Managing Oil and Gas Revenue Sharing Funds

All of this happened because of inadequate understanding among the stakeholders, including the regional government. As is known, the Special Task Force for Upstream Oil and Gas Business Activities (SKK Migas) and Cooperation Contract Contractors (KKS Contractors) conduct cooperation in oil and gas exploration and production.

     Oil and gas production will be shared between the government and PSC Contractors known as oil and gas revenue sharing. However, the revenue sharing here is not the distribution of state revenue for the regions, but the oil and gas revenue sharing within the scope of the implementation of the Production Sharing Contract, namely the distribution of oil and gas lifting (sold oil and gas production) between the government and PSC Contractors in accordance with the agreement in contract.

   The tasks of SKK Migas and KKS Contractors are concentrating on efforts to optimize lifting in each work area. SKK Migas and KKS Contractors' tasks are completed after oil and gas lifting has been commercialized and the money generated from oil and gas sales is channeled to government accounts. The results of this country's business are deposited directly to the country through the account of the Minister of Finance. So, no oil and gas sales proceeds go into SKK Migas accounts, "said SKK Migas Head of Public Relations, Taslim Z. Yunus.

     Other agencies involved in the process of determining the Revenue Sharing Fund are the Ministry of Energy and Mineral Resources (ESDM). Initially, the Ministry of Energy and Mineral Resources was tasked with dividing oil and gas lifting per province and per district / city. The Ministry of Energy and Mineral Resources will use the lifting report per KKS Contractor reported by SKK Migas as a comparison and control tool when evaluating lifting per producing region.

     After going through the review and evaluation process, the Ministry of Energy and Mineral Resources will issue a Minister of Energy and Mineral Resources Decree regarding the allocation of lifting per oil and gas producing region. Another process takes place at the Ministry of Finance. The ministry will verify the lifting report received from SKK Migas every month to ensure that the money received in the Ministry of Finance account at Bank Indonesia is the same as the SKK Migas report.

     If the report has been verified, the Ministry of Finance will calculate the net state revenue per KKS contractor. This net state revenue report per KKS Contractor together with the lifting report per producing region from the Ministry of Energy and Mineral Resources is then processed by the Ministry of Finance, so that the production sharing funds will be allocated to the central government, producing regional governments, and non-oil and gas producing regional governments.

The allocation of profit sharing funds is included in the Decree of the Minister of Finance. The basis of the government in dividing the percentage of revenue sharing from oil and gas is Law Number 33 of 2004 concerning Financial Balance between the Central Government and Regional Governments. The regulation stipulates that petroleum revenues, after being reduced by components of taxes and other levies, are divided by a balance of 84.5 percent for the central government and 15.5 percent for the regions.

   Of this 15.5 percent, 0.5 percent is allocated to increase the basic education budget in the region concerned. The remaining 15 percent is divided by details: 3 percent for the province; 6 percent for producing districts / cities, and 6 percent for other districts / cities in the province concerned. Specifically for natural gas revenues, the share is 69.5 percent for the central government and 30.5 percent for the regions.

   Then, as much as 0.5 percent of the rights of this region will be allocated to increase the basic education budget in the area concerned. The remaining 30 percent is divided by details: 6 percent for the province; 12 percent for producing districts / cities, and 12 percent for other city districts.

    From this explanation two conclusions can be drawn. First, SKK Migas and the KKS Contractors do not have the authority to manage the distribution of profit sharing funds to the regions. Second, every government agency involved in this process works according to applicable laws.

   Regional aspirations to improve the oil and gas output they receive certainly need to be appreciated. However, all parties certainly hope, lest the distribution of these aspirations interfere with upstream oil and gas operations that can threaten state revenue. Because in the end the disruption of upstream oil and gas operations will directly threaten the revenue of the area concerned from oil and gas revenue sharing funds.

Mengelola Dana Bagi Hasil Migas

     Semua itu terjadi lantaran pemahaman yang belum tepat di antara para pemangku kepentingan, termasuk pemerintah daerah. Sebagaimana diketahui, Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas) dan Kontraktor Kontrak Kerja Sama (Kontraktor KKS) melakukan kerja sama dalam eksplorasi dan produksi migas. 

     Hasil produksi migas akan dibagi antara pemerintah dan Kontraktor KKS yang dikenal dengan bagi hasil migas. Namun, bagi hasil di sini bukanlah distribusi penerimaan negara untuk daerah, tapi bagi hasil migas dalam lingkup pelaksanaan Kontrak Bagi Hasil Hulu Migas (Production Sharing Contract), yaitu pembagian lifting migas (produksi migas yang terjual) antara pemerintah dan Kontraktor KKS sesuai dengan kesepakatan dalam kontrak.

   Tugas SKK Migas dan Kontraktor KKS berkonsentrasi pada Upaya mengoptimalkan lifting pada masing-masing wilayah kerja.Tugas SKK Migas dan Kontraktor KKS selesai setelah lifting migas berhasil dikomersialisasikan dan uang yang dihasilkan dari penjualan migas disalurkan ke rekening pemerintah. Hasil bisnis negara ini disetorkan langsung ke negara melalui rekening Menteri Keuangan. Jadi, tidak ada hasil penjualan migas yang masuk ke rekening SKK Migas,” kata Kepala Humas SKK Migas, Taslim Z. Yunus. 

     Adapun instansi lain yang terlibat dalam proses penentuan Dana Bagi Hasil adaiah Kementerian Energi dan Sumber Daya Mineral (ESDM). Awalnya, Kementerian ESDM bertugas membagi lifting migas per provinsi dan per kabupaten/kota. Kementerian ESDM akan menggunakan laporan lifting per Kontraktor KKS yang dilaporkan SKK Migas sebagai bahan pembanding dan alat kontrol ketika melakukan evaluasi lifting per daerah penghasil. 

     Setelah melewati proses review dan evaluasi, Kementerian ESDM akan mengeluarkan Keputusan Menteri ESDM tentang alokasi lifting per daerah penghasil migas. Proses lain berlangsung di Kementerian Keuangan. Kementerian ini akan memverifikasi Laporan lifting yang diterima dari SKK Migas setiap bulan untuk memastikan bahwa uang yang diterima di rekening Kementerian Keuangan di Bank Indonesia sama besarnya dengan yang dilaporkan SKK Migas. 

     Bila laporan itu sudah terverifrkasi, maka Kementerian Keuangan akan melakukan penghitungan penerimaan negara bersih per Kontraktor KKS. Laporan penerimaan negara bersih per Kontraktor KKS ini bersama dengan laporan lifting per daerah penghasil dari Kementerian ESDM kemudian diolah oleh Kementerian Keuangan, sehingga diperoleh dana bagi hasil yang selanjutnya akan dialokasikan kepada, pemerintah pusat, pemerintah daerah penghasil, dan pemerintah daerah non-penghasil migas. 

     Pengalokasian dana bagi hasil ini dimasukkan dalam Surat Keputusan Menteri Keuangan. Dasar pemerintah dalam membagi persentase dana bagi hasil migas adalah Undang Undang Nomor 33 tahun 2004 tentang Perimbangan Keuangan antara Pemerintah Pusat dan Pemerintahan Daerah. Regulasi ini mengatur bahwa penerimaan minyak bumi, setelah dikurangi komponen pajak dan pungutan lain, dibagi dengan imbangan 84,5 persen untuk pemerintah pusat dan 15,5 persen untuk daerah. 

   Dari angka 15,5 persen ini, sebesar 0,5 persen dialokasikan untuk menambah anggaran pendidikan dasar pada daerah bersangkutan. Sisanya, sebesar 15 persen dibagi dengan rincian: 3 persen untuk provinsi; 6 persen untuk kabupaten/kota penghasil, dan 6 persen untuk kabupaten/kota lainnya dalam provinsi yang bersangkutan. Khusus untuk penerimaan gas bumi, pembagiannya adalah 69,5 persen untuk pemerintah pusat dan 30,5 persen untuk daerah. 

   Lalu, sebesar 0,5 persen dari hak daerah ini akan dialokasikan untuk menambah anggaran pendidikan dasar pada daerah bersangkutan. Sisanya, sebesar 30 persen dibagi dengan rincian: 6 persen untuk provinsi; 12 persen untuk kabupaten/kota penghasil, dan 12 persen untuk kabupaten kota lain.

    Dari penjelasan ini dapat ditarik dua kesimpulan. Pertama, SKK Migas dan Kontraktor KKS tidak memiliki kewenangan mengelola pembagian dana bagi hasil ke daerah. Kedua, setiap instansi pemerintah yang terlibat dalam proses ini bekerja berdasarkan perundang-undangan yang berlaku. 

   Aspirasi daerah untuk meningkatkan hasil migas yang mereka terima tentu perlu dihargai. Namun, semua pihak tentu berharap, jangan sampai penyaluran aspirasi ini mengganggu kegiatan operasi hulu migas yang dapat mengancam penerimaan negara. Karena pada akhirnya terganggunya kegiatan operasi hulu migas secara langsung akan mengancam penerimaan daerah bersangkutan dari dana bagi hasil migas.
