Revisi UU Migas dan Minerba Masuk Prolegnas 2017
Dewan Perwakilan Rakyat (DPR) menetapkan revisi Undang-Undang No. 4 Tahun 2009 tentang Pertambangan Mineral dan Batubara serta revisi Undang-Undang No. 22 Tahun 2009 tentang Minyak dan Gas Bumi masuk dalam Program Legislasi Nasional (Prolegnas) 2017. Wakil Ketua Komisi VII DPR Syaikhul Islam Ali mengatakan kedua undang-undang itu menjadi prioritas untuk segera diselesaikan pada tahun depan. “Kemungkinan nanti akan dikeRjakan bersamaan,” kata Syaikhul. Syaikhul enggan mengungapkan target penyelesaian kedua beleid tersebut. Namun dia menegaskan Komisi VII berusaha semaksimal mungkin merampungkan revisi undang-undang tersebut. Tetap diusahakan tahun 2017.
Revisi UU Minerba sebenarnya sudah masuk dalam Prolegnas 2015. Beleid tersebut direvisi seiring dengan terbitnya UndangUndang No. 23 Tahun 2014 tentang Pemerintah Daerah. Pasal-pasal dalam UU Minerba dan UU Pemda tersebut saling bertentangan. Penyelarasan perlu dilakukan dengan merevisi pasal dalam Undang-Undang Mineral dan Batubara (Minerba) terkait kewenangan Bupati/Walikota. Dalam Undang-Undang Mineral dan Batubara (Minerba) dinyatakan Bupati/Walikota dapat menerbitkan dan mencabut Izin Usaha Pertambangan (IUP).
Sedangkan pada UU Pemerintah Daerah menyatakan kewenangan penerbitan dan pencabutan IUP diserahkan ke Gubernur. Sebenarnya Kementerian Energi dan Sumber Daya Mineral (ESDM) pernah berkeinginan untuk mengambil alih inisiatif penyusunan UU tersebut. Menteri Koordinator bidang Kemaritiman Luhut Binsar Pandjaitan ketika menjabat sebagai Pelaksana Tugas (Plt) Menteri ESDM membicarakan usulan tersebut dengan Komisi VII DPR.
Pasalnya Kementerian ESDM telah menyelesaikan naskah revisi UU Minerba. Namun hasil pembahasan dengan Komisi VII menyatakan revisi UU Minerba tetap inisiatif DPR namun pembahasannya bakal lebih intensif. Kala itu ditargetkan revisi UU Minerba bisa rampung akhir tahun ini guna memberi kepastian hukum bagi pelaku usaha pertambangan.
