream business activities, downstream oil and gas business activities, oil and gas reserves, as well as a new chapter governing oil and gas business entities (BUK). 

    In the transitional and closing provisions it is mentioned that SKK Migas will continue to perform its functions and duties until the establishment of BUK Migas, while BPH Migas declared dissolved after this new beleid came into effect.

BUK Migas will become an extension of the government's hand managing upstream to downstream oil and gas business. From the organizational side, BUK Migas will obtain the right to exploit and obtain economic benefits to all proven reserves of oil and gas and business from upstream to downstream sectors. 

    In the BUK body, as mentioned in Article 43, five units will be formed, namely the upstream operational upstream unit, the upstream unit of cooperation, the downstream unit of cooperation, the downstream petroleum business unit and the downstream gas business unit.

Meanwhile, in the upstream independent operational business unit, BUK will be tasked with carrying out exploration and / or exploitation activities of new working areas, exploiting the expired working area of ​​the contract, managing and selling the products of the state and its own parts.

     In addition, the upstream operational business units can make purchases from outside as well as domestically to maintain the availability of reserves and meet the needs of the country.

In the meantime, in the upstream unit of cooperation, BUK will contract with the cooperation contractor (KKKS), supervise upstream operations, coordinate with local government to smooth operation, monitor the development of oil and gas production which has been done by SKK Migas. Then, through this unit, BUK should record and store data and information on the potential and proven reserves of oil and gas.

For the downstream units of cooperation, BUK will cooperate to develop oil and gas infrastructure, to cooperate in efforts to inspect, transport, transmission and / or oil and gas distribution. In the downstream oil and gas downstream business unit, BUK is in charge of downstream oil and gas business activities such as the business of PT Pertamina.

Meanwhile, BUK is directly under and responsible to the president not to the Minister of State-Owned Enterprises (SOEs). Based on the functions and duties as stipulated in Article 45, BUK is tasked with reviewing and submitting the first field development plan to be produced to the Minister of EMR.

Menyambut Lembaga Baru Sektor Migas


Awal April 2017, Komisi VII DPR menyerahkan hasil pembahasan naskah perubahan Rancangan Undang-Undang No. 22/2001 tentang Minyak dan Gas Bumi kepada Badan Legislasi (Baleg).

Pembahasan akhirnya selesai di Komisi VII meskipun seharusnya penyelesaian proses selesai pada tahun lalu. Mahkamah Konsitusi telah memutuskan agar UU Migas tersebut tidak dicabut, melainkan direvisi beberapa pasal yakni Pasal 12 tentang pemberian wewenang kepada badan usaha dan bentuk usaha tetap untuk melakukan eksplorasi dan eksploitasi migas. 

Selain itu, Pasal 22 tentang kewajiban penyerahan hasil produksi paling banyak 25% untuk memenuhi kebutuhan dalam negeri dan Pasal 28 tentang penetapan harga bahan bakar minyak. Lalu, bentuk badan pengawas, pengelola, juga kedudukan pemerintah di Sektor migas diperkuat dalam revisi UU Migas.

Hal yang paling menarik dan naskah RUU Migas yang disampaikan Komisi VII kepada Baleg, terdapat 98 pasal dengan tambahan bab seperti kegiatan usaha hulu, kegiatan usaha hilir minyak dan gas, cadangan migas, juga bab baru yang mengatur tentang badan usaha khusus (BUK) migas. 

     Pada ketentuan peralihan dan penutup disebutkan bahwa SKK Migas akan tetap melaksanakan fungsi dan tugasnya sampai terbentuknya BUK Migas, sedangkan BPH Migas dinyatakan bubar setelah beleid baru ini mulai berlaku.

BUK Migas akan menjadi perpanjangan tangan pemerintah yang mengelola usaha hulu hingga hilir migas. Dari sisi organisasi, BUK Migas nantinya akan memperoleh hak untuk pengusahaan dan memperoleh manfaat ekonomi terhadap semua cadangan terbukti migas dan pengusahaan dari Sektor hulu hingga hilir. 

    Di tubuh BUK, seperti disebutkan pada Pasal 43, akan dibentuk lima unit yakni unit hulu operasional mandiri, unit hulu kerja sama, unit hilir kerja sama, unit usaha hilir minyak bumi dan unit usaha hilir gas.

Adapun, pada unit usaha hulu operasional mandiri, BUK akan bertugas melaksanakan kegiatan eksplorasi dan/ atau eksploitasi wilayah kerja baru, mengusahakan wilayah kerja yang habis masa kontraknya, mengelola dan menjual hasil produksi bagian negara dan bagian sendiri. 

    Selain itu, unit usaha hulu operasional bisa melakukan pembelian dari luar juga dalam negeri untuk menjaga ketersediaan cadangan dan memenuhi kebutuhan Tanah Air.

Sementara itu, pada unit hulu kerja sama, BUK nantinya yang akan berkontrak dengan kontraktor kontrak kerja sama (KKKS), mengawasi kegiatan operasional hulu, berkoordinasi dengan Pemerintah Daerah untuk kelancaran operasi, memonitor perkembangan produksi migas yang selama ini dilakukan SKK Migas. Lalu, melalui unit ini, BUK harus mencatat dan menyimpan data dan infonnasi tentang potensi dan cadangan terbukti migas.

Untuk unit hilir kerja sama, BUK nantinya akan melakukan kerja sama untuk membangun infrastruktur migas, melakukan kerja sama usaha pengoIahan, pengangkutan, transmisi dan/ atau distribusi migas. Pada unit usaha hilir minyak dan hilir gas, BUK bertugas pada kegiatan pengusahaan hilir minyak dan gas bumi seperti bisnis yang dijalani PT Pertamina.

Adapun, BUK berkedudukan langsung di bawah dan bertanggung jawab kepada presiden bukan kepada Menteri Badan Usaha Milik Negara (BUMN). Berdasarkan fungsi dan tugasnya seperti yang diatur dalam Pasal 45, BUK bertugas mengkaji dan menyampaikan rencana pengembangan lapangan yang pertama kali akan diproduksi kepada Menteri ESDM.
