Biaya Pascaoperasi Ditanggung Kontraktor
Kontraktor kontrak kerja sama akan menanggung seluruh biaya kewajiban pascaoperasi atau abandonment and site restoration dalam kontrak bagi hasil kotor atau gross split. Pada kontrak bagi hasil produksi (production sharing contract/PSC) yang masih menerapkan pengembalian biaya operasi (Cost recovery), kontraktor bisa mendapatkan pengembalian biaya ASR bila disisihkan dan disetorkan ke rekening bersama Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas).
Sementara itu, ketika kontrak yang digunakan berubah menjadi kontrak bagi hasil kotor, tidak ada lagi perhitungan pengembalian biaya operasi karena pembagian hasil produksi dilakukan secara kotor.
Direktur Pembinaan Usaha Hulu Minyak dan Gas Bumi Kementerian Energi dan Sumber Daya Mineral (ESDM) Tunggal mengatakan bahwa kewajiban untuk melakukan pemulihan lingkungan dan pembongkaran fasilitas dan sarana secara permanen harus dilakukan seluruh kontraktor bila wilayah kerja yang dikelola habis masa kontraknya.
Kendati pada beberapa kontrak kerja sama lama yang diteken sebelum tahun 1990-an belum diatur tentang kewajiban pasca tambang. Dia menilai, kontrak baru yang nanti diteken akan mengakomodasi kewajiban tersebut pada syarat dan ketentuan (term and Condition) kontrak. "Nanti di term of condition kontrak yang baru, itu diwajibkan menanggung biaya ASR," ujarnya, Selasa (30/5).
Ketentuan untuk menambahkan klausul baru tentang ASR nantinya akan diatur dalam beleid baru berupa peraturan menteri. Menurutnya tanggung jawab penyisihan dana ASR akan diwajibkan pada wilayah kerja baru, terminasi maupun alih kelola.
Masalah keekonomian pengembangan lapangan karena pembebanan dana ASR di wilayah kerja terminasi maupun alih kelola, menurut Tunggal, bisa diselesaikan dengan membuat perhitungan dan mengajukan kompensasi kepada pemerintah. Pada konteks Wilayah kerja terminasi yang ditugaskan kepada PT Pertamina perseroan itu dapat langsung menikmati produksi sehingga peluang penurunan keekonomian lapangan akibat beban ASR masih bisa tertutupi.
Wilayah kerja baru, menurutnya, justru lebih berat karena pada wilayah kerja tersebut masih harus dilakukan kegiatan eksplorasi terlebih dahulu sebelum akhirnya bisa menghasilkan minyak dan gas. Selain itu, kontraktor pun harus menyisihkan dana segar untuk bonus tanda tangan kepada pemerintah.
Beban ASR pada delapan wilayah kerja yang ditugaskan kepada Pertamina menjadi salah satu alasan mengapa perseroan meminta perpanjangan waktu untuk melakukan evaluasi.
Direktur Hulu Pertamina Syamsu Alam mengatakan, penyisihan dana ASR merupakan kewajiban kontraktor. Adapun, komponen ASR akan memengaruhi keekonomian lapangan karena nilainya yang cukup besar. Selain itu, pada kontrak baru tidak terdapat pengembalian biaya operasi sehingga seluruh biaya operasi ditanggung sepenuhnya oleh kontraktor kontrak kerja sama.
Wilayah kerja yang nantinya dikelola Pertamina dengan kontrak gloss split yakni Blok Tuban, Jawa Timur (JOB Pertamina-PetroChina East Java); Blok Ogan Komering, Sumatra Selatan (JOB Pertamina-Talisman); Blok Sanga-Sanga, Kalimantan Timur (VICO); dan Blok Southeast Sumatera (SES), lampung (CNOOC SES Limited).
