Government Provides Incentive of Oil and Gas Business Taxes



PP 79/2010 was finally revised and provided some tax facilities to the upstream oil and gas industry

The Government finally finalized the final draft of Government Regulation Revision No. 79/2010 on the Cost of Restructured Operations and the Treatment of Income Tax in Upstream Business Field. Under the regulation, the government promised a number of tax incentives for oil and gas contractors.

PP 79/2010 akhirnya direvisi dan memberikan beberapa fasilitas pajak ke industri hulu migas

Pemerintiah akhirnya menyelesaikan draf final revisi Peraturan Pemerintah No 79/2010 tentang tentang Biaya Operasi yang Dapat Dikembalikan dan Perlakuan Pajak Penghasilan di Bidang Usaha Hulu. Dalam aturan itu, pemerintah menjanjikan sejumlah insentif perpajakan bagi kontraktor migas.

Wakil Menteri Energi dan Sumber Daya Mineral Arcandra Tahar yakin, jika revisi PP 79/2010 terbit, investasi hulu migas akan lebih banyak. Ujungnya, kegiatan eksplorasi meningkat dan masalah perpajakan bisa selesai. Menurut Arcandra, ia juga merevisi secepat mungkin apa yang menjadi ekspektasi Indonesia Petroleum Association (IPA). “Tidak hanya soal pajak, tapi lebih daripada masalah pajak. Kami coba mendengar apa yang membuat bisnis migas lebih baik," ungkap dia pekan lalu, dalam acara The 41 Indonesian Petroleum Association Convention and Exhibition di JCC.

Draf final revisi PP No 79/2010 Isinya tidak menyebutkan secara eksplisit soal prinsip assume and discharge. Namun, Pasal 26A, Pasal 2613, Pasal 26C dan Pasal 26D, yang merupakan pasal fasilitas perpajakan, menyebutkan beberapa ketentuan pajak dibebaskan, meski menunggu aturan Menteri Keuangan 

Menanggapi agenda revisi itu, IPA tetap meminta berlakunya prinsip assume and discharge dalam revisi PP 79. “Kontrak sebelum tahun 2010 tetap dihormati," Kata Marjolin Wanong Direktur Eksekutif IPA 

Sammy Hamzah, Ketua Asosiasi Pengusaha Indonesia (Apindo), menyatakan pentingnya assume and discharge dalam revisi aturan. "Saya tidak tahu detailnya, tapi yang penting adanya atau diberlakukannya unsur assume and discharge," jelas Sammy 

Namun demikian, meski belum membaca draf, beberapa poin, Sammy berkomentar, secara garis besar poin- poin dalam draf tersebut cukup positif. Secara garis besar apa yang dijabarkan cukup positif. Tapi kami baru benar-benar bisa menanggapi lebih detail setelah PP-n kami terima, ujar Sammy.

Sementara, Adiatma Sardjito Vice President Corporate Communication PT Pertamina, mengaku belun membaca soal draf final PP 79/2010 itu. Saya perlu masukan dulu dari kawan-kawan eksplorasi dan rekan hukum (untuk tanggapi soal draft itu).

Seperti diketahui, PP No 79/2010 membawa petaka ke industri hulu migas selama 7 tahun ini, maka, sejak PP No 79/2010 itu terbit, IPA sering memprotes soal aturan tersebut. Apalagi saat ini industri migas sedang lesu karena harga minyak belum juga naik. 

Belum tentu tumbuh

Fahmi Radhi, Pengamat Energi dari Universitas Gajah Mada, menyatakan, masalah perpajakan selama ini memang menjadi salah satu hambatan bagi investor migas. Revisi PP 79/2010 tidak menjamin akan mengangkat investasi migas di Indonesia.

Ada beberapa variabel yang menyebabkan penurunan investasi migas. Salah satunya adalah perubahan rezim contract dari production sharing contract (PSC) menjadi gross split.

Menurut dia, kontraktor migas yang sudah beroperasi dan selama ini merasa nyaman dengan skema production shaving contract bisnis migas cenderung menunggu bersikap menunggu (wait and see). Sehingga (gross split) ini yang berpotensi menurunkan investasi migas. Fahmi menyarankan agar PSC cost recovery masih bisa dipakai oleh kontraktor sampai 5 tahun ke depan.

Data Collection of Potential Constrained Minimals of Advanced Tools

Wawan added that Geomarine IV Research Vessel is much more efficient than Geomarine III. The cost of seismic surveys per square kilometer on Geomarine III Research Ship reaches Rp 200 million. The Geomarine IV Research Ship only needs Rp 6 million per square kilometer.

Pendataan Potensi Terkendala Minim-nya Alat Canggih


Upaya pemerintah mengumpulkan data potensi minyak dan gas bumi di perairan terkendala ketersediaan alat canggih. Saat ini, Indonesia hanya memiliki satu unit kapal penelitian yang dinamai Kapal Riset Geomarine III. Sekretaris Badan Penelitian dan Pengembangan (Balitbang) pada Kementerian Energi dan Sumber Daya Mineral (ESDM) Wawan Supriyatna mengatakan, kelengkapan data potensi minyak dan gas bumi sangat diperlukan investor. 

Apabila data yang ada lengkap, ketertarikan investor semakin  tinggi untuk mengembangkan Wilayah kerja tersebut ke tahap lebih lanjut, seperti eksplorasi hingga produksi. ”Saat ini baru ada Kapal Riset Geomarine III yang merupakan satu-satunya kapal riset tercanggih yang dimiliki Indonesia. Kami perlu Kapal Riset Geomarine IV yang punya kemampuan survei seismik tiga dimensi. Geomarine III kemampuannya masih dua dimensi,” ujar Wawan dalam diskusi di atas Kapal Riset Geomarine III, Sabtu (20/5), di Pelabuhan Benoa, Denpasar, Bali.

Wawan menambahkan, Kapal Riset Geomarine IV jauh lebih efisien daripada Geomarine III. Biaya survei seismik per kilometer persegi pada Kapal Riset Geomarine III mencapai Rp 200 juta. Adapun dengan Kapal Riset Geomarine IV hanya perlu dana Rp 6 juta per kilometer persegi. 

Kepala Pusat Penelitian dan Pengembangan Geologi Kelautan pada Balitbang Kementerian ESDM Ediar Usman menambahkan, karena hanya ada satu unit kapal riset yang dimiliki Indonesia, riset hanya bisa dilakukan di bidang tertentu saja. Hasil yang didapat pun tidak optimal karena tidak seimbangnya luas lautan dengan fasilitas kapal yang hanya satu unit.

Menurut Ediar, Kapal Riset Geomarine III lebih fokus pada penelitian gas biogenik. Gas ini terletak di perairan dangkal dengan kedalaman 500 meter sampai 1.000 meter dari dasar laut. Dengan demikian, biaya mulai dari eksplorasi, pengeboran, sampai produksi bisa lebih murah, Gas biogenik, mulanya bukan target utama dalam eksplorasi minyak dan gas konvensional. 

    Dari sekitar 100 triliun kaki kubik cadangan gas di Indonesia, sekitar 3,8 persen ditemukan sebagai gas biogenik. Di seluruh dunia, gas biogenik yang ditemukan baru sebanyak 4 triliun kaki kubik.

Shares of Oil and Gas Block

The participation of participating interest or participating interest (PI) of oil and gas blocks of 10% to regional-owned enterprises is considered not to guarantee accelerated licensing at the local government level. Executive Director of Indonesian Petroleum Association (IPA) Marjolijn Wajong said the shares of oil and gas block participation are offered to regional-owned enterprises rather than to local governments.

Although BUMD shares are owned by the local government, it is not a guarantee that the licensing process can be accelerated by the ownership of shares of participation in oil and gas blocks. The reason, Local Government and BUMD are two different entities. Granting licenses and cutting processes and the length of time required actually has become a government obligation in terms of ease of doing business.

On the other hand, the share offer of participation should be done by the contractor of cooperation contract (KKKS) even before the Minister of Energy and Mineral Resources Regulation No. 37/2016 issued, but the offer of permanent participation should consider the economy of the field. That it will lead to field development problems.

From the data of the Coordinating Ministry for Economic Affairs of February 2017, licensing in upstream oil and gas sector requires 373 types of permits. Meanwhile, as many as 137 permits have to be met during the development and construction period. Then, 117 permits must be completed at the exploration and survey stage. The remainder, 109 permits are met at the production stage and 10 other licenses during the operation.

Pelayanan di Daerah Belum Tentu Cepat


Penawaran hak partisipasi atau participating interest (PI) blok minyak dan gas bumi sebesar 10% kepada badan usaha milik daerah dianggap belum menjamin percepatan perizinan di tingkat pemerintah daerah. Direktur Eksekutif Indonesian Petroleum Association (IPA) Marjolijn Wajong mengatakan, saham partisipasi blok migas ditawarkan kepada badan usaha milik daerah bukan kepada pemerintah daerah.

Meskipun saham BUMD dimiliki pemerintah daerah, hal itu tidak menjadi jaminan bahwa proses perizinan bisa dipercepat dengan kepemilikan saham partisipasi pada blok migas. Pasalnya, Pemerintah Daerah dan BUMD merupakan dua entitas yang berbeda. Pemberian perizinan dan memangkas proses serta lamanya waktu yang dibutuhkan sebenarnya sudah menjadi kewajiban pemerintah dalam kaitan kemudahan berbisnis.

Di sisi lain, penawaran saham partisipasi memang seharusnya dilakukan kontraktor kontrak kerja sama (KKKS] bahkan sebelum Peraturan Menteri ESDM No. 37/2016 terbit. Meskipun demikian, penawaran hak partisipasi tetap harus mempertimbangkan keekonomian lapangan. Bila penawaran Pl nantinya mengganggu keekonomian, dia menyebut bahwa hal itu akan mengakibatkan masalah pengembangan lapangan. 

Dari data Kementenan Koordinator Bidang Perekonomian Februari 2017, perizinan di sektor hulu migas membutuhkan 373 jenis izin. Adapun, sebanyak 137 izin di antaranya harus dipenuhi ketika masa pengembangan dan konstruksi. Kemudian, 117 izin harus diselesaikan pada tahap eksplorasi dan survei. Sisanya, 109 izin dipenuhi pada tahap produksi dan 10 izin lainnya selama masa operasi.

Pertamina Prepare US $ 115 Billion



PT Pertamina has to increase the capacity of refineries up to 8 years with an investment of up to US $ 1 15 billion to reduce the volume of imports. Corporate Secretary of PT Pertamina Syarial Mukhtar revealed that his company has projected investment up to 2025 to finance the development of the infrastructure, especially the addition of refinery capacity.

"Approximately US $ 115 billion of investment until 2025. For upstream in downstream gas, for refineries to support the distribution of fuel [fuel]," he said after attending a seminar on oil and gas at the University of North Sumatra, Friday (19/5).

According to him, Pertamina's investment value always adjust to the existing business environment. Such as oil price movements, as well as domestic demand. The investment also aims to meet the needs of Sei Mangkei's economic region in North Sumatra.

The investment will also be directed to increase oil and gas production and reserves. However, the largest use of investment is one of them for the addition of refinery capacity. Pertamina currently operates six refineries. Namely Dumai II Refinery Unit (RU), RU III Plaju, RU IV Cilacap, RU V Balikpapan, RU VI Balongan, and RU VII Kasim. The six refineries have a total capacity of 1.05 million barrels per day although in operation it is only up to 950,000 barrels.

Because of this, Pertamina still imports 33 million kiloliters of oil every year because while this company can only contribute 39 million kiloliters and 72 million kiloliters of national demand. The import dependency ratio is also higher and currently reaches 44%. To that end, Pertamina chose to develop the capacity of a number of refineries, namely RU V Balikpapan, RU VI Balongan, RU IV Cilacap and RU II Dumai.

The project is called the Refinery Development Master Plan. Then the NGRR project (New Grass Root Refinery), the construction of new refineries in Tuban and Bontang. We do not want to depend on growing imports because of that our capacity must be large.

The use of the investment will be adjusted to the company's financial capability and scheduling. Likewise with the financing, some are handled by Pertamina itself and some are through the pattern of cooperation with the second party.

HOLDING ESTABLISHMENT

In a seminar session that was attended by practitioners of oil and gas practitioners, academics and students, the problem of holding a holding company became a much-reviewed topic. The seminar forum concluded that the formation of BUMN Migas is a government strategy in realizing energy security while accelerating import decline which has been the crucial issue of APBN.

In terms of readiness, the holding of oil and gas SOEs becomes the most likely policy in the near future considering that it will merge two business entities, namely PT Pertamina and PT Perusahaan Gas Negara Tbk. Each business entity has advantages and can be directed to complement each other.

Previously, Professor of the Faculty of Economics and Business University of Indonesia Rhenald Kasali said that until now many people are not aware that if only controlled, the natural resources of Indonesia is only a mere potential.

"Indonesia's natural resources are nothing. In order to be used to prosper the nation, it requires solidarity management. Solidarity management will bring potential to market, with technology, process, and value creation, "he said in the seminar forum.

Chairman of the House of Representatives Commission VII Gus lrawan revealed that at the end of January, the House Energy Commission drafted the draft Law on Oil and Gas and has agreed to strengthen Pertamina's position in managing the national oil and gas reserves.

Professor of Law University of Indonesia Hikmahanto reminded that until now the revision of Law no. 22/2001 on Oil and Natural Gas was also stipulated since the recommendation of the Special Committee on the Rights of BBN in 2008.

"The House Energy Commission's agreement should be included in the Law on which the law will become a reference for implementation. Without a clear legal basis, in the future it would be inconvenient for Pertamina, which is the manager of oil and gas. "

Hikmahanto also hopes that the revision of this Act will give the right of custodian management and exploitation of all national oil and gas blocks to SOEs. This new governance also increases the value of oil and gas resources for the state through the monetization of national oil and gas reserves and production.

PT Pertamina memiliki untuk menambah kapasitas kilang minyak sampai dengan 8 tahun mendatang dengan investasi hingga US$1 15 miliar untuk memperkecil volume impor. Corporate Secretary PT Pertamina Syarial Mukhtar mengungkapkan, pihaknya telah memproyeksikan investasi sampai dengan 2025 untuk membiayai pengembangan infrastraktur, terutama penambahan kapasitas kilang.

“Sekitar US$ 115 miliar investasi sampai 2025. Untuk hulu di gas hilir, untuk kilang untuk menunjang distribusi BBM [bahan bakar minyak],” ujarnya seusai menghadiri seminar migas di Universitas Sumatra Utara, Jumat (19/5).

Menurutnya, nilai investasi Pertamina selalu menyesuaikan dengan lingkungan bisnis yang ada. seperti pergerakan harga minyak, serta kebutuhan dalam negeri. Investasi tersebut juga bertujuan memenuhi kebutuhan kawasan ekonomi Sei Mangkei di Sumatra Utara.

Investasi juga akan diarahkan untuk meningkatkan produksi dan cadangan migas. Namun, penggunaan investasi terbesar salah satunya untuk penambahan kapasitas kilang. Saat ini Pertamina mengoperasikan enam kilang BBM. yakni Refinery Unit (RU) II Dumai, RU III Plaju, RU IV Cilacap, RU V Balikpapan, RU VI Balongan, dan RU VII Kasim. Ke-enam kilang tersebut memiliki total kapasitas sebanyak 1,05 juta barel per hari meski dalam operasionalnya hanya sampai dengan 950.000 barel.

Oleh karena ilu, Pertamina masih mengimpor minyak sebanyak 33 juta kiloliter setiap tahun karena sementara ini perusahaan hanya mampu berkontribusi 39 juta kiloliter dad 72 juta kiloliter kebutuhan nasional. Rasio ketergantungan impor pun semakin tinggi dan saat ini mencapai 44%. Untuk itu, Pertamina memilih untuk mengembangkan kapasitas sejumlah kilang, yakni RU V Balikpapan, RU VI Balongan, RU IV Cilacap dan RU II Dumai.

Proyek ini dinamakan Refinery Development Master Plan. Kemudian proyek NGRR (New Grass Root Refinery), yakni pembangunan kilang baru di Tuban dan Bontang. Kami tidak ingin tergantung impor yang semakin besar karena itu kapasitas kami harus besar.

Penggunaan investasi tersebut akan disesuaikan dengan kemampuan keuangan perseroan dan penjadwalan. Begitu juga dengan pembiayaannya, ada yang ditangani sendiri oleh Pertamina dan ada juga yang melalui pola kerja sama dengan pihak kedua.

PEMBENTUKAN HOLDING

Dalam sesi seminar yang dihadir kalangan dunia usaha praktisi migas, akademisi dan mahasiswa tersebut masalah pembentukan induk usaha atau holding menjadi topik yang banyak diulas. Forum seminar menyimpulkan bahwa pembentukan BUMN Migas merupakan strategi pemerintah dalam mewujudkan ketahanan energi sekaligus mempercepat penurunan impor yang selama ini menjadi persoalan krusial APBN.

     Dalam hal kesiapan, holding BUMN migas menjadi kebijakan yang paling mungkin dilakukan dalam waktu dekat mengingat hanya akan menyatukan dua entitas usaha, yakni PT Pertamina dan PT Perusahaan Gas Negara Tbk. Tiap-tiap badan usaha memiliki keunggulan dan dapat diarahkan untuk saling melengkapi.

     Sebelumnya, Guru Besar Fakultas Ekonomi dan Bisnis Universitas Indonesia Rhenald Kasali menuturkan bahwa sampai dengan saat ini banyak orang tidak sadar bahwa kalau hanya dikuasai saja, sumber daya alam Indonesia hanya menjadi potensi belaka.

“Sumber daya alam Indonesia tidak jadi apa-apa. Supaya bisa digunakan untuk memakmurkan bangsa, maka diperlukan manajemen yang solidaritas. Manajemen yang solidaritas akan mempertemukan potensi dengan pasar, dengan teknologi, proses, dan value creation,” tuturnya dalam forum seminar tersebut.

     Ketua Komisi VII DPR Gus lrawan mengungkapkan bahwa pada akhir Januari lalu, Komisi Energi DPR menyusun draf Rancangan Undang-Undang Migas dan telah bersepakat memperkuat posisi Pertamina dalam mengelola cadangan Migas nasional.

Guru Besar Hukum Universitas Indonesia Hikmahanto mengingatkan bahwa hingga saat ini revisi UU No. 22/2001 tentang Minyak dan Gas Bumi belmn juga ditetapkan sejak direkomendasikan Panitia Khusus Hak Angket BBM pada 2008.

“Kesepakatan Komisi Energi DPR harus dimasukkan dalam Undang-Undang yang menjadi dasar hukum yang akan menjadi acuan bagi pelaksanaan. Tanpa dasar hukum yang jelas, pada masa mendatang justru akan merepotkan bagi Pertamina yang menjadi pengelola migas.”

Hikmahanto juga berharap agar revisi UU ini memberikan hak kustodian pengelolaan dan pengusahaan seluruh blok migas nasional kepada BUMN. Tata kelola baru ini juga meningkatkan nilai sumber daya migas bagi negara melalui monetisasi cadangan dan produksi migas nasional.

Salah satu langkahnya melalui pemberian peran kepada BUMN migas nasional dalam melakukan pengelolaan dan pengusahaan seluruh blok migas nasional. Pemberian hak kustodian pengelolaan dan pengusahaan seluruh blok migas nasional kepada BUMN migas diyakininya akan mampu mewujudkan kedaulatan energi.

Syarial Mukhtar mengatakan, pembentukan induk usaha merupakan inisiatif pemerintah dan pihaknya akan mengikuti apa yang menjadi keputusan. Pertamina meyakini bahwa pembentukan induk usaha akan dapat memberikan manfaat bagi negara. Bisnis migas akan menjadi satu sehingga hambatan hambatan yang selama ini terjadi dapat diselesaikan dengan mudah.

Facilitate Oil and Gas Business, Licensing and Regulation Must Be Synchronized



Indonesia Petroleum Association (IPA) called on the government to synchronize licenses and regulations related to oil and gas projects issued from ministries and local governments. Thus, upstream oil and gas investment can rise significantly.

IPA Executive Director Marjolijn Wajong said that licensing and regulation is not an affair for oil and gas companies. With the large number of licenses to be obtained from various ministries, agencies and local governments, oil and gas companies even have to assign special staff to monitor progress in the ministry.

Not only that, every new regulation is issued, the attitude of each ministry is different so that makes investors hesitate. According to him, in order that this does not happen, the Ministry of Energy and Mineral Resources (ESDM) as handling oil and gas business should strengthen coordination and synchronize with other ministries and institutions.

"I'm glad yesterday that ESDM Minister Ignatius Jonan said he would talk to other ministry colleagues, this should be real, do not just talk. This is a big impact, because the licensing does not need to be long and does not need to put people (specifically to complete the licensing), "he said on the sidelines of The 41st IPA Convention and Exhibition in Jakarta, Thursday (18/5).

He explained, from the number of licenses to be managed by oil and gas companies around 370 permits, only 60 permits are the authority of the Ministry of Energy and Mineral Resources. The acceleration of licensing in the Ministry of Energy and Mineral Resources is certainly a good thing. However, this does not solve the problems faced by oil and gas companies. The reason, there are still many licenses to be completed in other ministries or local governments.

He exemplified the approval of environmental impact analysis (AMDAL). When the Amdal is agreed by the government, the oil and gas company still needs to take care of its derivative licenses that are not small and involve various parties. Oil and gas companies should need to re-clarify existing issues with other stakeholders.

"For example, the environmental permit must have a recommendation from the bupati. Permission is oil and gas companies that have to ask. Whereas the regent is also part of the government, "he said. Regarding regulation, Marjolijn appreciated the government's effort to publish new beleids as a solution to various problems. However, the implementation of these new regulations is not easy because it is not in line with the relevant ministries. Beleid about gross split for example, the view of the Ministry of Energy and Mineral Resources and the Ministry of Finance is not the same about the tax rules that must be embraced. Permudah Bisnis Migas, Perizinan dan Regulasi Harus Disinkronisasi


Indonesia Petroleum Association (IPA) meminta pemerintah untuk melakukan sinkronisasi perizinan dan regulasi terkait proyek minyak dan gas bumi yang dikeluarkan dari kementerian dan pemerintah daerah. Sehingga, investasi hulu migas bisa naik signifikan.

Direktur Eksekutif IPA Marjolijn Wajong mengatakan, perizinan dan regulasi bukan urusan bagi perusahaan migas. Dengan banyaknya jumlah perizinan yang harus diperoleh dari berbagai kementerian, lembaga, dan pemerintah daerah, perusahaan migas bahkan sampai harus menugaskan pegawai khusus untuk memantau progresnya di kementerian. 

Tidak hanya itu, setiap ada regulasi baru diterbitkan, sikap dari setiap kementerian juga berbeda sehingga membuat investor meragu. Menurutnya, agar hal ini tidak terjadi, Kementerian Energi dan Sumber Daya Mineral (ESDM) sebagai yang menangani bisnis migas, harus memperkuat koordinasi dan melakukan sinkronisasi dengan kementerian dan lembaga lainnya. 

“Saya senang kemarin Menteri ESDM Ignasius Jonan bilang akan bicara dengan rekan kementerian lain, ini harus riil, jangan hanya bicara saja. Ini dampaknya besar, karena perizinan tidak perlu lama dan tidak pelu menaruh orang (khusus untuk merampungkan perizinan),” kata dia di sela The 41st IPA Convention and Exhibition di Jakarta, Kamis (18/5).

Dia menjelaskan, dari jumlah perizinan yang harus diurus perusahaan migas sekitar 370 izin, hanya 60 izin yang merupakan kewenangan Kementerian ESDM. Percepatan perizinan di Kementerian ESDM tentu merupakan hal yang bagus. Namun, hal ini tidak menyelesaikan masalah yang dihadapi perusahaan migas. Pasalnya, masih banyak perizinan yang harus diselesaikan di kementerian lain atau pemerintah daerah.

“Makanya antar institusi pemerintah itu harus saling koordinasi. Perizinan bukan hanya perlu percepatan, tetapi apakah perlu sebanyak itu perizinannya,” ujar Marjolijn.

Dicontohkannya soal persetujuan analisis dampak lingkungan (Amdal). Ketika Amdal disepakati oleh pemerintah, perusahaan migas masih perlu mengurus izin-izin turunannya yang jumlahnya tidak sedikit dan menyangkut berbagai pihak. Perusahaan migas harus perlu menjelaskan kembali masalah-masalah yang ada dengan stakeholder lain.

“Misalnya izin lingkungan harus ada rekomendasi bupati. Izin ini perusahaan migas yang harus minta. Padahal bupati juga bagian dari pemerintah,” katanya. Sehingga, perusahaan migas tidak bisa hanya fokus mengerjakan teknis produksi proyek migas saja. “Kita maunya begitu Amdal disepakati, izin turunannya juga keluar,” tambahnya.

Terkait regulasi, Marjolijn menghargai upaya pemerintah menerbitkan berbagai beleid baru sebagai solusi berbagai masalah yang ada. Namun, implementasi dari peraturan-peraturan baru ini tidak mudah karena tidak sejalannya kementerian terkait. Beleid soal gross split misalnya, pandangan Kementerian ESDM dan Kementerian Keuangan tidak sama soal peraturan perpajakan yang harus dianut. Padahal perpajakan merupakan faktor penting yang harus dihitung oleh investor ketika akan mengalirkan dana. 

Investor tidak bisa diyakinkan hanya dengan kata-kata. Pemerintah harus melakukan upaya-upaya agar akhirnya investor nyaman berinvestasi di sektor hulu migas dengan kontrak gross split. “Jadi banyak yang butuh sinergi dan sinkronisasi. Artinya kalau keluar aturan, pastikan kementerian lain bersuara sama,” kata dia.

Lakukan Efisiensi

Soal tuntutan pemerintah agar perusahaan migas melakukan efisiensi dalam operasinya, Marjolijn menegaskan, pihaknya sepakat. Bahkan tanpa diminta oleh pemerintah pun, seluruh perusahaan migas pasti akan berupaya memangkas biaya produksi per barelnya supaya bisa bertahan di era harga minyak yang cukup rendah di kisaran US$ 50 per barel ini.

“Karena kalau tidak, keuntungan kontraktor jatuh banget. Jadi mereka (perusahaan migas) semua sudah mengencangkan ikat pinggang, memilah mana pengeluaran yang bisa dikurangi," ujarnya. Apalagi begitu harga minyak jatuh, Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas) sudah langsung meminta perusahaan migas merenegosiasi kontraknya dengan subkontraktor.

Sehingga, efisiensi sudah dilakukan perusahaan migas sejak 2015 lalu. Kalau tidak, kami tidak mungkin bisa survive,” tegas Marjolijn. Bahkan, kata Direktur IPA Tenny Wibowo, kantor pusat sudah pasti menekan anak usahanya di Indonesia untuk memangkas biaya. Efisiensi selalu menjadi pembahasan utama dalam setiap pertemuan dan laporan kepada kantor pusat. 

Pasalnya, tidak ada perusahaan yang senang ketika biaya naik sementara produksi migasnya turun. Perusahaan jasa penunjang disebutnya juga mulai berubah begitu harga minyak terjun bebas. Perusahaan jasa penunjang ini terbuka dengan upaya renegosiasi. “Mereka punya pemikiran sama, kini yang ditawarkan bagaimana supaya komersial (proyek) bisa masuk. Ini karena mereka juga mau hidup,” kata dia.

Marjolijn menambahkan, secara langsung industri migas memberikan kontribusi berupa penerimaan negara dan pajak. Sementara secara tidak langsung, banyak perusahaan lain yang hidup karena industri hulu migas berkembang. Perusahaan-perusahaan ini akhirnya juga memberikan kontribusi bagi negara berupa pajak. 

Senior Partner and Managing Director The Boston Consulting Deep Eddy Tamboto mengungkapkan, berdasarkan risetnya, industri hulu migas dapat memberikan kontribusi hingga US$ 120 miliar hingga 2025. Hal ini dengan catatan jika produksi migas nasional dipertahankan pada level 2015.

“Dampak akumulatif US$ 120 miliar ini, sebanyak US$ 40 miliar merupakan direct impact dan US$ 80 miliar indirect, yakni dari industri yang mendapatkan dukungan dari sektor migas,” kata dia. Dampak US$ 120 miliar itu setara dengan tambahan pertumbuhan produk domestik bruto sebesar 1,2% per tahun.

Dari sisi pasokan migas, Indonesia harus mengimpor hingga 50% dari total kebutuhan nasional pada 2025 jika tidak ada solusi atas permasalahan di industri migas. Tidak hanya itu, terdapat 40 ribu hingga 50 ribu pekerjaan yang menjadi pertaruhan ketika iklim investasi migas tidak diperbaiki.

Pertamina Wait Negotiation Result with PLN


JAMBARAN-TIUNG BUIRU PROJECT

PT Pertamina is still awaiting the results of the gas price negotiation with PT PLN before continuing the share transaction transaction talks with ExxonMobil. Pertamina, through its subsidiary, PT Pertamina EP Cepu (PEPC), intends to take over ExxonMobil's participation in the Tiung Biru Jambaran Project to ensure that the project can start generating oil and gas (on stream) by 2020.

This is a follow up letter of the Minister of Energy and Mineral Resources No. 9/13 / MEM.M / 2017 dated January 3, 2017 which instructs Pertamina to fully develop the JTB field and complete the discussion with ExxonMobil through a business to business / b to b scheme.

Upstream Director of Pertamina Syamsu Alam said that gas price agreement with PLN will be used for economic calculation from the Jambaran-Tiung Biru Project. He explained, without agreement with PLN, it can not continue the development of the Project Jambaran-Tiung Biru. It has started negotiating gas prices with PLN. Next week, the president director of each company will meet to discuss this matter.

Related to the beleid regulating the selling price of gas to PLN, Alam said, not necessarily the gas price of Project Jambaran-Tiung Biru will be the same as this beleid. It will negotiate with PLN in order to obtain a price appropriate to the project's economy.

Until there is clarity on this matter, it is not certain that the right of participation of ExxonMobil in Lapangan Jambaran-Tiung Biru field will be taken by Pertamina. "Do not know yet (ExxonMobil is releasing shares of participation or not)," Alam said.

Pertamina EP President Director Cepu Adriansyah said, based on the calculation, the appropriate gas price for the project is economical ie US $ 7 per million british thermal unit (mmbtu) with escalation of 2% per year.

Pertamina Tunggu Hasil Negosiasi dengan PLN


PT Pertamina masih menunggu hasil negosiasi harga gas dengan PT PLN sebelum melanjutkan pembicaraan transaksi saham partisipasi dengan ExxonMobil. Seperti diketahui, Pertamina melalui anak usahanya, PT Pertamina EP Cepu (PEPC), berniat mengambilalih hak partisipasi ExxonMobil di Proyek Jambaran Tiung Biru untuk memastikan proyek tersebut dapat mulai menghasilkan migas (on stream) pada 2020. 

Hal ini adalah sebagai tindak lanjut Surat Menteri ESDM No 9/13/MEM.M/2017 tertanggal 3 Januari 2017 yang memerintahkan Pertamina untuk mengembangkan secara penuh lapangan JTB dan menyelesaikan pembahasan dengan ExxonMobil melalui skema bisnis (business to business/ b to b).

Direktur Hulu Pertamina Syamsu Alam menuturkan, kesepakatan harga gas dengan PLN akan dipakai dasar perhitungan keekonomian dari Proyek Jambaran-Tiung Biru. Jika perseroan sudah memperoleh hasil perhitungan ini, baru pembicaraan soal pengalihan saham partisipasi dengan ExxonMobil akan dilanjutkan.

“Apakah ExxonMobil mau ikut atau tidak. Kalau ExxonMobil tidak mau ikut, berarti nanti akan ada b to b dengan mereka barangkali mereka mau sharedown dan kami ambil 100% Proyek Jambaran-Tiung Biru ini,” kata dia di Jakarta, Kamis (18/5).

Dia menjelaskan, tanpa kesepakatan dengan PLN, pihaknya tidak bisa melanjutkan pengembangan Proyek Jambaran-Tiung Biru. Pihaknya sudah mulai negosiasi harga gas ini dengan PLN. Pekan depan, sedianya direktur utama masing-masing perseroan akan bertemu guna membahas hal ini.

Terkait adanya beleid yang mengatur harga jual gas ke PLN, Alam mengatakan, belum tentu harga gas Proyek Jambaran-Tiung Biru akan sama dengan beleid ini. Pihaknya akan negosiasi dengan PLN supaya memperoleh harga yang sesuai dengan keekonomian proyek. 

“Ikut peraturan kalau tidak fly, bagaimana mau mulai development-nya,” ujarnya. 

Sampai ada kejelasan soal hal ini, tidak dapat dipastikan bahwa hak partisipasi ExxonMobil di Lapangan Jambaran-Tiung Biru akan diambil Pertamina. “Belum tahu (ExxonMobil melepas saham partisipasi atau tidak),” kata Alam.

Presiden Direktur Pertamina EP Cepu Adriansyah menuturkan, berdasarkan hitungannya, harga gas yang cocok agar proyek ini ekonomis yakni US$ 7 per juta british thermal unit (mmbtu) dengan eskalasi 2% per tahun.

Namun, soal kesepakatan harga nantinya dengan PLN, pihaknya akan mengikuti Pertamina. Pihaknya hanya mendengar bahwa PLN menginginkan harga gas US$ 7 per mmbtu di pembangkit miliknya. “Sementara dari kami harga sudah US$ 7 per mmbtu dan ada biaya toll fee jadi kira-kira US$ 8,5 per mmbtu,” jelasnya.

Sementara itu, Vice President Public and Government Affair ExxonMobil Erwin Marwoto enggan berkomentar soal pengalihan saham partisipasi milik perusahaan migas asal Amerika Serikat di Lapangan Jambaran ke Pertamina. 

Senada, pihaknya mengungkapkan masih terus berdiskusi dengan Pertamina. Meski demikian, ExxonMobil sampai saat ini masih mendukung pengembangan proyek ini. “Jadi persiapan proyek tetap berjalan, masalah komersial juga berjalan, paralel. Jadi (diskusi) tidak akan mengganggu persiapan Proyek Jambaran-Tiung Biru,” ujarnya.

ESDM Optimistic of Interest Investors Following Auction 15 Blocks

Selain itu pemerintah membuka data sehingga memudahkan investor untuk memberikan penawaran. Wakil Menteri ESDM, Arcandra Tahar bilang, dengan gross split, pemerintah menetapkan hasil untuk blok minyak sebesar 57% bagi investor dan 43% pemerintah. Sedangkan untuk blok gas bagi hasilnya 52% kontraktor : 48% pemerintah. 

"Base split menyesuaikan kondisi aktual lapangan, saat pengembangan melalui adjustment, baik pada komponen variabel maupun komponen progresif," kata Arcandra, Jumat (19/5).

Ia menambahkan, persyaratan minimal kegiatan eksplorasi di blok konvensional menyesuaikan kondisi masing-masing blok. Jika data sudah mencukupi, maka kontraktor wajib dilakukan pembuktian prospek dengan cara pemboran sumur. 

     Namun, bila data blok migas belum tersedia atau belum mencukupi, pemerintah memberikan syarat investor memberikan komitmen eksplorasi seismik 2D atau 3D. Sementara persyaratan minimal untuk komitmen eksplorasi di blok migas non konvensional mewajibkan pemboran sumur eksplorasi di tiap blok migas.

Arcandra mengklaim, lelang 2017 ini beda dengan 2016. Tahun ini calon investor bisa an ESDM dan Satuan Kerja Khusus Hulu Minyak dan Gas Bumi (SKK Migas). "Sekarang kami buka" katanya.

Dengan cara baru ini, pemerintah berharap lebih memudahkan investasi. Selain ilu pemerintah juga berharap akan ada kombinasi antara investor strategis.

Direktur Hulu Migas Kementerian ESDM Tunggal menambahkan, tahun Ialu ada 14 blok migas yang dilelang, namun hanya ada satu blok yang laku. "Yang menawar banyak di Blok itu, yang menang sudah ada. Karena Suratnya belum disampaikan, jadi belum bisa diberi tahu yang menang siapa. Dirjen Migas yang tandatangan," katanya Jumat (19/5).

Kemudian pemerintah mengevaluasi 13 blok yang belum laku tahun lalu. Pemerintah belum menentukan nasib 13 blok tersebut apakah dilelang ulang, atau tidak.

Pertamina Ensures PLN to Buy JTB Gas



The Tiung Biru Jambaran Blue Field (JTB) gas project is entering a new phase. PT Pertamina EP Cepu, operator in the field finally get a prospective buyer of gas that is PT Perusahaan Listrik Negara (PLN).

Upstream Director of Pertamina, Syamsu Alam said Pertamina is discussing gas price from JTB which will be purchased by PLN. "The gas is mainly used for PLN, how much PLN can absorb our gas price," Alam said on Thursday (18/5).

Pertamina and PLN have started talks, although there is no price agreement yet. Alam said, next week, there will be a meeting between Pertamina President Director and PLN President Director to discuss the price of this gas.

If the price has been agreed, Pertamina can only develop JTB field. "We have to know the price of gas, what we want to buy, but if we are unclear, there is no certainty of the price, we can not develop the field," Alam said.

However, there is a possibility that the price of gas from JTB is bought cheaper than the economic price that is expected by Pertamina. The reason, in Minister of Energy and Mineral Resources Regulation 11/2017, the Government set the price of earth germet per mmbtu at highest 8% of ICP for power generation. If it refers to the price of ICP April 2017, then the gas price of US $ 3.96 per mmbtu.

Alam said, if the price is not economically agreed then the project will not be developed. "Economically important first, follow the rules if not, how to start construction," said Alam.

Actually JTB project can be economical if gas price sold US $ 7 escalation 2% per year since production. "The model that we count, if for example the certainty of the ability of different PLN, please say, we can also say to the government," said Pertamina EP Cepu President Director, Adriansyah.

He claims PLN is actually able to pay the gas price from JTB of US $ 7 per mmbtu. "PLN that I know can be US $ 7 per mmbtu, while from US $ 7 per mmbtu plus toll fee to US $ 8.5 per mmbtu," added Ardiansyah.

Pertamina Pastikan PLN Beli Gas JTB


Proyek gas Lapangan Jambaran Tiung Biru (JTB) memasuki tahap baru. PT Pertamina EP Cepu, operator di lapangan tersebut akhirnya mendapatkan calon pembeli gas yaitu PT Perusahaan Listrik Negara (PLN). 

Direktur Hulu Pertamina, Syamsu Alam bilang, Pertamina sedang diskusi harga gas dari JTB yang akan di beli oleh PLN. "Gasnya terutama dipakai untuk PLN. Berapa besar PLN bisa menyerap harga gas kami," kata Alam, Kamis (18/5).

Pertamina dan PLN sudah memulai pembicaraan, meski belum ada kesepakatan harga. Alam bilang, pekan depan nanti, akan ada pertemuan antara Direktur Utama Pertamina dan Dirut PLN untuk membahas harga gas ini. 

Jika harga telah disepakati Pertamina baru bisa mengembangkan lapangan JTB. "Kami harus harus tahu dulu harga gasnya, mau dibeli berapa. Kalau kami belum jelas, kepastian harganya belum ada, kami tidak mungkin mengembangkan lapangan, " kata Alam. 

Namun, ada kemungkinan harga gas dari JTB dibeli lebih murah dari harga keekonomian yang diharapkan Pertamina. Pasalnya, dalam Peraturan Menteri ESDM 11/2017, Pemerintah mengatur harga agas bumi per mmbtu paling tinggi 8% dari ICP untuk pembangkit tenaga listrik. Jika merujuk pada harga ICP April 2017, maka harga gas sebesar US$ 3,96 per mmbtu.

Alam bilang, bila harga yang nanti disepakati tidak ekonomis maka proyek tersebut tidak akan bisa dikembangkan. "Ekonomis dulu yang penting. Ikut peraturan kalau tidak, bagaimana mau mulai pembangunannya? kata Alam. 

Sebenarnya proyek JTB bisa ekonomis jika harga gas dijual US$ 7 eskalasi 2% per tahun sejak produksi. "Model itu yang kami hitung, kalau misalkan kepastiannya kesanggupan PLN beda, silahkan bilang, kami juga bisa bilang ke pemerintah," kata Direktur Utama Pertamina EP Cepu, Adriansyah.

Dia mengklaim PLN sebenarnya sanggup membayar harga gas dari JTB sebesar US$ 7 per mmbtu. "PLN yang saya tahu sanggup US$ 7 per mmbtu, sementara dari kami US$ 7 per mmbtu plus toll fee jadi US$ 8,5 per mmbtu," tambah Ardiansyah.
