Down Permit, BUMD Bojonegoro Build Oil Refinery

The Government through the Ministry of Energy and Mineral Resources (ESDM) granted permission to PT Bojonegoro Bangun Sarana (BBS), BUMD of the Government of Bojonegoro Regency, to build an oil refinery by utilizing the oil production of Cepu Block. According to the explanation of the Director of PT BBS Bojonegoro, Toni Ade Irawan, a permit for the construction of a temporary oil refinery from the Ministry of Energy and Mineral Resources was obtained last week. Chairman of Commission B Bojonegoro DPRD Sigit Kusharjanto welcomed the decrease of oil refinery development permit from the Ministry of ESDM. "Commission B will oversee the construction of an oil refinery," he explained.

Head of Public Relations HCML Surabaya, Hamim Tohari, said the three fields are located about 200 kilometers east of Surabaya or 75 kilometers southeast of Madura. The MDA and MBH fields are expected to begin production by 2019.

According to him, the two fields are currently entering the installation stage of the platform using Hilong vessel which is expected to be completed until 2018. The production capacity of both fields is estimated to reach 170 million million standard cubic feet per day (MMSCFD).

Izin Turun, BUMD Bojonegoro Bangun Kilang Minyak

Pemerintah melalui Kementerian Energi Sumber Daya Mineral (ESDM) memberikan izin kepada PT Bojonegoro Bangun Sarana (BBS), BUMD Pemerintah Kabupaten Bojonegoro, membangun kilang minyak dengan memanfaatkan produksi minyak Blok Cepu.  Nantinya, kilang minyak itu berkapasitas pengolahan 10 ribu barel per hari.

Menurut penjelasan Direktur PT BBS Bojonegoro, Toni Ade Irawan, izin pembangunan kilang minyak sementara dari Kementerian ESDM sudah diperoleh pada pekan lalu. Ia lantas mengibaratkan proses izin pembangunan kilang minyak mirip telur dan ayam yang tidak jelas dari mana awalnya.

“Ketika mengajukan perizinan kepada Kementerian ESDM terkait pembangunan kilang minyak, harus ada kejelasan alokasi minyak yang akan diolah,” katanya, Senin (19/6).

Sebaliknya saat mengajukan permohonan permintaan alokasi minyak mentah (crude oil) kepada Kementerian ESDM diminta harus memiliki izin pembangunan kilang minyak. “Proses mengurus izin berjalan tiga tahun tanpa ada kejelasan hingga akhirnya izin bisa turun setelah BBS menyampaikan terkait pasokan minyak mentah,” ujarnya.

Menurut dia, Kementerian ESDM mensyaratkan BBS harus mampu mengerjakan pembangunan kilang minyak dalam kurun waktu dua tahun setelah izin turun. Dalam membangun kilang minyak itu dilakukan bekerja sama dengan PT Tierra Energi Perkasa Jakarta.

“Kami optimistis bisa menyelesaikan pembangunan kilang minyak dalam kurun waktu dua tahun,” kata Direktur PT Tierra Energi Perkasa Jakarta Edwargo Setjadiningrat, menambahkan.

Ketua Komisi B DPRD Bojonegoro Sigit Kusharjanto menyambut baik turunnya izin pembangunan kilang minyak dari Kementerian ESDM. “Komisi B akan mengawal pembangunan kilang minyak,” jelasnya.

Yang jelas, menurut dia, adanya pembangunan kilang minyak di daerahnya itu akan menciptakan lapangan kerja juga membawa dampak berkembangnya perekonomian masyarakat. “Berbagai kegiatan ekonomi masyarakat akan tumbuh dengan keberadaan kilang minyak,” katanya.

Terpisah, perusahaan minyak dan gas bumi PT Husky-CNOOC Madura Limited (HCML) akan mengembangkan tiga lapangan tambang gas bumi di Madura. Ketiga lapangan yang dikembangkan perusahaan Kontraktor Kontrak Kerja Sama (KKKS) dengan SKK Migas tersebut masing-masing diberi nama MDA, MBH, dan MDK.

Kepala Humas HCML Surabaya, Hamim Tohari, mengatakan ketiga lapangan tersebut berada sekitar 200 kilometer sebelah timur Surabaya atau 75 kilometer sebelah tenggara Madura. Lapangan MDA dan MBH diperkirakan mulai produksi pada 2019.

Menurutnya, kedua lapangan saat ini memasuki tahapan pemasangan platform menggunakan kapal Hilong yang diperkirakan pengerjaannya sampai 2018. Kapasitas produksi kedua lapangan diperkirakan mencapai 170 juta million standard cubic feet per day (MMSCFD).

July, BD Field Starts Production

The cooperation contract contractor (KKKS) of Husky-CNOOC Madura Limited (HCML) started producing gas from the BD field in July. In the first phase, new production reached 30 percent of the capacity of 110 million cubic feet per day (mmscfd).

HCML Senior Head of Relations Hamim Tohari states, 20-30 mmscfd of initial gas production will be channeled to PGN. "In addition to PGN, in accordance with the contract, gas from BD field will be channeled to PT Ind Alasindo Energy and PT Parna Raya with 40 mmscfd each," he said yesterday (18/6).

The field that is part of the Madura Strait Block is located at 16 kilometers south of Madura or 65 km east of Surabaya. Until now, the field in the area of ​​Mandangin Islands is in commissioning stage. The field is expected to generate 442 billion cubic feet of natural gas and 18.7 million barrel (mmbbl) of condensate for 13 years.

In the BD field development, HCML uses offshore PT PAL production platforms. The offshore platform has been installed in a 55 meter sea depth. The offshore rig construction project was acquired by PT PAL after winning a special tender for offshore engineering procurement construction and installation (EPCI) Madura BD project.

In addition to the BD field, HCML is exploring the MDA and MBH fields. The field is east of Surabaya or 75 km southeast of Madura. The planned gas production for the two fields is 170 mmscfd. "Currently we are building a platform construction using Hilong ships that will be completed until 2018," said Hamim.

Gas from the field is planned to be absorbed by the fertilizer industry, power plants, and manufacturing industries that require gas in East Java.

Juli, Lapangan BD Mulai Produksi

Kontraktor kontrak kerja sama (KKKS) Husky-CNOOC Madura Limited (HCML) mulai memproduksi gas dari lapangan BD pada Juli mendatang. Pada tahap pertama, produksi baru mencapai 30 persen dari kapasitas 110 juta kaki kubik per hari (mmscfd).

Senior Head of Relations HCML Hamim Tohari menyatakan, 20-30 mmscfd gas hasil produksi awal akan disalurkan ke PGN. "Selain ke PGN, sesuai dengan kontrak, gas dari lapangan BD akan disalurkan ke PT lnti Alasindo Energy dan PT Parna Raya dengan masing-masing 40 mmscfd,” ujarnya kemarin (18/6).

Lapangan yang menjadi bagian dari Blok Madura Strait itu terletak di 16 kilometer sebelah selatan Madura atau 65 km sebelah timur Surabaya. Hingga kini, lapangan di areal Kepulauan Mandangin tersebut berada dalam tahap commissioning. Lapangan itu diharapkan mampu menghasilkan 442 miliar kaki kubik gas bumi dan 18,7 juta barel (mmbbl) kondensat selama 13 tahun.

Dalam pengembangan lapangan BD, HCML mengguanakan anjungan lepas pantai produksi PT PAL. Anjungan lepas pantai tersebut telah terpasang di kedalaman laut 55 meter. Proyek pembangunan anjungan lepas pantai itu diperoleh PT PAL setelah memenangi tender khusus proyek lepas pantai engineering procurement construction and installation (EPCI) Madura BD.

Selain lapangan BD, HCML sedang mengeksplorasi lapangan MDA dan MBH. Lapangan tersebut berada di sebelah timur Surabaya atau 75 km sebelah tenggara Madura. Produksi gas yang direncanakan untuk dua lapangan itu mencapai 170 mmscfd. ”Saat ini kami membangun konstruksi platform dengan memakai kapal Hilong yang akan selesai hingga 2018,” kata Hamim.

Gas dari lapangan tersebut direncanakan mampu diserap industri pupuk, pembangkit listrik, maupun industri manufaktur yang membutuhkan gas di Jawa Timur.

HCML Exploration, MDA-MBH Field Socialization

Oil and gas exploration in East Java continues. One of them is by the Cooperation Contract Contractor (KKKS) of Husky CNOOC Madura Limited (HCML) in Madura region. The Company is busy conducting further socialization of the MDA-MBH field development that will be exploited soon in Sumenep.

Eksplorasi migas di Jawa Timur terus dilakukan. Salah satunya oleh Kontraktor Kontrak Kerja Sama (KKKS) Husky CNOOC Madura Limited (HCML) di wilayah Madura. Perseroan sedang sibuk melakukan sosialisasi lanjutan pengembangan Lapangan MDA-MBH yang akan segera dieksploitasi di Sumenep.

Head of Relations HCML Surabaya, Hamim Tohari mengatakan untuk eksploitasi migasnya selalu menggunakan komponen lokal. Tidak benar bahwa industri migas terutama yang dilakukannya tidak sepenuhnya dikuasai asing.

“Operasional di lapangan nantinya sepenuhnya menggunakan platform dalam negeri, kami misalnya menggunakan produk PT PAL,” ujarnya di Surabaya.

Hamim mengakui, harga minyak saat ini kurang bagus, namun gas masih prospektif. Dan seluruh produksi gas HCML untuk memenuhi kebutuhan dalam negeri.

“Untuk gas tidak ada yang di ekspor. Nantinya ada saluran pipa ke Pasuruan mengalirkan gas produksi HCML untuk pabrik yang ada di Pasuruan dan sekitarnya,” tegasnya. 

Rencananya, tiga lapangan dikembangkan, MDA, MBH dan MDK. Kali ini fokus lapangan MDA dan MBH. Lapangan itu berada di 75 km tenggara Madura. Kegiatan HCML saat ini adalah pembangunan konstruksi platform menggunakan kapal Hilong.

Setelah beroperasi, HCML berjanji berpartisipasi langsung program pengembangan pemberdayaan masyarakat sesuai kebutuhan sekitar operasi. HCML juga meminta dukungan dari segenap pemangku kepentingan untuk mendukung kegiatan operasi hulu migasnya.

Sejumlah kegiatan yang mereka lakukan untuk membantu masyarakat setempat sudah dilakukan. Diantaranya bantuan ambulans Pusat Kesehatan Masyarakat, pemberdayaan petani rumput laut dan nelayan, serta peningkatan sarana pendidikan dan keagamaan di daerah terdampak. 

     Hasil produksi gas dari lapangan MDA-MBH milik HCML itu sendiri nantinya akan digunakan untuk memenuhi kebutuhan pabrik pupuk, pembangkit listrik. Produk mereka juga akan disalurkan ke berbagai industri yang berada di wilayah Jawa Timur.

Ini menjadi tantangan bagi kami, meskipun demikian kegiatan sosial ke masyarakat Sumenep sudah kami lakukan," kata Head of Relations HCML Surabaya, Hamim Tohari, Minggu (18/6).

Hamim menambahkan, sosialisasi tersebut dihadiri beberapa instansi terkait di antaranya Komando Daerah Militer V/Brawijaya, Pangkalan Utama TNI Angkatan Laut V/Surabaya, Dinas Perhubungan Jawa Timur, Dinas Komunikasi dan Informasi Jawa Timur, Pemerintah Daerah Sumenep, Badan Lingkungan Hidup Sumenep, Dinas Perhubungan Sumenep, Biro Sumber Daya Alam Sumenep dan beberapa kelompok masyarakat dari Sumenep.

Next Year, Gas Production Can Rise 7%

Ministry of Energy and Mineral Resources (ESDM) targets, next year gas (lifting) production will rise while the oil lifting will stagnate. That picture is emblazoned in the State Budget (APBN) 2018.

In budget beleid next year, the government targets gas lifting of 1.19 million-1.23 million barrels of oil equivalent per day (boepd). The amount is up 4% -7% from the assumption of 2017 which amounted to 1.15 million boepd.

Minister of Energy and Mineral Resources, Ignasius Jonan explains, gas production from Cricket Field starting production in late May 2017 will support the increase of lifting gas next year. "The production of Cricket Field operated by Eni is at least 450 mmscfd, so the assumption is changed to 1.19 million-1.23 million boepd," said Jonan in a meeting with Commission VII DPR on Tuesday (13/6) night.

In addition to the Cricket Field, the Special Unit for Upstream Oil and Gas Business Activities (SKK Migas) recorded additional gas production from Wasambo Field in the second quarter of 2018 of 70 mmscfd. There is also gas production from CNY Field and Husky CNOOC Madura Limited's (HCML) MMD program that can support around 175 mmscfd.

Jonan added that oil production is projected at 771,000-815,000 barrels per day (bpd). The amount is relatively stagnant or equal to the assumption of oil production APBN 2017.

With these figures, the projected oil and gas production (oil and gas) to be included in the 2018 budget rules amounts to 1.96 million-2.05 million boepd. The projection is not much different from the assumption of oil and gas lifting in this year's state budget of 1.96 million boepd.

Director General of Oil and Gas, IGN Wiratmaja Puja, added that next year's petroleum production tends to stagnate as there is no additional large-scale production from the new field. "Currently, there is no new discovery of Banyu Urip Field in Cepu Block," said Wiratmaja.

Kementerian Energi dan Sumber Daya Mineral (ESDM) menargetkan, tahun depan produksi (lifting) gas akan naik sedangkan liftng minyak akan stagnan. Itulah gambaran yang terpampang dalam Rancangan Anggaran Pendapatan dan Belanja Negara (APBN) 2018.

Dalam beleid anggaran tahun depan, pemerintah menargetkan lifting gas sebesar 1,19 juta-1,23 juta barel setara minyak per hari (boepd). Jumlah tersebut naik 4%-7% dari asumsi tahun 2017 yang sebesar 1,15 juta boepd.

Menteri ESDM, Ignasius Jonan menjelaskan, produksi gas dari Lapangan Jangkrik yang mulai berproduksi akhir Mei 2017 akan menopang kenaikan lifting gas tahun depan. "Produksi Lapangan Jangkrik yang dioperasikan Eni minimal 450 mmscfd sehingga asumsinya berubah menjadi 1,19 juta-1,23 juta boepd," kata Jonan dalam rapat dengan Komisi VII DPR, Selasa (13/6) malam.

Selain dari Lapangan Jangkrik, Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas) mencatat tambahan produksi gas dari Lapangan Wasambo pada kuartal II-2018 sebesar 70 mmscfd. Ada juga produksi gas dari Lapangan MDH dan MBA milik Husky CNOOC Madura Limited (HCML) yang bisa menyokong sekitar 175 mmscfd.

Jonan menambahkan, produksi minyak diproyeksikan sebesar 771.000-815.000 barel per hari (bph). Jumlah tersebut relatif stagnan atau sama dengan asumsi produksi minyak APBN 2017.

Dengan gambaran tersebut, proyeksi produksi minyak dan gas bumi (migas) yang akan dimasukkan dalam aturan anggaran 2018 sebesar 1,96 juta-2,05 juta boepd. Proyeksi tersebut tidak berbeda jauh dengan asumsi lifting migas dalam anggaran negara tahun ini yang sebesar 1,96 juta boepd.

Direktur Jenderal Minyak dan Gas Bumi, IGN Wiratmaja Puja menambahkan, produksi minyak bumi tahun depan cenderung stagnan karena belum ada tambahan produksi berskala besar dari lapangan baru. "Saat, ini belum ada discovery baru sebesar Lapangan Banyu Urip di Blok Cepu," kata Wiratmaja.

HCML Develops Two Oil and Gas Wells on Raas Island and Sepudi 1

" Mohon doa dan dukungan, Insya Allah, selain berharap di tahun 2019, Husky Cnooc Madura Limited (HCML) sudah bisa eksploitasi juga kami berencana membuka dua sumur migas lagi yang diterima dari lapangan MDA-MDH," kata Ali Aliyudin, Koordinator Community Developmen HCML, dalam acara buka bersama dgn media di Sumenep, Jumat malam [9/6).

Dikatakan Ali, program pengembangan dua sumur di perairan Pulau Sepudi dan Raas itu juga sama dengan kegiatan pengembangan migas di tempat lain, Yakni didahului dengan mendatangkan kapal pengangkut jacket atau rangka baja yang akan ditanam di dasar laut sebagai fondasi anjungan. " Saat ini jacket atau rangka baja tersebut masih akan didatangkan dari Cilegon," kata Ali.

Setelah anjungan selesai dibangun, maka akan dilanjutkan dengan pasangan pipa ke dasar laut sehingga kemudian rencana pencarian kandungan migas sudah bisa dimulai, termasuk instalasi dan commissioning test atau pengujian operasional pekerjaan.

" Semua proses persiapan produksi diharapkan bisa selesai pada tahun 2018, sehingga apabila kandungan gasnya dinilai cukup ekonomis, maka diharapkan tahun 2019 sudah bisa eksplorasi dan eksploitasi" kata Ali.

Untuk memuluskan itu, HCML juga sedang gencar mensosialisasikan rencana tersebut ke masyarakat sekitar rencana kegiatan HCML di Pulau Sepudi dan Pulau Raas. Termasuk dengan pihak TNI AL, karena lokasi tersebut berada di daerah latihan TNI AL.

Support Oil and Gas Operation Activities, SKK Migas Cooperate with BMKG

Special Unit for Upstream Oil and Gas Business Activities (SKK Migas) agreed to cooperate with Meteorology, Climatology and Geophysics Agency (BMKG). The Memorandum of Understanding on the provision, utilization, development of data and information of MKG in the management of upstream oil and gas business was signed by Head of SKK Migas Amien Sunaryadi and Head of BKMG Andi Eka Sakya at SKK Migas office on 31 May.

In his speech, Amien explained that the upstream oil and gas industry needs reliable and efficient meteorological, climatological and geophysical (MKG) information so that activities can run safely and on time. As a non-departmental government agency (LPND), BMKG has the competence to achieve these objectives.

According to him, many data services BMKG services that can be utilized by SKK Migas and Contractors Cooperation Contracts (KKS Contractors) to support upstream oil and gas activities, including lifting, production, drilling, and especially offshore projects. Dalam sambutannya, Amien menjelaskan dalam industri hulu migas dibutuhkan informasi meteorologi, klimatologi, dan geofisika (MKG) yang reliable dan efisien agar kegiatan dapat berjalan dengan aman dan tepat waktu. Sebagai lembaga pemerintah non departemen (LPND), BMKG memiliki kompetensi untuk rnencapai tujuan tersebut.

Menurutnya, banyak data layanan jasa BMKG yang dapat dimanfaatkan oleh SKK Migas dan Kontraktor Kontrak Kerja Sama (Kontraktor KKS) untuk mendukung kegiatan hulu migas, antara lain lifting, produksi, pengeboran, dan proyek-proyek khususnya di lepas pantai. Layanan jasa BMKG tersebut antara lain observasi cuaca seperti intensitas curah hujan, kecepatan dan arah angin baik di darat maupun di laut, tinggi gelombang laut, pasang surut, kecepatan arus bawah air laut, data geofisika dan bencana alam seperti informasi kegempaan dan potensi tsunami; early hazard warning system terkait adanya tumpahan minyak (oil spill); serta bahaya asap kebakaran hutan.

Di sisi lain, BMKG dapat memanfaatkan fasilitas migas yang berada di lepas pantai (Offshore) baik di anjungan, kapal Floating Production Storage Offloading (FPSO) maupun Floating Storage Offloading (FSO) untuk menempatkan peralatan/ sensor sehingga tingkat keakuratan data, khususnya perkiraan cuaca bisa lebih akurat.

Selain itu, pelibatan BMKG sebagai bentuk pemberdayaan kapasitas nasional. “Ke depannya, tidak ada lagi kerja sama atau kontrak kerja dengan pihak lain terkait pelayanan jasa MKG di kegiatan survei, pengeboran, proyek maupun operasional,” kata Amien dalam keterangan tertulis di jakarta, Kamis (1/6).

Setelah penandatangan nota kesepahaman dengan SKK Migas, BMKG langsung menandatangani perjanjian kerja sama dengan Husky CNOOC Madura Limited (HCML), sebagai operator Wilayah kerja Madura Strait, dan ENI, sebagai operator Wilayah kerja Muara Bakau terkait penyediaan layanan informasi di bidang meteorologi maritim.

Amien berharap dengan adanya nota kesepahaman dan perjanjian kerja sama tersebut dapat meningkatkan kualitas pelaksanaan tugas dan fungsi SKK Migas, Kontraktor KKS, dan BMKG sesuai dengan kewenangan masing-masing. Strengthen National Energy, HCML Start Up Field BD

The Cooperation Contract Contractor (KKKS) of Husky-CNOOC Madura Limited (HCML) started BD field start up activity on Saturday (6/5). This commissioning or startup activity is expected to take 1 to 2 weeks.

After the start up period, initial production of BD field will be channeled to PGN of 20-30 MMSCFD and is planned to increase gradually to strengthen national energy availability. "In addition to gas, BD field also produces condensate and liquid sulfur," said Senior Manager Development HCML, Jonny Pasaribu.

"The startup process is run to see the readiness of the entire facility already installed,". On the other hand, Senior Manager Legal, HR & Business Support; HCML Wahyudin Sunarya added that HCML is a KKKS under the supervision and control of SKK Migas, which operates Madura Strait working area in East Java.

BD Field is part of the Husky Madura Strait Block, located off the coast of Madura Strait, East Java, 65 kilometers east of Surabaya and 16 kilometers south of Madura Island. The Madura-BD gas wells are located around the Mandangin Islands area, off the coast of the Madura Strait. The field is an old field and is expected to produce 442 BCF (Billion Cubic Feet) natural gas and 18.7 MMBL condesate for 13 years.

In BD Field development, HCML uses offshore platform PT PAL production centered in Surabaya. The offshore platform has been installed in a 55 meter sea depth. The offshore rig construction project was acquired by PT PAL after they won a special tender for Madura BD's "Engineering Procurement Construction and Installation / EPCI" project.

The use of PT PAL's offshore production platform is a form of HCML commitment in supporting SKK Migas business to continuously increase the percentage of Domestic Component (Domestic Component Level) and support the strengthening of national industry in its operations.

"This is in line with the spirit of SKK Migas to encourage upstream oil and gas industry as a driver of the national economy and improving people's welfare," said Wahyudin.

Kontraktor Kontrak Kerja Sama (KKKS) Husky-CNOOC Madura Limited (HCML) mulai melakukan kegiatan start up lapangan BD, Sabtu (6/5). Kegiatan commisioning atau start up ini diperkirakan akan memakan Waktu 1 hingga 2 minggu.

Setelah melewati masa start up, produksi awal lapangan BD akan disalurkan ke PGN sebesar 20-30 MMSCFD dan direncanakan akan terus meningkat secara bertahap untuk memperkuat ketersediaan energi nasional. “Selain gas, lapangan BD juga memproduksi kondensat dan sulfur cair,” kata Senior Manager Development HCML, Jonny Pasaribu.

“Proses start up ini dijalankan untuk melihat kesiapan keseluruhan fasilitas yang sudah terpasang,”. Pada bagian lain, Senior Manager Legal, HR & Business Support' HCML Wahyudin Sunarya menambahkan, HCML merupakan KKKS di bawah pengawasan dan pengendalian SKK Migas, yang mengoperasikan wilayah kerja Madura Strait di wilayah Jawa Timur. 

Lapangan BD merupakan bagian dari Blok Husky Madura Strait, terletak di lepas pantai Selat Madura, Jawa Timur, 65 kilometer sebelah timur Surabaya dan 16 kilometer sebelah selatan Pulau Madura. Sumur-sumur gas Madura-BD sendiri berada di sekitar areal Kepulauan Mandangin, lepas pantai Selat Madura. Lapangan tersebut merupakan lapangan lama dan diharapkan akan menghasilkan 442 BCF (Billion Cubic Feet) gas bumi dan 18,7 MMBL kondesat selama 13 tahun.

Dalam pengembangan Lapangan BD, HCML menggunakan anjungan lepas pantai (offshore platform) produksi PT PAL yang berpusat di Surabaya. Anjungan lepas pantai itu telah terpasang di kedalaman laut 55 meter. Proyek pembangunan anjungan lepas pantai ini diperoleh PT PAL setelah mereka memenangkan tender khusus proyek lepas pantai “Engineering Procurement Construction and Installation/ EPCI” Madura BD. 

Penggunaan anjungan lepas pantai produksi PT PAL merupakan Wujud komitmen HCML dalam mendukung usaha SKK Migas untuk terus meningkatkan-persentase TKDN (Tingkat Komponen Dalam Negeri) dan mendukung perkuatan industri nasional dalam kegiatan operasinya.

“Hal ini seiring dengan semangat SKK Migas mendorong industri hulu migas sebagai penggerak perekonomian nasional dan peningkatan kesejahteraan rakyat,” kata Wahyudin.

Bidding conspiracy

KPPU will appeal the decision of the South Jakarta District Court which won the stronghold of PT COSL Indo and Husky CNOOC Madura Limited (HCML) related to tender conspiracy cases.

On the decision of the South Jakarta District Court ruling on Thursday (27/4), the panel of judges overturned the decision of the Business Competition Supervisory Commission. O3 / KPPU-L / 2016. KPPU's lawyer Nurul Fadilah said that although the court granted the objection to the reported parties I and II, it would not be able to refuse to prove the existence of the conspiracy.

According to him, it has been thought to appeal to the Supreme Court. Of course, there is a cassation direction. However, I will report first.

Meanwhile, PT COSL Indo and Husky-CNOOC Madura Limited (HCML) legal counsel, Teuku Raja Rajuanda from law firm Firmansyah and Co. Said that from the beginning KPPU's decision was judged.

This is because the Commission Council does not consider the facts presented by the witnesses reported. Of course, satisfied, and most importantly the panel of judges overturned the KPPU's decision. We are ready for the further legal process because there is no problem with our tender.

Tender of jack-up drilling services for BD services to support the drilling and completion of operations of Madura BD Structure located off Madura Strait KKS Madura. The estimated value of the project reached US $ 34.62 million.

On October 14, 2016, KPPU Commission Council read the verdict stating Husky CNOOC Madura Limited (Reported I) and PT COSL Indo (Reported II) violated Article 22 of Law no. S / 199. Both were reportedly punished to pay a fine of Rp 12,8 billion, and Rp 11,6 billion. Unsatisfied, the two reportedly filed an objection through the South Jakarta District Court. As a result, the court accepted the two business entities' objections.

Chief Judge Irwan said that no affiliation facts were found as mentioned by KPPU, which resulted in a tender conspiracy.

According to him, based on the witnesses presented by Husky CNOOC and PT COSL Indo in the case 03 / KPPU-L / 2016, showed that there are no unhealthy competition elements since the tender process has been running correctly.

The petitioner's objection can not be blamed on the provisions of Article 22 of Law no. 5 / 1999. The Assembly concludes, is not legally and convincingly proven that the applicant objected to violating the tender rules.

The panel of judges also considers that if Reported I and II violate Article 22 of Law no. 5/1999, then it should see the other party losing his rights.

In Article 22, it is mentioned that business actors are prohibited to conspire with other parties to arrange and or determine the winning bidder so that it can lead to unfair business competition.

Upon granting the objection petition filed with the case number 907 / Pdt.G.KPPU / 2016 / PN.Jkt.Sel, the judges acquitted the complainants of Husky-CNOOC Madura Limited (HCML) and PT COSL Indo from the payment of fines.

RECOMMENDATION

However, with the recommendation of the Commission Assembly to the Special Unit for Upstream Oil and Gas Business Executor (SKK Migas), the judge considered it appropriate, in anticipation of unhealthy competition in the tender process.

The recommendation of the KPPU Commission Assembly shall among others evaluate the procurement rules concerning the relation of ownership of shares between the goods provider and/or service with the user of the goods and/or services in the same tender process. The reason, it can trigger a conspiracy that hampers business competition.

Also, evaluating the tender related to the requirements of the domestic content level (TKDN) is more effective in reflecting its achievement, so that it is not only a statement of sole ability. In the case of a report handled by KPPU last year, the investigators concluded the alleged conspiracy between Husky-CNOOC Madura Limited and PT COSL Indo. The conspiracy can be seen from the affiliation between PT COSL Indo and Husky-CNOOC Madura Limited (HCML).

Besides, KPPU believes that the post bidding actions conducted by the reporters in the bidding process can be categorized as dishonest and unlawful. The reason, in addition to contrary to the provisions in the tender documents, is also not following the regulations.

Post bidding is the amendment, addition, replacement, and/or reduction of qualification assessment documents, tender documents, and/or bidding documents after the deadline for submission of documents is closed.

Three Oil and Gas Projects Work Can Be Hampered

One of them, gas distribution infrastructure in Madura Block is not yet ready 

Indonesia's oil and gas production has not moved up from year to year. One of the causes is that new oil and gas projects still can not contribute, because there are still problems. As related to prices and infrastructure of oil and gas itself.

Indeed, the Special Unit for Upstream Oil and Gas Business Executor (SKK Migas) has 14 oil and gas projects that have been targeted to deliver gas or onstream by 2025.

Specifically this year, there are three projects that should have been able to supply gas. First, the Matindok oil and gas project can produce 65 million standard cubic feet per day or mmscfd in the second quarter of this year.

Second, the Cricket Field project that can produce the value of the third quarter of 2017. Crude oil production can reach 2.00 barrels per day and about 450 million standard cubic feet of gas per day or mmscfd.

The third is the Madura BD oil and gas projects under construction. SKK Migas targets the Madura BD Block project to start production in the second quarter of this year. Understandably, this oil and gas block has a significant value of oil and gas production for the size of Indonesia. Namely reach 5,000 barrels of oil per day and 110 million standard cubic feet of gas per day.

But the Madura block production process is threatened when the buyers are still not ready to receive gas from the block. This means there is a problem downstream of the project. Allegedly because the facilities and infrastructure of gas receipts to buyers are still not ready.

The operator of the block, Husky CNOOC Madura Limited, has signed a gas sales and purchase agreement of 145 million standard cubic feet per day with three companies, PT Perusahaan Gas Negara Tbk (PGN), PT Inti Alasindo Energy and PT Petrokimia Gresik last year.

Based on these data, there are still more problematic projects. For example the Wasambo project. In this project, the problem is the price of gas that has not agreed with the buyer of this gas buy that is PT PLN. In fact, the oil and gas project of Wasambo Block is still under construction and can actually produce this year. However, the block production process will be delayed until the second quarter of 2018.

Produksi minyak dan gas Indonesia masih belum beranjak naik dari tahun ke tahun. Salah satu penyebab adalah proyek migas baru masih belum bisa berkontribusi, karena masih ada persoalan. Seperti terkait harga dan infrastruktur migas itu sendiri.

Sejatinya Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas) terdapat 14 proyek migas yang sudah ditargetkan mengalirkan gas atau onstream hingga tahun 2025.

Khusus tahun ini, ada tiga proyek yang seharusnya sudah bisa memasok gas. Pertama, proyek migas Matindok yang bisa memproduksi gas sebanyak 65 juta standar kaki kubik per hari atau mmscfd pada kuartal II tahun ini juga.

Kedua, proyek Lapangan Jangkrik yang bisa berproduksi nilai kuartal III-2017. Produksi minyak di Jangkrik bisa mencapai 2.00 barel per hari dan sekitar 450 juta standar kaki kubik gas per hari atau mmscfd.

Yang ketiga yakni proyek migas Madura BD yang sedang dalam proses konstruksi. SKK Migas menargetkan proyek Blok Madura BD sudah bisa berproduksi pada kuartal II tahun ini. Maklum, blok migas ini memiliki nilai produksi migas yang signifikan untuk ukuran Indonesia. Yaitu mencapai 5,000 barel minyak per hari dan 110 juta standar kaki kubik gas per hari. 

Namun proses produksi blok Madura terancam terganggu bila para pembeli masih belum siap menerima gas dari blok tersebut. Artinya ada persoalan di hilir proyek. Diduga karena sarana dan prasarana penerimaan gas ke pembeli masih belum siap. 

Operator blok ini yakni Husky CNOOC Madura Limited telah meneken perjanjian jual beli gas 145 juta standar kaki kubik per hari  dengan tiga perusahaan, yakni PT Perusahaan Gas Negara Tbk (PGN), PT Inti Alasindo Energy dan PT Petrokimia Gresik pada tahun lalu.

Berdasarkan data tadi, masih ada lagi proyek yang bermasalah. Misalnya proyek Wasambo. Di proyek ini , persoalannya adalah harga gas yang belum sepakat dengan pembeli beli gas ini yakni PT PLN. Padahal, proyek migas Blok Wasambo sampai saat ini masih dalam tahap konstruksi dan sejatinya sudah bisa berproduksi pada tahun ini juga. Namun proses produksi blok tersebut akan tertunda hingga kuartal II-2018.

Menurut Kepala Satuan Gas dan BBM PLN Yhairani Rachmatullah, harga gas Wasambo sudah pernah disepakati. Namun,  menerbitkan Peraturan Menteri ESDM No 11/2017 tentang Pemanfaatan Gas Bumi untuk Pembangkit Listrik. "Dengan keluarnya Peraturan Menteri ESDM No ll/2017, PLN meminta pihak penjual mendiskusikan kembali untuk bisa disesuaikan," 

    Ia berharap, Permintaan PLN tersebut bisa disepakati. Sayang, ia tidak merinci besaran harga gas yang diminta. "Mudah-mudahan segera sepakat lagi. Permintaan PLN seperti itu," tegasnya.
