Pemerintah akan terus membangun jaringan gas sampai mencapai 1,2 juta sambungan pada 2019. “Tahun ini pemerintah menganggarkan Rp 1,14 Triliun untuk bisa membangun jaringan gas baru di beberapa kota/kabupaten dengan jumlah 53-59 ribu sambungan,” kata Wiratmaja.

Sambungan ini akan dikerjakan pemerintah pada tahun ini melalui penugasan kepada PT Pertamina dan PT PGN Tbk. Pertamina ditugasi mengerjakan jaringan gas di Kota Pekanbaru, Kabupaten Penukal Abab Lematang Ilir, Kabupaten Muara Enim, Kabupaten Mojokerto, Kota Samarinda dan Kota Bontang. Sementara, PGN membangun jaringan gas di Kabupaten Musi Banyuasin, Kota Bandar Lampung, DKI Jakarta dan Kota Mojokerto. Untuk di Kalimantan Timur, pemerintah bakal membangun 14.500 sambungan jaringan gas. “Untuk Kalimantan Timur, tahun ini akan dibangun di Bontang 10 ribu sambungan dan Samarinda 4.500 sambungan,” kata dia. 

Saat ini, sebanyak 3.849 rumah tangga di Kelurahan Karang Jati, Balikpapan telah tersambung jaringan gas dan sudah dapat menikmati pasokan gas. Pembangunan dan pengoperasian jaringan gas Kota Balikpapan ini merupakan penugasan Pemerintah kepada Pertamina dengan dana APBN 2016 sebesar Rp 49,7 miliar, berdasarkan Keputusan Menteri ESDM No 4822K/ 12/MEM/2015. Warga kini tidak perlu khawatir lagi dengan adanya kelangkaan gas. jaringan gas hadir di rumah-rumah warga ini dengan suplai kontinyu, 24 jam ada gas,” jelas Wiratmaja.

Gas untuk jaringan gas Kota Balikpapan diperoleh dari Blok East Kalimantan yang dikelola PT Chevron Indonesia Company dengan alokasi 500 ribu kaki kubik per hari. Wiratmaja menjamin, pasokan gas akan terus ada meski kontrak kerja sama (production sharing contract/ PSC) Chevron bakal berakhir di Oktober 2018. Pemerintah akan mengupayakan operasi migas di Blok East Kalimantan terus berlanjut. “Kontrak Chevron habis di tahun 2018. Tetapi gas masih di bawah, hanya ganti operator saja. Kami beri arahan agar keberlangsungan operasi tetap baik,” ujarnya.

Menurut Wiratmaja, selain memudahkan masyarakat memperoleh gas, jaringan gas juga diharapkan bisa mengurangi impor dan subsidi liquefied petroleum gas/LPG secara signifikan. Sehingga, subsidi LPG tidak lagi memberatkan keuangan negara. Karenanya, pemerintah menargetkan dapat menyelesaikan jaringan gas sebanyak 1,2 juta sambungan. Walaupun, diakuinya realisasi pembangunan jaringan gas masih minim, yakni sekitar 189 ribu sambungan. Hal ini disebabkan oleh terbatasnya anggaran pemerintah. “Kami ingin membangun banyak tetapi terbatas oleh anggaran. Makanya ini harus dicarikan terobosan,” jelasnya. Ke depannya, pemerintah bakal melanjutkan proyek jaringan gas ini. Khusus di Kalimantan Timur, jaringan gas akan diperluas di Kutai Kertanegara dan diperbanyak jumlahnya di Balikpapan dan Bontang. Pemerintah juga mendorong badan usaha untuk ikut membangun infrastruktur gas nasional, termasuk jaringan gas.

Pertamina Siap

Untuk jaringan gas Balikpapan, Pertamina menugaskan afiliasinya PT Pertagas Niaga (PT PGN) untuk mengelola dan mengoperasikan jaringan gas bekerjasama dengan BUMD setempat. Pertamina juga siap mengerjakan penugasan pembangunan jaringan gas dari pemerintah untuk 2017. “Melalui APBN 2017, Pertamina akan membangun jaringan gas di Kota Pekanbaru, Samarinda, Bontang, Kabupaten Muara Enim, Penukal Abab Lematang Ilir, dan Kabupaten Mojokerto,” kata President Director Pertagas Niaga Linda Sunarti.

Selain menggunakan APBN, Pertamina juga menggembangkan jaringan gas di Kota Jambi dan Prabumulih. Pertamina menargetkan bakal ada jaringan gas sebanyak 130 ribu sambungan yang akan beroperasi pada tahun ini. Jumlah ini termasuk jaringan gas yang dibangun dengan dana APBN maupun modal perseroan. “Sebagai BUMN energi, Pertamina mendukung perluasan program jaringan gas agar masyarakat bisa mendapatkan energi dengan kualitas yang lebih baik,” kata Linda.

Jaringan gas di Balikpapan dioperasikan oleh PT Pertagas Niaga, anak usaha PT Pertamina. Direktur Jenderal Minyak dan Gas Bumi Kementerian Energi dan Sumber Daya Mineral (ESDM) I Gusti Nyoman Wiratmaja mengatakan, tahun ini akan ada 53,000 sampai 59.000 sambungan gas rumah tangga yang dibangun di sejumlah kota di Indonesia.

Kepala Juru Bicara SKK Migas Taslim Z. Yunus mengatakan, pihaknya sedang melakukan pembahasan secara intens untuk menyelesaikan peralihan kontraktor dan kontrak pada blok yang ditugaskan kepada PT Pertamina. SKK Migas akan mengeluarkan perjanjian yang mengakomodasi kegiatan di masa transisi di antara operator eksis dan operator baru. SKK Migas akan mengeluarkan Surat keputusan, tidak perlu mengeluarkan pedoman tata kerja (PTK) agar kegiatan di masa transisi memiliki perlindungan hukum.

Menurutnya, Pertamina sebagai operator baru bisa memulai investasi sebelum masa kontrak berakhir. Kemudian, seluruh izin penggunaan aset negara juga kontrak sedang disiapkan agar peralihan dari kontrak cost recovery ke gross split tidak mendadak seperti yang terjadi pada Blok Offshore North West Java (ONWJ) yang ditandatangani pada Januari 2017. “Sebetulnya PTK tidak  perlu, keputusan SKK Migas saja karena yang berkontrak hanya SKK Migas, operator yang lama, sama operator yang akan datang," ujarnya.

Hal lain yang juga harus diselesaikan, ujar Taslim, penggantian biaya investasi di masa transisi ketika masih menerapkan kontrak cost recovery. Menurutnya, biaya pada delapan wilayah kerja tersebut harus dihitung agar bisa dikonversi menjadi bagian kontraktor. “Makanya unrecovered cost-nya harus diperhatikan dari sekarang. 

Sebelumnya, Direktur Hulu Pertamina Syamsu Alam mengatakan, pemerintah telah memberikan surat terkait keputusan pengelolaan delapan wilayah kerja yang akan habis masa kontraknya pada 2018. Tiga dari delapan wilayah kerja tersebut, hanya mengalami peralihan dari kontrak bagi hasil (production sharing contract/PSC) cost recovery menjadi gross split yaitu Blok Tuban (JOB Pertamina-PetroChina East Java), Blok Ogan Komering, (JOB Pertamina-Talisman), dan Blok North Sumatera Offshore (Pertamina).

Bila tidak segera dilakukan kegiatan, potensi penurunan produksi semakin tinggi. Oleh kanena itu, perseroan bisa mengurangi laju penurunan produksi dengan cara memulai kegiatan sebelum kontrak berakhir seperti yang dilakukan pada Blok Mahakam.

Juga ada jaminan alokasi gas sesuai dengan kontrak. Kemudian, investasi pembangkit di depresiasi sekurang-kurangnya 20 tahun. Lalu, ada jaminan pengembang dengan specific fuel consumption (SFC) setara minyak solar (HSD) sebesar 0,25 liter per kWh. Apabila melalui pelelangan umum, dilakukan jika harga lebih tinggi dari 8 persen ICP. ”Titik penyerahan listrik pada gardu induk terdekat,” kata Jarman

 Setelah masa kontrak TOTAL E&P Indonesie terhadap Blok Mahakam habis di akhir 2017, Pertamina diketahui mendapat hak partisipasi 100%. Pertamina resmi menjadi operator per 1 Januari 2018, tetapi tetap dipersilakan menggandeng operator eksisting, Total dan Inpex Corporation dengan memberi hak partisipasi minoritas 30%. Kendati demikian, BUMN energi itu ingin berinvestasi lebih awal demi menjaga tingkat produksi lapangan kaya gas itu.

 Kementerian ESDM kemudian menyetujui amendemen kontrak bagi hasil (production sharing contract/PSC) periode 2018-2038 sebagai kepastian hukum bagi PT. Pertamina Hulu Mahakam (PHM) selaku anak usaha Pertamina untuk berkontribusi dalam Rencana Kerja dan Anggaran (WP&B) Blok Mahakam 2017.  Gas dari enam sumur yang diproduksi tahun ini dengan perkiraan mencapai 1,4-1,5 tcf dan produksi minyak di kisaran 50 ribu boepd. “Kegiatan pengeboran (enam sumur) itu dimulai Maret. Revisi ini diklaim memberikan insentif yang meringankan bisnis migas di Indonesia. Direktur Minyak dan Gas Bumi Kementerian Energi dan Sumber Daya Mineral (ESDM) I Gusti Nyoman Wiratmaja mengatakan, revisi beleid cost recovery itu sudah selesai. Saat ini peraturan baru ini masih dalam proses perundangan. “Sebentar lagi, yang jelas sudah bukan di Kementerian ESDM lagi. Itu (revisi Peraturan Pemerintah (PP) 79/2020) sangat kami tunggu,” kata dia. 

Wakil Badan Kebijakan Fiskal Kementerian Keuangan Goro Ekanto menambahkan, revisi PP cost recovery ini sudah di Sekretariat Negara. Selanjutnya, bakal ada diskusi antara Kementerian Koordinator Perekonomian, Kementerian ESDM, dan Sekretariat Negara. “Artinya tidak lama lagi,” ujarnya. Wiratmaja membeberkan beberapa poin revisi PP 79/2010. Beleid baru itu bakal memberikan kepastian soal perpajakan dalam bisnis migas. Beleid itu juga akan memperjelas fasilitas insentif non fiskal yang dapat diperoleh perusahaan migas, diantaranya investment credit, percepatan depresiasi, dan DMO (domestic market obligation/ kewajiban pasok dalam negeri). 

Sementara untuk insentif fiskal tersebut pernah disebutkan sebelumnya yakni, pada masa eksplorasi dan eksploitasi, pajak pertambahan nilai (PPN) impor, bea masuk, PPN dalam negeri, dan pajak bumi dan bangunan (PBB) akan ditanggung oleh Negara. Selain itu, kontraktor migas juga akan memperoleh pembebasan pajak penghasilan (PPh) pemotongan atas pembebanan biaya operasi fasilitas bersama dalam rangka pemanfaatan barang milik negara dan alokasi biaya overhead kantor pusat. Wiratmaja menyebut, PP 79/2010 tidak memberikan kepastian ini. “Kemudian POD Basis diubah menjadi Block Basis,” katanya. Dalam beleid lama, juga tidak ada kejelasan terkait Block Basis ini.

Selanjutnya, revisi PP 79/2010 ini disebutnya juga menerapkan konsep bagi hasil sliding scale. Dengan skema ini, pemerintah bisa memperoleh bagi hasil lebih besar apabila terdapat windfall profit. Terakhir, revisi itu juga memuat standar dan norma pemeriksaan yang sama dengan pedoman pemeriksaan yang digunakan oleh Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas) dan Ditjen Pajak. Dalam peraturan lama, konsep bagi hasil menganut prinsip fixed scale, sehingga negara tidak mendapat tambahan bagi hasil ketika terdapat windfall profit. 

Sementara soal pemeriksaan, audit-nya dilakukan berlapis oleh beberapa institusi, yakni SKK Migas, Badan Pemeriksa Keuangan (BPK), Badan Pengawasan Keuangan Pembangunan (BPKP), serta Ditjen Pajak. Namun, Goro menambahkan, prinsip Assume and Discharge yang diminta oleh perusahaan migas tidak bisa diberikan dalam revisi PP cost recovery itu. Pasalnya, Undang-Undang tidak membolehkan pemberlakuan prinsip ini. Meski demikian, pemerintah fasilitas yang setara dengan prinsip tersebut. “Secara teknis kami setuju fasilitasnya harusnya meringankan.

Saat eksplorasi, ada ketentuan baru ini harusnya meringankan,” tambahnya. Dalam draf revisi PP 79/ 2010 yang diperoleh Investor Daily disebutkan Menteri ESDM dapat menetapkan bentuk dan besaran insentif kegiatan hulu untuk pengembangan blok migas, terutama menyangkut keekonomian proyek. Insentif yang diberikan bisa berupa insentif perpajakan dan penerimaan negara bukan pajak sesuai dengan ketentuan peraturan perundangan.

Sebelumnya, Pemerintah sepakat merevisi PP 79/2010 guna menarik investasi. Dalam revisi itu, pemerintah akan memberikan insentif fiskal dan non-fiskal yang menaikkan keekonomian proyek, serta menerapkan konsep sharing the pain and the gain. PP 79/ 2010 perlu direvisi lantaran menjadi penghambatan investasi migas nasional. Jika tidak dicarikan solusi, beleid ini bakal membuat kegiatan hulu migas terus berkurang yang tercermin dari terus menurunnya produksi minyak dari 800 ribu barel per hari (bph) pada tahun ini dan diprediksi menjadi 400 ribu bph pada 2020. Penurunan ini bukan hanya lantaran sumur migas yang sudah tua, tetapi juga tidak adanya kegiatan eksplorasi.

Pemerintah telah merinci sejumlah permasalahan terkait PP 79/2010. Pertama, pemberlakuan PP 79/ 2010 menghapus rezim assume and discharge dimana pemerintah akan mengganti seluruh pajak tidak langsung yang dibayar kontraktor melalui re-imbusement. PP 79/ 2010 mengubahnya menjadi rezim cost recovery dimana pajak tersebut dibayar pada kontraktor sebagai biaya operasi dan dapat masuk cost recovery. 

Perubahan ini dinilai memperbesar risiko yang harus ditanggung investor. Pasalnya, kontraktor migas harus menanggung pajak bahkan sejak masa eksplorasi yang jika gagal, maka menjadi beban permanen investor. Penghapusan assume and discharge juga membuat keekonomian proyek semakin menurun, utamanya di proyek laut dalam yang butuh biaya besar

Total Masih Review Keikutsertaan di Blok Mahakam

PT Total E&P Indonesie masih mengkaji partisipasi dalam mengelola Blok Mahakam menjelang alih kelola pada 1 Januari 2018. Ladang gas yang terletak di Kutai Kalimantan Timur tersebut secara resmi akan diserahkan kepada PT Pertamina Hulu Mahakam pasca berakhir kontrak pada 31 Desember 2017. ”Saya selalu sampaikan bahwa saat ini kita prioritas pada transisi terlebih dahulu supaya berjalan lancar. Setelah itu baru kita diskusi ke situ," ujar President and General Manager Total E&P Indonesie Arividya Noviyanto di Kementerian Koordinator Kemaritiman.

Menurutnya, pada masa transisi ini pihaknya masih fokus mengantisipasi penurunan produksi alami di Blok Mahakam. Hal itu sesuai kesepakatan bersama antara pemerintah dari Pertamina. Sesuai komitmen Total sampai kuartal I/ 2017 tetap melakukan investasi di Blok Mahakam. Perusahaan asal Prancis ini akan melakukan pengeboran enam sumur Maret mendatang. 

Sementara Pertamina telah berinvestasi akan melakukan pengeboran sebanyak 19 sumur. Dia melanjutkan, Pertamina memberi peluang jika Total berkeinginan ikut serta berpartisipasi mengembangkan Blok Mahakam. Menurut dia, Pertamina membuka pintu kepada Total untuk membicarakan keikutsertaan sampai akhir tahun ini.

Melalui Peraturan Menteri Energi dan Sumber Daya Mineral (ESDM) No 30/2016 bersamaan dengan amendemen kontrak bagi hasil (production Sharing contract / PSC) Blok Mahakam akhir tahun lalu, Pertamina diberikan izin untuk menawarkan 30% hak pengelolaan kepada kontraktor yang telah ada. Namun, Pertamina juga diperbolehkan bermitra dengan kontraktor baru. 

Direktur Hulu Pertamina Syamsu Alam sebelumnya mengatakan, investasi yang tanamkan untuk menjaga produksi Blok Mahakam dianggarkan sebesar USD 80 juta. Investasi awal tersebut akan digunakan untuk mengebor 19 sumur mulai kuartal II tahun ini. Targetnya saat alih kelola tidak terjadi penurunan produksi. Kami sudah sepakat pada 2018 tidak turun jauh karena sulit menaikkan lagi.

Dia berharap saat alih kelola produksi gas Blok Mahakam tetap di atas 1 miliar kaki kubik (BCP). Adapun kapasitas produksi gasnya sebesar 1.747 MMSCFD dan kondensat 69.186 barel per hari (bph). "Kami sedang bekerja terus dengan kawan-kawan di Total sehingga kekhawatiran penurunan produksi tidak terjadi,”katanya.

Kepala Bagian Humas Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas). Taslim Yunus mengatakan, pemerintah akan mempercepat masuknya Pertamina di dalam masa transisi delapan blok migas yang akan berakhir masa kontraknya. Pengelolaan blok-blok migas itu akan diserahkan kepada Pertamina.

Untuk sejumlah blok akan digunakan skema bagi hasil terbaru yaitu gross split . SKK Migas bersama Pertamina masih memastikan tidak ada penurunan produksi. Setelah itu Pertamina akan di izinkan masuk atau berinvestasi lebih awal seperti di Blok Mahakam.
