Prohibited from Selling Oil and Gas Manage Parts to the Private Sector


The central government ensures that local governments will prohibit selling part of the management or Participating Interest to the private sector. This certainty was stated by ESDM Minister Ignasius Jonan.

According to Jonan, this prohibition aims to prevent the loss of parts of the bloodstream in the management of oil and gas blocks in their area. As is known, so far local governments have a 10% management share of oil and gas blocks in their area. This part is regulated in Government Regulation (PP) No. 35/2004 concerning Upstream Oil and Gas Business Activities.

As stated in the regulation, the part must be offered to Regional Owned Enterprises (BUMD) Article 35 paragraph 1 said, if the BUMD is interested and able to take part in managing the region, they must declare within a period of 60 days from the time the bidding is given by the contractor.

According to Jonan, this plan became one of the points of the report submitted when he was called by President Joko Widodo to the Palace on Monday (10/31). Deputy Minister of Energy and Mineral Resources Arcandra Tahar added that the government hopes that with this tightening person in the regions will be able to feel the results of the natural wealth in their area.

Daerah Dilarang Menjual Bagian Kelola Migas ke Swasta

Pemerintah pusat memastikan akan melarang pemerintah daerah menjual bagian kelola atau Participating Interest ke pihak swasta. Kepastian ini dikemukakan Menteri ESDM Ignasius Jonan. 

Menurut Jonan, larangan ini bertujuan untuk mencegah hilangnya bagian daarah pada pengelolaan blok migas di wilayah mereka. Seperti diketahui, selama ini pemerintah daerah memiliki bagian pengelolaan atas blok minyak dan gas di wilayah mereka sebesar 10%. Bagian ini diatur dalam Peraturan Pemerintah (PP) Nomor 35 Tahun 2004 tentang Kegiatan Usaha Hulu Minyak dan Gas.

Di aturan disebutkan, bagian tersebut wajib ditawarkan kepada Badan Usaha Milik Daerah (BUMD) Pasal 35 ayat 1 mengatakan, bila BUMD berminat dan sanggup mengambil bagian kelola daerah, mereka harus menyatakan dalam jangka waktu paling lama 60 hari sejak ada penawaran oleh kontraktor. 

Menurut Jonan, rencana ini menjadi salah satu poin laporan yang disampaikan saat dia dipanggil Presiden Joko Widodo ke Istana, Senin (31/10). Wakil Menteri ESDM Arcandra Tahar menambahkan pemerintah berharap dengan pengetatan ini nantinya masyarakat di daerah bisa merasakan hasil kekayaan alam di daerah mereka.
