Skema Baru Bagi Hasil Migas Disosialisasikan
Pemerintah akan melakukan sosialisasi terkait perubahan sistem bagi hasil minyak dan gas bumi (production sharing contract /PSC) menjadi gross split. Perubahan sistem bagi hasil ini akan berlaku mulai tahun depan. "Dalam waktu dekat Kementerian ESDM akan melakukan sosialisasi terkait skema gross split ini kepada seluruh pihak, khususnya pelaku usaha industri hulu migas,” ujar Menteri
Energi dan Sumber Daya Mineral Ignasius Jonan.
Menurut Jonan, sosialisasi tersebut untuk menjelaskan bahwa penerapan skema gross split bertujuan menciptakan kontraktor kontrak kerja sama (KKKS) beserta bisnis penunjangnya menjadi entitas bisnis global dan menciptakan daya saing tinggi di dalam negeri. Kementerian ESDM juga menyebut penggantian sistem bagi hasil guna meningkatkan efisiensi KKKS dengan menghilangkan cost recovery Serta meningkatkan pendapatan negara dengan tidak meninggalkan fungsi kontrol SKK Migas.

Indonesia salah satu negara penghasil minyak dan gas terbesar di dunia. Pernyataan yang benar sekali, tetapi itu dulu pada 1970-an. Kalau berpatokan pada tingkat produksi minyak sekitar 800.000 barel perhari saat ini dengan situasi produksi yang konstan, cadangan minyak Indonesia hanya akan bertahan hingga 12 tahun ke depan. Sejak 12 tahun lalu, negeri ini telah mencatatkan diri sebagai net impor minyak.
Selanjutnya, pada 2024 Indonesia diprediksi menjadi negara net impor gas. Celakanya, kegiatan eksplorasi minyak dan gas semakin menurun. Data menunjukkan, pada 2012 terdapat 72 aktivitas eksplorasi minyak kemudian anjlok menjadi 12 pada periode 2013 hingga 2015, padahal antara 20l2 sampai 2014 harga minyak sedang bagus. Hal itu harus dibaca bahwa ada persoalan besar yang membuat investor menahan diri mengeksplorasi minyak di Indonesia.
Memang, pemerintah tidak diam saja untuk merangsang investor senantiasa menanamkan modal dalam eksplorasi minyak. Sejumlah aktivitas birokrasi dipangkas melalui sejumlah penyederhanaan perizinan hingga rencana perubahan skema bagi hasil yang lebih praktis. Selama ini, pola bagi hasil minyak antara negara dan kontraktor kontrak kerjasama (KKKS) berada pada kisaran 85% untuk negara dan 15% buat kontraktor.
Selain itu, kontraktor masih dapat kompensasi lewat cost recovery yang diambilkan dari bagian negara. Cost recovery adalah biaya yang digantikan negara atas pengeluaran kontraktor untuk memproduksi minyak. Belakangan ini, terkait dengan cost recovery, banyak sekali mendapat sorotan karena dinilai selain tidak efisien juga merepotkan KKKS sehingga perlu dirumuskan ulang agar kedua pihak bisa diuntungkan. Lihat saja, dalam Anggaran Pendapatan dan Belanja Negara Perubahan (APBN-P) 2016 pos untuk cost recovery mencapai sebesar USD 11,6 miliar, sedangkan tahun depan sedikit diturunkan dengan pengalokasian anggaran sebesar USD 10,4 miliar.
Meski angka cost recovery tersebut sudah dipangkas USD1,2 miliar oleh Wakil Menteri Energi dan Sumber Daya Mineral (ESDM) Arcandra Talhar, masih dinilai terlalu mahal yang berdampak pada penurunan pendapatan negara. Sebelumnya, Menteri Koordinator (Menko) Maritim Luhut B Pandjaitan sudah menitipkan pekerjaan rumah kepada petinggi Kementerian ESDM untuk meninjau atau menghitung ulang biaya operasi perusahaan minyak yang dikembalikan oleh negara atau cost recovery.
Pemerintah menargetkan revisi cost recovery bisa dituntaskan sebelum akhir tahun ini. Selain dinilai mahal, cost recovery juga ditengarai sebagai sumber kebocoran anggaran negara yang luput dari perhatian selama ini. Dalam laporan keuangan pemerintah pusat 20 15 yang diserahkan Badan Pemeriksa Keuangan (BPK) kepada Presiden Joko Widodo (Jokowi), salah satu temuan yang mengemuka adalah cost recovery membengkak sebesar Rp 2,56 triliun.

Pertemuan yang baru bergulir sekitar 10 menit, pimpinan sidang menskors rapat kerja karena tulisan data cost recovery 2015-2016 sulit terbaca oleh anggota Komisi VII DPR.
Secara terbuka, pihak DPR menyatakan persoalan cost recovery selama ini kurang transparan, padahal alokasi anggaran sangat besar. Rencananya skema bagi hasil minyak akan diganti dengan pola gross split . Seperti apa gross split itu. Gambaran sederhananya adalah bagi hasil negara dan KKKS masing-masing 50% dari hasil produksi minus cost recovery. Jadi, negara terbebas dari penggantian biaya operasi produksi minyak yang dikeluarkan KKKS sehingga bagian yang diterirna negara bersih sebanyak 50%.
Di sisi lain berpotensi besar mendongkrak pendapatan KKKS seandainya aktivitasnya lebih efisien. Penghapusan cost recovery bukan berarti tanpa risiko. Kalangan pelaku industri penunjang hulu migas di dalam negeri kini menjadi panas dingin. Pasalnya, dalam skema cost recovery pemerintah bisa mewajibkan KKKS memakai produk dalam negeri, mengatur tingkat kandungan dalam negeri (TKDN) karena pengeluaran operasional KKKS ditanggung oleh negara. Karena itu, adalah hal wajar kalau Kamar Dagang dan Industri (Kadin) Indonesia menitipkan kepada pemerintah agar perubahan skema bagi hasil minyak tidak merugikan industri nasional

ESDM Menerapkan Syarat TKDN di Gross Split

Arcandra Tahar, Wakil Menteri Energi dan Sumber Daya Mineral (ESDM), mengungkapkan, semakin banyak TKDN yang dipakai oleh Kontraktor Kontrak Kerja Sama (KKKS), akan semakin besar pula split yang didapat mereka.
Kalau mereka (KKKS) tidak mau memakai TKDN maka split tidak dapat besar. Dan tidak ada insentif. Dia juga tidak ingin berandai-andai, jika pada penerapannya malah gagal meningkatkan pendapatan untuk negara. Sejauh ini pemerintah dan beberapa asosiasi penunjang migas juga akan melakukan diskusi soal masalah penerapan TKDN. Direktur Indonesian Petroleum Association (IPA) Marjolijn Wajong, belum mau menegaskan soal pemakaian TKDN bagi KKKS, jika nantinya skema gross split akan diterapkan pada Januari 2017.
IPA mengaku diskusi belum sampai soal TKDN. Tapi yang saya bisa katakan bahwa soal TKDN dan soal teknologi, KKKS akan seefisien mungkin, karena cost akan ditanggung sepenuhnya oleh KKKS. Revisi UU Migas Rumuskan Pengganti SKK Migas
Proses revisi Undang-Undang Migas di DPR masih terkendala. Ini karena belum ada kesepakatan tata kelola sektor hulu migas, terutama dalaru menentukan badan pengganti Satuan Kerja Khusus Pelaksana Hulu Minyak dan Gas Bumi (SKK Migas) guna memenuhi amanat keputusan Mahkamah Konstitusi Komisi VII DPR mengusahakan agar peran SKK Migas sebagai pengelola sektor Hulu migas bisa dikembalikan lagi ke Pertamina, tapi jangan sampai mengulang kesalahan di masa lalu.
Yang belum disepakati di Komisi VII adalah bentuk kelembagaan hulu migas. Fraksi Gerindra dan Nasdem sebetulnya sudah sepakat, SKK Migas sebaiknya disatukan dengan Pertamina, tapi dengan beberapa modifikasi, kata Harry Purnomo, anggota Komisi VII. Harry menekankan, posis Pertamina sangat menentukan dalam mewujudkan ketahanan energi, dalam hal ini mengamankan pasokan migas untuk masyarakat. Sedangkan, peran perusahaan migas swasta nasional selama ini hanyalah sebagai pelengkap.
Karena itu, sangat penting mendorong Pertamina bisa kembali menguasai produksi migas nasional melalui penguasaan sektor hulu. Harga Naik, Tren Produksi Masih Turun
Harga minyak dan gas, tahun depan, cenderung lebih tinggi dibandingkan dengan dua tahun terakhir. Hal ini berpeluang meningkatkan penerimaan negara secara signifikan. Persoalannya, tren penurunan volume produksi minyak dan gas yang terjadi sejak 2004 masih akan berlanjut pada tahun depan. Dosen Universitas Trisakti, Pri Agung Rakhmanto menyatakan, terpilihnya Donald Trump sebagai Presiden Amerika Serikat (AS) menimbulkan ketidakpastian perekonomian global dan berpotensi memunculkan ketegangan antara AS dan sejumlah negara mitra. Hal ini menjadi faktor utama yang mendorong harga minyak dunia naik.
Faktor ini diperkuat dengan keputusan Organisasi Negara-Negara Pengekspor Minyak (OPEC) memotong produksi 1,2 juta barrel per hari, dari 33,7 juta barrel menjadi 32,5 juta barrel. Ini berlaku per Januari-Juni 2017 dan dapat diperpanjang untuk paruh kedua pada 2017. Pri memperkirakan harga rata-rata selama 2017 berkisar 55-60 dollar AS per barrel, sementara asumsi dalam Anggaran Pendapatan dan Belanja N egara 2017 adalah 45 dollar AS per barrel.

Tahun lalu, realisasinya anjlok menjadi Rp 78,2 triliun.

MK memutuskan pasal yang mengatur tugas dan fungsi BP Migas sebagaimana diatur dalam UU Nomor 22 Tahun 2001 tentang Minyak dan Gas Bumi bertentangan dengan UUD 1945 dan tidak memiliki hukum mengikat. Gugatan ke MK diajukan oleh sejumlah organisasi masyarakat. Untuk mengisi kekosongan hukum, pernerintah lalu mengeluarkan Peraturan Presiden Nomor 95 Tahun 2012 untuk membentuk Satuan Kerja Sementara Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas).
Meski demikian, hal itu dipandang tidak cukup sehingga menimbulkan ketidakpastian dalam iklim investasi hulu migas di Indonesia. Ditambah dengan harga minyak yang turun, eksplorasi migas menjadi lesu. Secara terpisah, peneliti Lembaga Ilmu Pengetahuan Indonesia Maxensius Tri Sambodo memproyeksikan harga minyak dunia tahun depan berkisar 55-60 dollar AS per barrel. Pada satu sisi, ini akan meningkatkan penerimaan negara.

Tagih Kompensasi JOB-PPEJ
Puluhan warga dan Karang Taruna Desa Rahayu Kecamatan Soko mendatangi Kantor Pemerintah Daerah Kabupaten Tuban dengan jalan kaki melewati jalur Soko, Rengel, Grahagan, Semanding dan Tuban, Rabu (14/12). Mereka datang ke Pemda ingin menemui Bupati H. Fathul Huda dengan tujuan meminta bantuannya dalam memperjuangkan tuntutan untuk mendapatkan dana kompensasi dampak flaring yang dilakukan Joint Operating Body Pertamina Petrochina East Java (JOB PPE).
Dalam orasinya di depan kantor Pemerintah Daerah, massa menuntut agar kompensasi yang nunggak selama 12 bulan segera dibayar. Koordinator Aksi, Miftakhul Khoiri mengatakan, tuntutan itu dilakukan mengacu pada kesepakatan warga dengan JOB PPEJ dan SKK Migas Jabanusa pada tahun 2009 lalu yang hingga kini belum berakhir. "Kami lakukan jalan kaki ke Pemerintah Daerah Tuban untuk menuntut dana kompensasi selama 12 bulan Tahun 2016 sebanyak 3,4 Miliar segera dibayarkan oleh JOB PPEJ," terangnya. Ia juga menegaskan, menolak opsi dana tali asih yang diberikan oleh pihak JOB-PPEJ kepada warga. Sebab menurutnya, tali asih tidak sesuai dengan kesepakatan sebelumnya.
Dalam kesempatan itu, massa hanya ditemui Wakil Bupati Noor Nahar Husein. Wakil Bupati mengatakan pihaknya masih akan melakukan pertemuan dengan warga terdampak, DPRD Tuban, SKK Migas dan JOB PPEJ di Kantor Kecamatan Soko untuk mengambil jalan tengah atau solusi atas permasalahan tersebut. Rencana kami akan menggelar pertemuan yang mempertemukan warga dengan JOB PPEJ dan SKK Migas, agar permasalahan ini cepat selesai. Puluhan warga Desa Rahayu akhirnya membubarkan diri setelah mendapatkan penjelasan dari Wakil Bupati.
